C. Obstructing Gutters<br />

1. Rubbish<br />

No person shall place any garbage, rubbish, sand, stone, or other<br />

material in any gutter, street, or alley so as to obstruct the flow of<br />

water in the gutter.<br />

2. Driveway<br />

No person shall erect, construct, place, or maintain, a concrete, brick,<br />

or macadam driveway, or any driveway regardless of the material<br />

used in the construction, that shall extend across the established street<br />

line and obstruct the flow of water in any gutter in an alley or street.<br />

3. Removal of Obstruction<br />

6.0207 SNOW AND ICE REMOVAL<br />

A. Owner's Responsibility<br />

An obstruction may be removed by any person authorized by the<br />

Council or by the Board of <strong>Public</strong> <strong>Works</strong> to remove the same, and the<br />

cost of the removal of the obstruction shall be charged against the<br />

person responsible for erecting, constructing, placing, or maintaining<br />

the obstruction in the gutter.<br />

The owner, lessee, occupant, or person in charge of each and every building<br />

or structure or unoccupied lot in the City of Marinette fronting or abutting<br />

any street shall clean, or cause to be cleaned, the sidewalk in front of or<br />

adjoining each such home, building, or unoccupied lot, as the case may be<br />

of snow or ice to the width of such sidewalk within twenty-four (24) hours<br />

of the cessation of such snowfall and shall cause the same to be kept clear<br />

from ice and snow, provided that when the ice has formed on any sidewalk<br />

so that it cannot be immediately removed, the persons herein referred to<br />

shall keep the same sprinkled with salt, sawdust, or sand, and shall, as soon<br />

thereafter as the weather shall permit, thoroughly clean such sidewalk.<br />

B. City's Option to Clear Sidewalks<br />

In the event of failure of the lessee, occupant, person having charge, or<br />

owner to remove all snow and ice from the sidewalk within said twentyfour<br />

(24) hour period, the Department of <strong>Public</strong> <strong>Works</strong> may remove the<br />

snow and ice from sidewalks. (See MMC 9.1302 Schedule A for fees)<br />

(Ordinance 2007-2085 adopted 3-6-07). This, however, does not remove the<br />

responsibility of the lessee, occupant, person having charge, or owner from<br />

removing snow and/or ice from the sidewalk and said person or entity shall<br />

retain responsibility for any liability accruing because of failure to remove<br />

snow and/or ice from the sidewalk and adjacent areas. The charges shall be<br />

set forth in a statement to the City Clerk who, in turn, shall mail the same to<br />

the owner, occupant, or person having charge of the subject premises. If<br />
