time will not count as active service.<br />

The layoff and recall provisions of this article are subject to such Equal Employment<br />

Opportunity Commission guidelines or other employment programs as required of or<br />

adopted by the Board of Education in order to maintain existing or required staff balance.<br />

Any action taken under this policy will not be subject to the grievance procedure; however,<br />

it shall be subject to the administrative complaint procedure.<br />

ARTICLE XXVI<br />

Rehired, Retired Teachers<br />

26.1 A. Definition: “Rehired, Retired Teacher” (RRT) shall mean a teacher, as defined<br />

by the <strong>Negotiated</strong> <strong>Agreement</strong>, who has entered regular or early retirement from a<br />

Maryland school system under the provisions of the State Personnel and Pensions<br />

Article of the Annotated Code of Maryland.<br />

All other provisions of the <strong>Negotiated</strong> <strong>Agreement</strong> shall apply to RRTs except those<br />

specifically excluded or amended below:<br />

C. Amendments to the <strong>Negotiated</strong> <strong>Agreement</strong>:<br />

1. Article 6.2 – Administrative Transfers<br />

RRTs will be separated first when a reduction in staff at a school is<br />

necessary.<br />

2. Article 11 – Sick Leave<br />

a) 11.1 – A RRT shall accrue sick leave only during consecutive years<br />

of service with HCPS. Upon leaving service with HCPS, all accrued<br />
