opening, the street opening may be performed without a permit. The<br />

person or entity performing the emergency street opening shall obtain<br />

a street opening permit at the first available opportunity during<br />

normal City Hall business hours.<br />

5. The Marinette Police Department shall be notified prior to<br />

undertaking any emergency street opening without a permit.<br />

D. Seasonal Limitations<br />

No street opening shall be undertaken during the months of<br />

November through March, with the following exceptions:<br />

1. An emergency situation such as a gas leak, water main leak, sewer<br />

break, or damaged utility cables.<br />

2. If weather and ground conditions warrant, in which case permission<br />

may be granted by the Board of <strong>Public</strong> <strong>Works</strong>. The Board of <strong>Public</strong><br />

<strong>Works</strong> may impose whatever conditions it feels will ensure site<br />

restoration, including holding the performance deposit over the<br />

winter.<br />

E. Performance Deposit Requirements<br />

1. Prior to issuance of a permit, the applicant shall deposit with the City<br />

Treasurer a sum to be determined by the Director of <strong>Public</strong> <strong>Works</strong> or<br />

his designee based upon the nature and extent of the proposed street<br />

opening to ensure the restoration of the street opening.<br />

2. The deposit shall be used by the City to defray any restoration<br />

expense incurred by the City and if any balance shall remain, it shall<br />

be refunded to the applicant.<br />

3. No deposit or portion of deposit shall be refunded prior to final<br />

inspection by the City.<br />

4. Any person or entity regularly undertaking street openings may post a<br />

seasonal deposit of One Thousand Dollars ($1,000.00) to cover all<br />

street openings in lieu of posting a deposit for each opening.<br />

5. The Marinette Water Utility and the Marinette Wastewater Treatment<br />

Commission shall be exempt from the performance deposit<br />

requirement.<br />

F. Insurance Required<br />

A permit shall be issued only upon condition that the applicant submit to the<br />

City Clerk satisfactory written evidence that applicant has in force and shall<br />

maintain during the time the permit is in effect public liability insurance of<br />

not less than Two Hundred Fifty Thousand Dollars ($250,000.00) per one<br />

(1) person, Five Hundred Thousand Dollars ($500,000.00 for one (1)<br />

accident, and property damage coverage of not less than One Hundred<br />

Thousand Dollars ($100,000.00).<br />
