said statement is not paid in full within thirty (30) days thereafter, the<br />

statement shall be reported to the City Treasurer, who shall enter the<br />

charges in the tax roll as a special tax against said lot or parcel of land, and<br />

the same shall be collected in all respects like other taxes upon real estate,<br />

or as provided under Section 66.615, Wisconsin Statutes, as amended.<br />

C. Penalty<br />

As an alternative to a remedy provided in subsection (b) above, or in<br />

addition thereto, the City may impose a penalty for any violation of any<br />

provision of this Section, providing that the person who violates any of the<br />

provisions of this Section shall forfeit and pay to the City of Marinette an<br />

amount as found in Section 1.0107 of this Code of Ordinances, together<br />

with the costs of prosecution for each offense. A separate offense shall be<br />

deemed committed during each day (24 hours) or part thereof during which<br />

a violation occurs or continues.<br />

6.0208 DEPOSIT OF SNOW AND ICE ON STREETS PROHIBITED<br />

A. Deposit Prohibited<br />

It is unlawful for any person in clearing snow from parking lots, driveways,<br />

filling stations, garages, or other areas to pile or distribute snow, or cause<br />

snow to be piled or distributed, in a street or alley in any manner that tends<br />

to narrow the traveled portion of the street or prevent parking at the curb.<br />

Persons having such an accumulation of snow on private property shall be<br />

responsible for its handling at their own expense without depositing same in<br />

the right-of-ways, ditches, public streets, or alleys.<br />

B. City's Option to Clear<br />

The Department of <strong>Public</strong> <strong>Works</strong> may remove any such illegally piled,<br />

distributed, or deposited snow at any time. The property owner, from whose<br />

premises the snow originated, shall be billed a minimum of Thirty Dollars<br />

($30.00) on the first occasion that the Department of <strong>Public</strong> <strong>Works</strong> removes<br />

the snow. For subsequent violations, the Department of <strong>Public</strong> <strong>Works</strong> may<br />

remove the snow at the same cost multiplied by the number of times the<br />

Department of <strong>Public</strong> <strong>Works</strong> shall have removed the snow. This, however,<br />

does not remove the responsibility of the lessee, occupant, person having<br />

charge or owner from removing said snow, and said persons or entities shall<br />

retain responsibility for any liability accruing because of failure to remove<br />

said snow. The charges shall be set forth in a statement onto the City Clerk<br />

who, in turn, shall mail the same to the owner, occupant, or person in<br />

charge of the subject premises. If said statement is not paid in thirty (30)<br />

days thereafter, the statement shall be reported to the City Treasurer who<br />

shall enter the charges in the tax roll as a special tax against said lot or<br />

parcel of land, and the same shall be collected in all respects like other taxes<br />

upon real estate, or as provided under Wisconsin Statutes Section<br />
