Section 500. Basis for Denial of License. The following shall be grounds for denying the issuance orrenewal of a license under this or<strong>di</strong>nance. If a license is mistakenly issued or renewed to a person, it shallbe revoked upon the <strong>di</strong>scovery that the person was ineligible for the license under this section.A. The applicant is under the age of eighteen (18) years.B. The applicant has been convicted within the past five years of any violation of a Federal,State or local law, or<strong>di</strong>nance provision, or other regulation relating to tobacco, tobaccoproducts or tobacco-related devices.C. The applicant has had a license to sell tobacco, tobacco products or tobacco-related devicesrevoked within the prece<strong>di</strong>ng twelve months of the date of application.D. The applicant fa<strong>il</strong>s to provide information required on the application, or provides false ormislea<strong>di</strong>ng information.E. The applicant is prohibited by Federal, State or other local law, or<strong>di</strong>nance, or other regulationfrom hol<strong>di</strong>ng such a license.F. The applicant is delinquent in the payment of Federal, State, or local taxes.G. The applicant or proposed business location is in violation of any local or<strong>di</strong>nances.Section 600. Prohibited Sales. It shall be a violation of this or<strong>di</strong>nance for any person to sell or offer tosell any tobacco, tobacco product or tobacco-related device:A. To any person under the age of eighteen (18) years.B. By means of any type of ven<strong>di</strong>ng machine.C. By means of self-service methods whereby the customer does not need to make a verbal orwritten request to an employee of the licensed premise in order to receive the tobacco, tobaccoproduct or tobacco-related device and whereby there is not a physical exchange of the tobacco,tobacco product or tobacco-related device between the licensee or the licensee’s employee andthe customer.D. Containing opium, morphine, jimson weed, bella donna, strychnos, cocaine, marijuana, orother deleterious, hallucinogenic, toxic or controlled substances except nicotine and othersubstances found naturally in tobacco or added as part of an otherwise lawful manufacturingprocess.E. Inclu<strong>di</strong>ng any product sold to minors containing or delivering nicotine or lobelia intended forhuman consumption, or any part of such a product, that is not tobacco as defined by MinnesotaStatutes 609.685, unless that product has been approved or otherwise certified for legal sale bythe United States Food and Drug Administration for tobacco use cessation, harm reduction, or forother me<strong>di</strong>cal purposes, and is being marketed and sold solely for that approved purpose.F. By any other means, to any other person, or in any other manner or form prohibited by Federal,State, or other local law, or<strong>di</strong>nance provision or other regulation.
