Due <strong>to</strong> <strong>the</strong> fact that <strong>the</strong> provision <strong>of</strong> remote gambling services continues <strong>to</strong> be illegal or is currently<br />
in <strong>the</strong> process <strong>of</strong> being regulated in many Member States, <strong>the</strong>re are very few studies or statistics<br />
that accurately reflect <strong>the</strong> nature and size <strong>of</strong> <strong>the</strong> black market for remote gambling services.<br />
Never<strong>the</strong>less, several <strong>of</strong> <strong>the</strong> studies mentioned in our answer <strong>to</strong> Question 1, cover also <strong>the</strong> black<br />
market. For instance <strong>the</strong> report “Aard en omvang van illegale kansspelen in Nederland” makes<br />
reference <strong>to</strong> <strong>the</strong> websites Pokerstars (licenced in <strong>the</strong> Isle <strong>of</strong> Man), Unibet, Everest Poker (licenced in<br />
Malta), and Party Poker (Gibraltar).<br />
By way <strong>of</strong> illustration, however, information recently made public by <strong>the</strong> Bulgarian Ministry <strong>of</strong> <strong>the</strong><br />
Interior <strong>the</strong> size <strong>of</strong> <strong>the</strong> black market in Bulgaria represents about 400 million EURO per year. In <strong>the</strong><br />
<strong>response</strong> <strong>of</strong> <strong>the</strong> German Bundesrat <strong>to</strong> <strong>the</strong> Green Paper, <strong>the</strong> Bundesrat estimated <strong>the</strong> turnover <strong>of</strong> <strong>the</strong><br />
illegal and black market between 0,6 and 1,7 Billion Euro per year (Bundesrat-Drucksache 176/11<br />
(Beschluss)).<br />
Question 3: What, if any, is your experience <strong>of</strong> EU-based on-line gambling opera<strong>to</strong>rs licensed in<br />
one or more Member State and providing and promoting <strong>the</strong>ir services in o<strong>the</strong>r EU Member<br />
States? What are your views on <strong>the</strong>ir impact on <strong>the</strong> corresponding markets and <strong>the</strong>ir consumers?<br />
<strong>EUROMAT</strong> refers <strong>to</strong> its statement <strong>of</strong> principles and notes that current regulation <strong>of</strong> remote services<br />
is inadequate as it lacks consistency, effective enforcement, consumer protection and dis<strong>to</strong>rts<br />
national and international markets by creating a competitive advantage for remote opera<strong>to</strong>rs at <strong>the</strong><br />
expense <strong>of</strong> licenced opera<strong>to</strong>rs in <strong>the</strong> respective market, consumers and national government<br />
revenues.<br />
In many Member States, EU-based (as well as non EU-based) remote gambling opera<strong>to</strong>rs licensed in<br />
o<strong>the</strong>r Member States (or o<strong>the</strong>r countries) provide and promote <strong>the</strong>ir services in an uncontrolled<br />
manner. In addition <strong>to</strong> <strong>the</strong> considerable commercial disadvantage that this creates for <strong>the</strong> strictly<br />
controlled land-based sec<strong>to</strong>r, this situation also gives rise within <strong>the</strong> sphere <strong>of</strong> <strong>the</strong> remote gambling<br />
sec<strong>to</strong>r <strong>to</strong> a considerable lack <strong>of</strong> consumer protection, fraud, money laundering and an outflow <strong>of</strong><br />
national income. By way <strong>of</strong> illustration, <strong>the</strong> research “Aard en omvang van illegale kansspelen in<br />
Nederland” concludes that more than 500.000 Dutch citizens, although online gambling is currently<br />
illegal in <strong>the</strong> Ne<strong>the</strong>rlands, gamble on <strong>the</strong> internet and <strong>the</strong>ir stake per game is on average 12 <strong>to</strong> 13<br />
Euros.<br />
