the required program entry fees. Candidates who fail to successfully complete the<br />

program within the established time allotment will be required to reimburse the<br />

<strong>Harford</strong> <strong>County</strong> <strong>Public</strong> <strong>Schools</strong> for program entry fees. National Board Certified<br />

Teachers will be paid on the same scale as Master’s Degree with Professional<br />

Certificate.<br />

ARTICLE XXII<br />

Personal Rights<br />

22.1 No teacher shall be reduced in compensation or reduced in rank with a resulting<br />

reduction in compensation for arbitrary or capricious reasons.<br />

22.2* Any discipline of an employee by a supervisor shall be conducted in private, so as to<br />

avoid embarrassment to the employee, except when immediate action is required by<br />

the supervisor in an emergency situation.<br />

22.3* The teacher is recognized as the person with primary responsibility for determining<br />

the grades for the students in his or her class.<br />

22.4* Teachers’ Citizenship Rights. The Board of Education recognizes the citizenship<br />

rights of teachers. Should any section of this agreement be held to be violative of a<br />

teacher’s citizenship rights under the law by a court of competent jurisdiction, such<br />

section of this agreement shall be deemed null and void.<br />

22.5* Self-Protection. A teacher may, in accordance with the law, apply such amount of<br />

force as is reasonable and necessary for the purpose of self-defense.<br />

22.6* Whenever a teacher is required to appear before the Superintendent, or his/her<br />

designee, for the purpose of discussing suspension or dismissal, the teacher shall be<br />

given the opportunity to have a representative of the Association present.<br />

22.7* Right to Respond. A teacher may attach a signed and dated addendum to<br />

documents placed in his/her file.<br />

22.8* The Board and the Association agree not to interfere with the right of the teacher to<br />

join and participate in the Association or not to join the Association.<br />

*These provisions are not subject to the grievance procedure.<br />
