6.0209 TERRACE AREAS<br />

A. Definition<br />

As an alternative to the remedy provided in subsection (b) above, or in<br />

addition thereto, the City may impose a penalty for any violation of any<br />

provision of this Section. The person or entity who violates any of the<br />

provisions of this Section shall forfeit and pay to the City of Marinette an<br />

amount as found in Section 1.0107 of this Code of Ordinances, together<br />

with the costs of prosecution for each offense. A separate offense shall be<br />

deemed committed during each day (24 hours) or part thereof during which<br />

a violation occurs or continues.<br />

The definition of "terrace" shall be as defined in Section 6.0402 (G).<br />

B. Noxious Weeds; Paving<br />

All that part of the terrace not covered by a sidewalk shall be kept free and<br />

clear of all noxious weeds and shall not be paved, surfaced, or covered with<br />

any material which shall prevent the growth of plants, and shall be<br />

maintained as a lawn, except in areas specifically approved by the Common<br />

Council or its designee. EXCEPTION: Paver bricks shall be allowed in the<br />

terrace area along Marinette Avenue from Cleveland Avenue to Hall<br />

Avenue, both sides, subject to a street opening permit and approval by the<br />

Director of <strong>Public</strong> <strong>Works</strong> (Ordinance 2007-2108 adopted 10-2-2007).<br />

C. Responsibility to Maintain<br />

Every owner of land in the City whose land abuts a terrace is required to<br />

maintain, or have maintained by his tenant, the terrace directly abutting<br />

such land as provided in this Section and elsewhere in this Code. Every<br />

owner shall keep mailboxes located on a terrace free and clear of snow.<br />

D. Signs Prohibited<br />

No person shall erect, maintain, or place upon or within the roadway, curb,<br />

space, tree lane, or sidewalk, any sign, advertising matter or any other<br />

object. This prohibition shall not apply to religious signs.<br />

Gasoline Pumps<br />

1. Gasoline Pumps<br />

No person shall erect or maintain any gasoline pumps within the curb<br />

line or sidewalk within the City.<br />

2. Gasoline Hoses<br />

No person shall at any time extend a hose or apparatus across a curb<br />

line or sidewalk within the City for the purpose of selling or<br />

distributing gasoline or other products.<br />
