i) Fire access roads are required per the <strong>Sunnyvale</strong> Municipal Code<br />
and the published requirements for Fire Department Vehicle<br />
Access.<br />
j) Dead end fire access roads shall have an approved turnaround if<br />
the dead-end is greater than 150 feet. Approved turnaround will be<br />
required at the west end <strong>of</strong> the project.<br />
k) Prior to any combustible construction or materials on site, provide<br />
fire access drives and operational on-site fire protection systems if<br />
applicable. (Chapter 14 CFC)<br />
l) Provide a written construction Fire Protection Plan. (Section 1408<br />
CFC)(Refer to Unidocs.org , Fire Prevention documents).<br />
m) Trees (at maturity) along the fire access road shall not interfere<br />
with the 13'6" vertical clearance.<br />
TM: THE FOLLOWING CONDITIONS SHALL BE MET PRIOR TO THE<br />
APPROVAL OF THE FINAL MAP OR PARCEL MAP.<br />
TM-1. MAINTENANCE AGREEMENT:<br />
Any proposed deeds, covenants, restrictions and by-laws relating to<br />
the subdivision are subject to review and approval by the Director <strong>of</strong><br />
Community Development and the <strong>City</strong> Attorney. Four (4) sets <strong>of</strong> the<br />
Maintenance Agreement including all information required below shall<br />
be submitted to the Engineering Division <strong>of</strong> the Public Works<br />
Department for routing. In addition to requirements as may be<br />
specified elsewhere, the Maintenance Agreement shall include the<br />
following provisions:<br />
a) Membership in and support <strong>of</strong> an association (Maintenance<br />
Agreement) controlling and maintaining all common facilities<br />
shall be mandatory for all property owners within the<br />
development.<br />
b) The owners association shall obtain approval from the Director <strong>of</strong><br />
Community Development prior to any modification <strong>of</strong> the<br />
Maintenance Agreement pertaining to or specifying the <strong>City</strong>.<br />
c) The developer shall maintain all private utilities and landscaping<br />
for a period <strong>of</strong> three (3) years following installation <strong>of</strong> such<br />
improvements or until the improvements are transferred to a<br />
owners association, following sale <strong>of</strong> at least 75% <strong>of</strong> the units,<br />
whichever comes first.<br />
d) The Standard Development Requirements and Conditions <strong>of</strong><br />
Approval included as part <strong>of</strong> the approved Planning Application,<br />
Permit #<strong>2011</strong>-<strong>7072</strong>, and associated map shall be incorporated<br />
into the Maintenance Agreement as an exhibit or attachment.<br />
The included map shall clearly indicate all public/private<br />
easements as disclosure for property owners. The Maintenance<br />
Agreement shall include a list <strong>of</strong> all attachments and/or exhibits.
