MARCH 22, 2013 Council in support of statewide plastic bag ban By Jared Whitlock ENCINITAS — At Wednesday night’s meeting, council voted unanimously to update its legislative priorities f or the next year. Those changes include supporting a statewide plastic bag ban. “I think it makes a lot of sense to support the statewide plastic bag ban; twice now they’ve come very close to ha ving the ban and hopefull y the third time is the charm,” Councilman Tony Kranz said. Kranz also said the statewide ban would have the benefit of putting all of the California cities on the same page, preventing confusion over cities’ varying approaches to the ban. The statewide legislation, introduced last month, would ban singleuse carryout bags for large retailers in 2015, and then convenience stores and smaller businesses in 2016. Resident Darius Degher said that Encinitas should back the state’s legislation, but he also said that the city should de vel- By Jared Whitlock ENCINITAS — The Encinitas Union Sc hool District Board of Trustees voted to eliminate five child guidance aide positions at Wednesday night’s meeting. The aides pr ovided social and emotional support for students in kindergarten through sixth grades. This included e verything from how to handle bullies to coping with c hange, according to Maria Waskin, director of pupil personnel services for the district. “These are important positions that w e would rather not let go, but we have a tough budget situation,” Waskin said. The five aides alternated between the district’ s nine schools, giving each school at least one aide every day. They worked in conjunction with school psychologists, who primarily serve special needs students, Waskin said. Over eight y ears, the district was given a $165,000 state grant each year for 15 aides, although at that time they only served kindergarten through third grades. Citing the California budget op its own ban. “We should contin ue to move forward with a local bag ban, ” Degher said. “Because if we don’t, and the state measure fails due to inevitable pressure from the plastic industr y, then Encinitas will not be able to do its part in this ecological matter.” The Encinitas Environmental Commission has been researching the fiscal and environmental impacts of a local plastic bag ban. It will present its finding to council April 10 and ask for further direction. In 2008, Encinitas moved to ban or place a fee on plastic bags with a 3-2 vote. But the plastic-bag industry threatened litigation, arguing the city needed to complete an environmental impact report. Due to the cost of the en vironmental impact r eport, the city never adopted the ban. Councilmembers also agreed that emphasizing railroad infrastructure in Encinitas should be part of its legislative priorities. EUSD cuts five child guidance aides @CoastNewsGroup crisis, Gov. Jerry Brown scrapped the state wide grant, known as the Early Mental Health Initiati ve, last year with a line-item veto. Brown argued that instead of funding specific programs, the state should let school districts set priorities for spending money. At a cost of $65,000, the district decided to pay for five aides, rather than 15, itself this school year. Waskin said the aides were eliminated for the following school year due to a difficult budget situation. In the meantime, she said that the district is looking for other grants or help from foundations to hopefully bring back the aides. The district also eliminated a nutrition clerk position. By Promise Yee OCEANSIDE — Utility Commission chair Brian Boyle said he would not rerun as commission chair or vice chair, after being voted off the San Diego Water Authority board by City Council. “I’m not willing to put in time for a city that doesn’t appreciate what other people do,” Boyle said. Boyle addressed his comments to Councilman Jerry Kern, who attended the commission meeting Mar ch 20, and who voted Boyle off the Water Authority board in February along with Councilmen Gary Felien and Jack Feller. The same three council members voted in Kern to fill the regional board position. Boyle served on the Water Authority board for two years and on the THE COAST NEWS Commission denies permit to sell firearms By Rachel Stine CARLSBAD — At its March 20 meeting, the Carlsbad Planning Commission denied a local store’s second application for a conditional use permit to sell firearms, and in doing so ensured that Car lsbad would remain without a gun store for the foreseeable future. After the Planning Commission and City Council denied her first application in 2012, Lisa Gunther submitted an adjusted application to sell firearms at her stor e, Gunther Gifts, which is located off of Palomar Airport Road. Specifically, Gunther applied for a conditional use permit from the commission to be authorized to store, transfer and sell guns as a r etail business, even though her store is located in the Planned Industrial zone. Carlsbad City Planner Shannon Werneke advised the Planning Commission to den y Gunther’s application f or the permit, stating that a gun store would not follow the intent of the current industrial zoning in the area. Gunther contended that a gun store would serve the security needs of the nearb y businesses, specifically the Bank of America which has an armed guard during business hours. “Every business has a need for security,” she said. Gunther added that she has the support of the business complex’s master association. She stated that as the first gun store in Carlsbad her store would have the opportunity to supply firearms for the Carlsbad Police Department. Gunther also claimed that Oceanside Utility Commission for nine years. He earned his water conservation license in 1988 and has “been in the water business” for over 30 years. “I donated time f or a long time,” Boyle said. “I think I helped.” Boyle said he was disappointed at being taken off the board and angry at the way it was handled. He said he learned from a reporter that council members were considering removing him for “political reasons.” He chose to resign from the position prior to the council vote. “They still voted to take me off,” Boyle said. “I have a spotless reputation. It is an ugly appearance on m y record.” Boyle said he w ould be watching Oceanside politics, but not volunteering to serve. a number of the industrial businesses in the same comple x currently run retail operations without appropriate conditional use permits. She argued that she should be granted a permit in light of the fact that she was trying to go thr ough the pr oper city channels while other businesses were not. Commissioners were concerned by the idea of denying her permit when other industrial businesses may already be running retail operations in that location. “Here we have an applicant who is trying to follow the law and do it the right w ay,” said Commissioner Jeff Segall. As a separate matter, the commission may consider rezoning the ar ea where the business is located to allo w retail operations in the futur e. However, the change has yet to come before the Planning Commission and w ould need the eventual approval of City Council as well as the Coastal Commission, a process that would take several months at minimum. Ultimately, the commission voted to den y Gunther’s application in light of curr ent zoning laws with a 4-1 vote. Commissioner Marty Montgomery voted in f avor of granting the permit, asserting that the business did meet the needs of the surrounding industrial area. “This business can meet the security needs of the surrounding businesses.
