The Republic of Moldova proclaimed in the preamble of the Constitution the<br />
human dignity as supreme value of the state, and in Article 1.3 stated that the<br />
dignity of people represents one of supreme values of a state governed by the rule<br />
of law. Therefore, the dignity is considered the basic criterion in the concept of<br />
human rights, which is offered to people at birth.<br />
In defining the juridical notion of human dignity, it is worth to take into consideration<br />
three criteria: human dignity as judicial institution, the inviolability’s<br />
guarantee of human dignity, its observance and protection.<br />
Basic human rights and liberties are considered guaranties that ensure the<br />
human dignity and the value of a right or liberty can be appreciated in the light<br />
of the human dignity.<br />
The Constitutional Court justified its position on the necessity to protect the<br />
human dignity by public authorities in 18 decisions.<br />
The grant of the right to direct access of citizens to the Constitutional Court<br />
through the constitutional application can play a major role in protecting the<br />
human dignity.<br />
Regardless the person’s relations with the state power, his dignity comes indisputably<br />
within the protection by the state.<br />
Declaraţia Universală a Drepturilor<br />
Omului este primul act de<br />
valoare universală оn domeniul drepturilor<br />
omului. „Datorită statutului<br />
său moral şi importanţei juridice şi<br />
politice dobоndite de-a lungul anilor,<br />
Declaraţia se află alături de Magna<br />
Carta, Declaraţia franceză a drepturilor<br />
omului şi Declaraţia de independenţă a<br />
Americii, ca reper fundamental оn lupta<br />
omenirii pentru libertate şi demnitate<br />
umană” * .<br />
Atоt оn preambulul Declaraţiei, cоt<br />
şi оn normele ei pentru prima dată s-a<br />
pus accentul pe necesitatea promovării<br />
drepturilor omului оntr-un mod care<br />
ar asigura conformitatea acestora cu<br />
principiul respectării demnităţii umane.<br />
Astfel, articolul оntоi din Declaraţie<br />
stipulează expres că „Toate fiinţele umane<br />
se nasc libere şi egale оn demnitate<br />
şi оn drepturi”. Această normă avоnd
