the collapse of adjoining ground; and in excavations, the excavation<br />

shall not have below the surface any portion which extends beyond<br />

the opening at the surface.<br />

2. All tunnels or other underground excavation shall be bored.<br />

3. No injury shall be done to any pipes, cables or conduits in the making<br />

of such excavations or tunnels; and notice shall be given to the<br />

persons maintaining any such pipes, cables or conduits which may be<br />

endangered or affected by the making of any such excavation or<br />

tunnel before such pipes, cables or conduits shall be disturbed.<br />

4. No damage or injury shall be done to any tree or shrub or the roots<br />

thereof.<br />

J. Sidewalks<br />

If any sidewalk is blocked by any such work, a temporary sidewalk shall be<br />

constructed or provided which shall be safe for travel and convenient for<br />

users. The permittee shall make good any and all damages to sidewalks and<br />

driveways resulting from his work.<br />

K. Terrace Areas<br />

1. When an excavation is made in a terrace area, the holder of the permit<br />

shall restore the ground at his own expense in the following manner:<br />

(a) Backfill the trench and tamp in layers of not more than three (3)<br />

feet.<br />

The top three (3) inches of backfill shall be made with a good<br />

grade of topsoil and seeded.<br />

2. The terrace work shall be completed within two (2) weeks of the<br />

completion of work except that the Director of <strong>Public</strong> <strong>Works</strong> or his<br />

designee may waive the requirement during the months of November<br />

through March.<br />

L. Time Limit<br />

All street openings shall be restored not more than five (5) working<br />

days after the underground work has been completed. In exceptional<br />

circumstances, an extension of time for restoration may be granted by<br />

the Director of <strong>Public</strong> <strong>Works</strong> or his designee in his or her sole<br />

discretion.<br />

M. Supervision<br />

The Director of <strong>Public</strong> <strong>Works</strong> shall, from time to time, inspect all<br />

street openings to ensure the enforcement of the provisions of this<br />

section. Notice shall be given to him at least eight (8) hours before the<br />

work of refilling any street opening commences.<br />
