<strong>OSCA</strong> <strong>11</strong>-<strong>036</strong> Treatment Court Specialized Service Providers<br />

<strong>Addiction</strong> <strong>Awareness</strong> llc assumes liability for all disclosures of confidential information by<br />

<strong>Addiction</strong> <strong>Awareness</strong> llc and/or <strong>Addiction</strong> <strong>Awareness</strong> llcs/provider’s subprograms and<br />

employees.<br />

All records processed and created by <strong>Addiction</strong> <strong>Awareness</strong> llc in the performance of services<br />

contain personal information that is restricted from release pursuant to state and federal law,<br />

specifically Sections 32.057 and 32.091, RSMo. To the extent <strong>Addiction</strong> <strong>Awareness</strong> llc or <strong>Addiction</strong><br />

<strong>Awareness</strong> llc’s personnel may have access to any report, return or other information received by<br />

<strong>OSCA</strong> in connection with the administration of the tax laws of the state of Missouri, <strong>Addiction</strong><br />

<strong>Awareness</strong> llc and <strong>Addiction</strong> <strong>Awareness</strong> llc’s personnel shall comply with Section 32.057, RSMo.<br />

Any person making unlawful disclosure of information in violation of such Section shall, upon<br />

conviction, be guilty of a Class D felony.<br />

<strong>Addiction</strong> <strong>Awareness</strong> llc assumes liability for all unauthorized disclosures of confidential<br />

information by <strong>Addiction</strong> <strong>Awareness</strong> llc and/or any of <strong>Addiction</strong> <strong>Awareness</strong> llc’s personnel. In the<br />

event that records or copies of any such material are to be destroyed, <strong>Addiction</strong> <strong>Awareness</strong> llc<br />

shall accomplish such destruction in a manner prescribed by <strong>OSCA</strong> and ensuring the obliteration<br />

of all data and preventing improper or unauthorized disclosure of the personal, restricted<br />

information. Shredding the materials shall satisfy this requirement. <strong>Addiction</strong> <strong>Awareness</strong> llc will<br />

comply with <strong>OSCA</strong> policy regarding record retention and destruction.<br />

Authorized Personnel (Immigrant Responsibility Act)<br />

<strong>Addiction</strong> <strong>Awareness</strong> llc understands and agrees that by signing the RFP, <strong>Addiction</strong> <strong>Awareness</strong> llc<br />

certifies the following:<br />

<strong>Addiction</strong> <strong>Awareness</strong> llc will only utilize personnel authorized to work in the United States<br />

in accordance with applicable federal and state laws. This includes but is not limited to the<br />

Illegal Immigration Reform and Immigrant Responsibility Act (IIRIRA) and INA Section<br />

274A.<br />

If <strong>Addiction</strong> <strong>Awareness</strong> llc is found to be in violation of this requirement or the applicable<br />

state, federal and local laws and regulations, and if the state of Missouri has reasonable<br />

cause to believe that <strong>Addiction</strong> <strong>Awareness</strong> llc has knowingly employed individuals who are<br />

not eligible to work in the United States, the state shall have the right to cancel the contract<br />

immediately without penalty or recourse and suspend or debar <strong>Addiction</strong> <strong>Awareness</strong> llc<br />

from doing business with the state.<br />

Assignment<br />

<strong>Addiction</strong> <strong>Awareness</strong> llc will agree and understand that, in the event <strong>OSCA</strong> consents to a financial<br />

assignment of the contract, in whole or in part to a third party, any payments made by the state of<br />

Missouri pursuant to the contract, including all of those payments assigned to the third party, shall<br />

be contingent upon the performance of the prime <strong>Addiction</strong> <strong>Awareness</strong> LLC in accordance with all<br />

terms and conditions, requirements and specifications of the contract.<br />

Insurance<br />

<strong>Addiction</strong> <strong>Awareness</strong> llc shall understand and agree that the state of Missouri cannot save and<br />

hold harmless and/or indemnify <strong>Addiction</strong> <strong>Awareness</strong> llc or employees against any liability<br />

incurred or arising as a result of any activity of <strong>Addiction</strong> <strong>Awareness</strong> llc or any activity of<br />

<strong>Addiction</strong> <strong>Awareness</strong> llc's employees related to <strong>Addiction</strong> <strong>Awareness</strong> llc's performance under the<br />

contract. Therefore, <strong>Addiction</strong> <strong>Awareness</strong> llc will acquire and maintain adequate liability<br />
