In Spain, <strong>the</strong> National Health System deals with <strong>the</strong> issue <strong>of</strong> problem gamblers as a regular disease<br />
in <strong>the</strong>ir psychiatric department. There are private associations for compulsive gamblers (mostly run<br />
by former gamblers) which aim <strong>to</strong> provide <strong>the</strong>rapies and remedies, and rehabilitate problem<br />
gamblers. These are usually very small, run at regional or local level and require payments from<br />
compulsive gamblers.<br />
In Sweden, <strong>the</strong> Swedish National Institute <strong>of</strong> Public Health is now investigating <strong>the</strong> extent <strong>of</strong><br />
problem gambling in <strong>the</strong> country and how <strong>to</strong> tackle <strong>the</strong> situation. Today no particular authority is<br />
responsible for problem gamblers or <strong>the</strong> associated costs that research and treatment produce.<br />
Question 22: What is <strong>the</strong> required level <strong>of</strong> due diligence in national regulation in this field? (E.g.<br />
recording on-line players' behaviour <strong>to</strong> determine a probable pathological gambler?).<br />
The situation varies across <strong>EUROMAT</strong> member countries. There are very patchy rules, if <strong>the</strong>y exist at<br />
all for <strong>the</strong> remote gambling sec<strong>to</strong>r. By way <strong>of</strong> example, <strong>the</strong>re are no legal requirements in Poland,<br />
while in Romania <strong>the</strong> following information must appear in websites <strong>of</strong>fering gambling services:<br />
Information about responsible gambling and <strong>the</strong> possible harmful effects <strong>of</strong> gambling. This<br />
information must be drawn up in collaboration with a treatment centre;<br />
Access <strong>to</strong> a self-test regarding addiction <strong>to</strong> gambling;<br />
Information about and a contact address for a helpline which gives recommendations<br />
relating <strong>to</strong> gambling addiction issues and <strong>the</strong> treatment centres in Romania or o<strong>the</strong>r<br />
Member States <strong>of</strong> <strong>the</strong> European Union;<br />
A clock must also be displayed on <strong>the</strong> gambling opera<strong>to</strong>r’s website, <strong>to</strong> enable <strong>the</strong> player <strong>to</strong><br />
keep track <strong>of</strong> <strong>the</strong> time spent on <strong>the</strong> gaming page. The clock shall indicate <strong>the</strong> current date<br />
and time and must be visible <strong>to</strong> <strong>the</strong> player at all times.<br />
Fur<strong>the</strong>rmore, <strong>the</strong> gambling operaotr must provide <strong>the</strong> player with an application that would<br />
enable <strong>the</strong>m <strong>to</strong> request <strong>to</strong> be temporarily or permanently excluded from <strong>the</strong> game. Any<br />
request for exclusion issued by <strong>the</strong> player must be implemented immediately.<br />
Question 23: Are <strong>the</strong> age limits for having access <strong>to</strong> on-line gambling services in your or any o<strong>the</strong>r<br />
Member State in your view adequate <strong>to</strong> attain <strong>the</strong> objective sought?<br />
Age limits are statu<strong>to</strong>ry by law for <strong>the</strong> land-based amusement and gaming device industry across <strong>the</strong><br />
EU and we believe very necessary, and strictly observed by land-based opera<strong>to</strong>rs. Where such limits<br />
do exist for <strong>the</strong> remote gambling sec<strong>to</strong>r (not always <strong>the</strong> case) <strong>the</strong>y are easier <strong>to</strong> bypass given <strong>the</strong><br />
lack <strong>of</strong> face-<strong>to</strong>-face engagement between remote gambling opera<strong>to</strong>rs and <strong>the</strong>ir cus<strong>to</strong>mers.<br />
