2. Where a curb is to be opened, it shall be sawed in such a manner to<br />
allow the return radii to be transitioned to the curb so as not to present<br />
an unsightly condition.<br />
3. The driveway surface between the sidewalk or proposed sidewalk line<br />
and the street edge, shall be of bituminous concrete or Portland<br />
cement concrete surface placed in a true workmanlike manner. Where<br />
the driveway will be constructed between a sidewalk and concrete<br />
curb and gutter, the driveway apron shall be Portland cement<br />
concrete.<br />
4. Sidewalk construction for the width of the driveway shall be of airentrained<br />
Portland cement concrete with a minimum thickness of six<br />
(6) inches. Existing sidewalk not meeting these requirements shall be<br />
removed and replaced at the applicant's expense to conform with the<br />
above requirement.<br />
5. Driveway construction shall not impede or obstruct the natural flow<br />
of surface water.<br />
6. The owner of the premises shall be responsible to return the area of<br />
construction to original condition or better as determined by the City<br />
Engineer's office.<br />
I. Drainage<br />
Driveway culverts shall be provided by the property owner where required,<br />
and of sufficient size to accommodate surface water flow upstream of the<br />
driveway. Culvert size shall be determined by the City Engineer, but in no<br />
case shall be less than an equivalent fifteen (15) inches diameter pipe.<br />
J. Repair<br />
It shall be the duty of the property owner maintaining a driveway to keep<br />
the same, including the sidewalk, in good repair and free from obstructions<br />
and defects.<br />
6.0302 PERMITTEE LIABLE FOR DAMAGE OR INJURY<br />
The permittee shall assume responsibility for any injury or damage to persons or<br />
property resulting directly or indirectly during construction or repair of driveway<br />
approaches or entrances. When curb or gutter is removed, the new construction<br />
shall be of equivalent acceptable material and curb returns provided or restored in<br />
a neat, workmanlike manner. Driveway surfaces shall connect with the street<br />
pavement and sidewalk in a neat, workmanlike manner.<br />
