control point for the applicable density range unless the following findings are made:<br />

1. <strong>The</strong> project will provide sufficient additional public facilities for the density in excess of the control<br />

point to ensure that the adequacy of the City's public facilities plans will not be adversely<br />

impacted; and<br />

2. <strong>The</strong>re have been sufficient developments approved in the quadrant at densities below the control<br />

point to cover the units in the project above the control point so that approval will not result in<br />

exceeding the quadrant limit; and<br />

3. All necessary public facilities required by this chapter will be constructed or are guaranteed to<br />

be constructed concurrently with the need for them created by this development and in compliance<br />

with the adopted City standards.<br />

For the purposes of this paragraph the term "quadrant" means those quadrants established by the<br />

intersections of El Camino Real and Palomar Airport Road as set forth in the map amending the<br />

General Plan and as required by Proposition E adopted November 4, 1986.<br />

SECTION III: That the findings and conditions of the Planning Commission in Planning<br />

Commission Resolution No. 6933 shall also constitute the findings and conditions of the City<br />

Council.<br />

EFFECTIVE DATE: This ordinance shall be effective thirty days after its adoption; and the city clerk<br />

shall certify the adoption of this ordinance and cause the full text of the ordinance or a summary of<br />

the ordinance prepared by the City Attorney to be published at least once in a newspaper of general<br />

circulation in the City of Carlsbad within fifteen days after its adoption. (Notwithstanding the<br />

preceding, this ordinance shall not be eff ective within the <strong>Coast</strong>al Zone until LCP A 12-03 is<br />

approved by the California <strong>Coast</strong>al Commission.)<br />

Draft FY<strong>2013</strong>-14 Action Plan For Housing and Community<br />

Development Activities<br />

<strong>The</strong> draft FY<strong>2013</strong>-14 Action Plan is available for public review from<br />

<strong>March</strong> <strong>22</strong> through April <strong>22</strong>, <strong>2013</strong>. <strong>The</strong> Action Plan describes the<br />

intended use of federal Community Development Block Grant<br />

(CDBG) and HOME Investment Partnership (HOME) funds for<br />

Fiscal Year (FY) <strong>2013</strong>-14 (July 1, <strong>2013</strong> – June 30, 2014). <strong>The</strong> annual<br />

Action Plan implements the City of Encinitas FY2010-15<br />

Consolidated Plan. <strong>The</strong> Consolidated Plan identifies the housing<br />

and community development needs, strategies and proposed implementation<br />

actions for the five-year period.<br />

<strong>The</strong> City of Encinitas anticipates allocating approximately $358,283<br />

of CDBG funds and $114,891 of HOME funds for FY<strong>2013</strong>-14. <strong>The</strong><br />

City Council will hold a public hearing on Wednesday, April 24,<br />

<strong>2013</strong>, at 5:00 p.m. at City Hall Council Chambers, 505 S. Vulcan<br />

Ave., Encinitas, CA, or as soon as possible thereafter, to consider<br />

and approve the FY<strong>2013</strong>-14 Action Plan. All comments received on<br />

the draft Action Plan will be provided to Council prior to consideration<br />

and approval.<br />

<strong>The</strong> proposed CDBG budget allocates approximately: $41,505 for<br />

public services; $55,340 for planning and administration; and,<br />

$261,438 for facility improvements and other activities. Public services<br />

include: homeless assistance, youth shelter, meal delivery for<br />

seniors, youth development, and teen/family drug treatment and<br />

outreach. Planning and administration include: general administration<br />

of the CDBG program and planning activities. Capital improvements<br />

and other activities include: improvements to a child learning<br />

center, an AIDS/HIV care facility, a social services center; and a residential<br />

rehabilitation program.<br />

<strong>The</strong> proposed HOME budget allocates approximately: $111,318 for<br />

a residential rehabilitation program; and $3,573 for planning and<br />

administration.<br />

<strong>The</strong> draft FY<strong>2013</strong>-14 Action Plan is available for review at the City’s<br />

Planning and Building Department located at City Hall during regular<br />

ZONING/OVERLAYS: <strong>The</strong> subject property is located in the R-8<br />

(Residential 8) zone, the <strong>Coast</strong>al Bluff Overlay Zone and within the<br />

California <strong>Coast</strong>al Commission Appeal Jurisdiction of the <strong>Coast</strong>al<br />

Zone.<br />

DESCRIPTION: Public Hearing to consider a <strong>Coast</strong>al Development<br />

Permit application request to convert an existing duplex into a single-family<br />

residence and complete various interior improvements.<br />

<strong>The</strong> applicant is also proposing the replacement of a rooftop deck<br />

and handrail within 50 feet of the coastal bluff edge.<br />

ENVIRONMENTAL STATUS: <strong>The</strong> project has been determined to<br />

be exempt from environmental review as per California<br />

Environmental Quality Act (CEQA) Guidelines Sections 15301(a),<br />

which exempts from environmental review consists of or minor alteration<br />

of existing p private structures, facilities, mechanical equipment<br />

such as interior or exterior alterations involving such things as<br />

interior partitions, plumbing, and electrical conveyances.<br />

An appeal of the Planning Commission determination, accompanied<br />

by the appropriate filing fee, may be filed by 6:00 p.m. on the<br />

15th calendar day (10th calendar day for subdivisions) following the<br />

date of the Commission’s determination. Appeals will be considered<br />

by the City Council pursuant to Chapter 1.12 of the Municipal<br />

Code. Under California Government Code Sect. 65009, if you challenge<br />

the nature of the proposed action in court, you may be limited<br />

to raising only the issues you or someone else raised regarding<br />

the matter described in this notice or written correspondence delivered<br />

to the City at or before the time and date of the determination.<br />

Items 1 & 2 are located in the City’s <strong>Coast</strong>al Zone and require<br />

issuance of a <strong>Coast</strong>al Development Permit. <strong>The</strong> action of the<br />

Planning Commission and/or City Council relative to Item 1 is not<br />

appealable to the <strong>Coast</strong>al Commission. <strong>The</strong> action of the Planning<br />

Commission and/or City Council relative to Item 2 is appealable to<br />

the <strong>Coast</strong>al Commission.<br />
