• Below Market Rate (BMR) Housing<br />

No BMRs are required <strong>of</strong> this development since the total number <strong>of</strong> units is<br />

less than nine.<br />

Environmental Review<br />

A Mitigated Negative Declaration has been prepared in compliance with<br />

California Environmental Quality Act provisions and <strong>City</strong> Guidelines. An initial<br />

study has determined that the proposed project would not create any<br />

significant environmental impacts with implementation <strong>of</strong> the recommended<br />

mitigation measures.<br />

The Initial Study includes discussion about noise impacts from <strong>Sunnyvale</strong>-<br />

Saratoga Road and air quality impacts. Mitigation measures have been<br />

incorporated in the attached conditions <strong>of</strong> approval at the appropriate states <strong>of</strong><br />

construction (Attachment B).<br />

FISCAL IMPACT<br />

Transportation Impact Fee<br />

Projects resulting in net new peak hour automobile trips are subject to a<br />

transportation impact fee. The transportation impact fee is estimated to be<br />

$6,147.54, and must be paid prior to issuance <strong>of</strong> a building permit. The<br />

amount is subject to the fee in place at the time <strong>of</strong> payment.<br />

Park Dedication In-Lieu Fee<br />

The project is subject to a park dedication in-lieu fee for each new residential<br />

unit. The park dedication in-lieu fee is based on the current acreage standard<br />

<strong>of</strong> 2.25 acres/1,000 population; the fee, based on FY 2010-<strong>2011</strong> adopted land<br />

values is estimated to be $70,567.20, and must be paid prior to recordation <strong>of</strong><br />

a Final Map. The amount is subject to the fee, based on a formula in the<br />

Municipal Code, in place at the time <strong>of</strong> payment.<br />

PUBLIC CONTACT<br />

Outreach Meeting<br />

The applicant held a community outreach meeting on May 2, <strong>2011</strong>.<br />

Approximately 20 residents from the surrounding Sunset Park community<br />

attended. A majority <strong>of</strong> the concerns were related to construction noise,<br />

parking, and maintenance responsibilities.
