addition a Phase I and Phase II Soil Analysis were also completed. The MND<br />

and studies <strong>for</strong> <strong>the</strong> proposed project did not reveal any new significant impacts.<br />

Applicable and remaining mitigation measures from <strong>the</strong> previous<br />

environmental documents have been incorporated into <strong>the</strong> MND. The<br />

Conditions <strong>of</strong> Approval include <strong>the</strong> applicable mitigations and will act as <strong>the</strong><br />

Mitigation Monitoring and Reporting Program.<br />

FISCAL IMPACT<br />

No fiscal impacts o<strong>the</strong>r than normal fees (such as TIF, Park In-lieu, sewer and<br />

water connections) and taxes are expected.<br />

PUBLIC CONTACT<br />

The applicant conducted an Open House on August 2, 2012. Approximately<br />

seven residents attended <strong>the</strong> open house. The applicant provided color<br />

renderings, copies <strong>of</strong> reduced plans and answered questions. The applicant has<br />

also been diligently conducting additional outreach with <strong>the</strong> adjacent residents<br />

and Home Owners Associations. Two letters <strong>of</strong> support from <strong>the</strong> Danbury Place<br />

and Morse Park Home Owners Associations have been submitted (see<br />

Attachment E). Staff received two letters in opposition after <strong>the</strong> Draft RTC had<br />

been prepared (see Attachment G). A discussion has been included in <strong>the</strong><br />

Planning Commission Hearing section below.<br />

Planning Commission Study Session<br />

The project was presented to <strong>the</strong> Planning Commission on July 23, 2010 <strong>for</strong><br />

comment. Overall <strong>the</strong> Planning Commission was pleased with <strong>the</strong> proposed<br />

design. The Planning Commission provided <strong>the</strong> following comments:<br />

The project should have pedestrian connections to <strong>the</strong> future Morse<br />

Park.<br />

Compatibility <strong>of</strong> <strong>the</strong> structure with <strong>the</strong> adjacent townhomes is important.<br />

Requested clarification in <strong>the</strong> staff report regarding <strong>the</strong> requested<br />

Rezone.
