G. Barricades and Lights<br />

1. Any person or entity making or maintaining any street opening shall<br />

keep the same adequately guarded by barricades and lights to protect<br />

persons and property from injury and shall hold harmless the City of<br />

Marinette and its authorized agents from any claim or suit resulting<br />

from the above.<br />

2. Every street opening shall be enclosed with sufficient barriers.<br />

Sufficient warning lights shall be kept on from sunrise to sunset.<br />

Such lights shall be spaced so as to give adequate warning of the<br />

existence of the street opening and of piled excavated materials. No<br />

open-flame warning pots shall be used. Except by special permission<br />

from the Superintendent of <strong>Public</strong> <strong>Works</strong>, no trench shall be<br />

excavated more than two hundred fifty (250) feet in advance of pipe<br />

or conduit laying or left unfilled more than five hundred (500) feet<br />

where pipe or conduit has been laid.<br />

3. All necessary precautions shall be taken to guard the public<br />

effectively from accidents or damage to persons or property through<br />

the period of the work. Each person or entity making such street<br />

opening shall be held liable for all damages, including costs incurred<br />

by the City in defending any action brought against it for damages, as<br />

well as cost of any appeal, that may result from the neglect by such<br />

person or entity, or its employees of any necessary precaution against<br />

injury or damage to persons, vehicles, or property of any kind. The<br />

manual on Uniform Traffic Control Devices for Streets and<br />

Highways, published by the U.S. Department of Transportation<br />

Federal Highway Administration, as amended, shall control.<br />

H. Backfilling<br />

As soon as the purpose for a street opening has been accomplished, it shall<br />

be the duty of the person or entity having caused the opening, to<br />

immediately notify the Director of <strong>Public</strong> <strong>Works</strong> or his designee, and the<br />

person or entity, upon approval, will then cause such street, alley, or<br />

pavement to be repaired by backfilling the opening or trench with slurry or<br />

an alternative method approved by the Director of <strong>Public</strong> <strong>Works</strong> or his<br />

designee. A minimum of eight (8) inches of road gravel shall be used as<br />

backfill beneath the base of the road surface. A minimum of eight (8) inches<br />

of road gravel shall be used as backfill under completed pavement.<br />

I. Manner of Excavating<br />

1. All bituminous or concrete surfaces shall be machine cut. It shall be<br />

unlawful to make any such street opening in any way contrary to or at<br />

variance with the terms of the permit. All orders of the State<br />

Department of Industry, Labor, and Human Relations governing<br />

proper excavating methods are hereby made a part of this code as<br />

though set forth herein. Proper bracing shall be maintained to prevent<br />
