CHAPTER VI Use Zone (Moderation of Restrictions for Existing Buildings) Article 130. Permissible scope of enlargement, remodelling or change of usa of existing buildings not complying with provisions of Article 49 of the Law or Article 50 paragraph 2 or paragraph 4 of the Law shall be as provided for in. the following items with the standard at the time when the building concerned has come not to comply with these provisions (hereinafter referred to as "standardized time" in this Article) : (1) The enlargement or remodelling is to be done in the site at standardized time, and the area or total area of building for enlargement or remodelling is not to exceed the percentage against area of site at standardized time prescribed in the provisions respectively in Article 55 of the Law or Article 56 of the Law; (2) After standardized time total floor area to be increased by extension (in case extension involves more than two houses or enlargement undergoes by several extension works, total of floor areas increased by these enlargement works) shall not exceed 1/2 of total floor at standardized time (in case there is a building constituting more than two houses in the same site, tota1 floor area thereof) ; (3) Total floor area of part of a building (total of floor areas increased by these enlargement of change of use when several extensions or change of use take place) not appropriate for uses mentioned in the provisions of Article 49 of the Law or Article 50 paragraph 2 or paragraph 4 of the Law concerned with the increase through enlargement or change of use after standardized time shall not exceed 1/2 of the total of that floor area at standardized time; (4) In the case where the cause not complying with the provisions of Article 49 of the Law is due to horse power of motors or number of machineries, the total of horse power of motors or number of machineries increased by enlargement of building or change thereof after standardized time (in case enlargements take place at several occasions, the total of these enlargements) shall not exceed 1/2 of total of horse power or number of machineries at standardized time. CHAPTER VII Height of Building (Disposal about Moderation in Height) Article 131. Disposal about moderation of application of the provisions of Article 58 paragraph 1 or paragraph 2 of the Law under the provisions of paragraph 3 of the same Article shall be as prescribed in this Chapter. 2 In the case of area where land replotting has been executed as well as other areas where street blocks have been readjusted In like manner, the road on which abut the street blocks, subject to the designation of administrative agency concerned shall be treated as the front road. (In case of having more than two Front Roads) Article 132. In case more than two front roads to a building exist, regarding the area with horizontal distance from the boundary line of front road which is largest within the limit of twice the width of that road, or at the same time with the -distance within the limit of 35 and regarding the area with the horizontal distances from center line of other front roads exceeding 10m., the width of all front roads shall be treated as having the same width as the widest front road. 2 With regard, out of the areas other than that mentioned in the preceding paragraph, to the area with horizontal distance from the boundary line of one front road within the limit of twice the width of that road and at the same time with the distance within the limit of 35m., the front road thereof only may be considered as the front road. 3 With regard, out of the areas other than that mentioned in paragraph 1, to the area with horizontal distance from the boundary line of more than two roads within the limit of twice the widthof each road and at the same time with the distance within the limit of 35m., the narrowest road of the front roads thereof shall be considered as having the same width of the wider road. (When Site abuts on Park, Open Space, Body of Water, etc.) Article 133. In case a site of a building abuts on park, open space, body of water, or others of the similar nature, the height of each and all part of said building may be taken 1.5 times or less (1.25 times in residential zone) of the horizontal distance measured from the boundary line of the opposite side of the front road, and at the same time, it shall not exceed twice the width of front road (1.75 times in residential zone) increased by 8m., and it shall not exceed the width of said park, open space, body of water, or others of the same or similar nature. (In case Park, Open Space, Body of Water or the Like exists on the Opposite Side of Front Road) Article 134. In case park, open space, body of water or the like exists on the opposite side of front road, the height at any and all parts of said building shall be less than 1.5 times of the horizontal distance from that part or parts of building to the boundary line on opposite side of said park, open space, body of water or the like (1.25 times in residential zone), and at the same time, it does not exceed twice the width of front road (1.75 times in residential zone) plus 8 m. In case there is wall-surface line receded front road boundary line is opposite front road, the height of each part of that building shall be 1.5 times (in residential zone 1.25 times) the distance measured horizontally from that part to that wall line, or less, and at the same time it shall not exceed the width equal to or less than 1.5 times the width of front road (1.25 times in residential zone) plus 8 m. (In Case Level of Road and Building Site not at Same Height) Article 136. In case the level of building site is higher than front road by 1 m. or more, the front road shall be considered to exist at tbe level equal to 1/2 or the difference of levels or the ground and building sites and the front road minus one meter. 2 In case the administrative agency concerned deems it extremely improper to apply the pro* cedures as prescribed in the provisions of the preceding paragraph by reason of the special character of feature of land, irrespective of the provisions of said paragraph, the height of the position of that road may, by regulation, be determined as deemed proper so long as the height is kept within the level of ground at the position and site prescribed by the provisions of the same paragraph. CHAPTER VIII Miscellaneous Provisions ! (Similarity of Uses) Article 137. The mutual relation of similar uses as provided for in the proviso to Article 87 paragraph 2 of the Law shall, in case of existing building, mean the mutuality of uses belonging to the same item in the following items: (1) Theater, cinema, show house, auditorium, meating place ; (2) Department store, market; (3) Hotel, Ryokan (Japanese hotel) ; (4) Apartment house, dormitory, lodging house, hospital, medical office (excepting that which has no accommodating facilities for patients). Regarding the application of the provisions of Article 49 of the Law or Article 50 paragraph 2 or paragraph 4^ of the Law, irrespective of the preceding paragraph, and in the case of existing building, mean the mutual uses of the same item of each item (if there is any item separated by parenthesis within the item, meant by that item ; in paragraph (c) item 1 item (1), item (2), item (3), item (4) and item (12) where it says "manufacture" shall also include disposal as well as of annexed Table No. 1 of the Law (excluding parts concerning articles or things of paragraph (A) item 1 paragraph (B) item (1) and paragraph (C) item 2 item (1), item (2), item (3), item (4) and -35- i item (12)) and the each item of annexed Table No. 2 of the Law. 3 Regarding the designation of similarity of uses provided for in the proviso to the same paragraph in case of applying mutatis mutandis of the provisions of the by-law given in the same paragraph in accordance with the provisions of Article 87 paragraph 2 of the Law irrespective of the provision of paragraph 1, separate provision may be made by the same by-law. (Designation of Structures) Article 138. In accordance with the provisions of Article 88 paragraph 1 of tfie Law, the following items of structures (excluding those concerning operation, safety, etc., within the site of railway and tramway shall be designated : (1) Chimney exceeding 6m. in height (in case there is frame for support or stay lines, the same included and the stove-chimney excluded) ; (2) Reinforced concrete column, steel column, wooden column exceeding 15m. in height or other similar ones (excluding flag pole and transmission poles for electricity) ; (3) Advertisement tower, advertisement boanjn decoration tower, memorial tower, and other similar structures ; (4) Wooden elevated tank, silo and watch tower exceeding 8m. in height or other similar structures ; (5) Retaining walls exceeding 2m. in height, (Chimney and Stays at Chimney) Article 139. Regarding the chimney given in paragraph 1 item (1), of the preceding Article in addition to applying mutatis mutandis the provisions of Article 36, Article 37, Article 40, Article 41, Article 47, Article 51 paragraph 1, Article 52, Article 53, Section 5? Section 6 (excluding Article 76 to Article 78 inclusive) and Section 7 (Article 51 paragraph 1, Article 53, Article 71, Article 72, Article 74 and parts applying mutatis mutandis of Article 75 only) the following items shall apply respectively according to the structural requirement: (1) Chimney constructed of terra cotta pipes, concrete pipes or pipes of similar make shall use mortar with cement at each connection or joint, and it shall be tied firmly to the supporting frame, or supporting frame and stay wires. However, those exceeding 10 m. in height shall be built of self-supporting frames ; (2) Chimney of masonry construction shall be provided with steel frame to prevent it from falling down; (3) In reinforced concrete chimney, the thickness of concrete cover over steel bars shall be more than 5cm; (4) Chimney exceeding 16m. in height shall be of reinforced concrete construction which requires no stay wires.
