(Reems Road Retail Center Conditional Use Permit)<br />

Request: Approval <strong>of</strong> a Conditional Use Permit to allow for the<br />
use <strong>of</strong> a Convenience Food Restaurant in a recently<br />
approved site plan <strong>and</strong> building located in Reems Road<br />
Retail Center located on approximately a 2.36 Acre Site<br />
on the east site <strong>of</strong> Reems Road <strong>and</strong> north <strong>of</strong> Greenway<br />
Road.<br />
History All <strong>of</strong> the buildings shown in the Reems Road Retail<br />
Center Master Site Plan were approved on 4119/2005 as<br />
case # SP04-364. There subject building was approved •<br />
with a drive thru, but the use was undetermined at the<br />
time. It was stipulated:<br />
"The drive thru shown around building "B" will require approval <strong>of</strong> a<br />
Conditional Use Permit per Title 17 <strong>of</strong> the <strong>Surprise</strong> Municipal Code<br />
should this building be proposed for use as a fast food restaurant."<br />
Staff Recommendation:<br />
The use proposed to occupy the subject building is a<br />
convenience food restaurant which by ordinance<br />
requires a Conditional Use Permit. The approval is<br />
requested for the use only.<br />
The subject request is substantially buffered from any residential shown in "EXHIBIT A" which<br />
will avoid any noise conflicts. The master site plan <strong>and</strong> all buildings shown are already<br />
approved <strong>and</strong> the site is determined appropriate by staff for a convenience food restaurant<br />
use. Staff recommends the Planning <strong>and</strong> Zoning approve this request.<br />
