2.6 Should either party suggest an impasse, the procedures as provided in the<br />

Education Article, Title 6, Subtitle 4 of the Annotated Code shall be followed.<br />

2.7 The panel shall be named as provided in Education Article, Title 6, Subtitle 4,<br />

Section 6-408(d), of the Annotated Code of Maryland. In the event that the two<br />

initial panel members cannot agree upon a third party, the third member of the panel<br />

shall be determined by:<br />

(A) Requesting a list of seven arbitrators from the American Arbitration<br />

Association. (A list of five arbitrators may be requested in the event that<br />

there is mutual agreement to do so.)<br />

(B) Drawing lots to determine which of the two initial panel members shall<br />

first strike a name from the list.<br />

(C) Alternately striking names from the list until one name remains, such<br />

person to be the third panel member.<br />

2.8 All other provisions for handling an impasse as provided by Education Article, Title<br />

6, Subtitle 4, of the Annotated Code of Maryland shall apply.<br />

2.9 Modification of <strong>Agreement</strong>. This agreement may not be modified in whole or in<br />

part except by an instrument in writing duly executed by both parties.<br />

ARTICLE III<br />

Board’s Rights<br />

Subject to the terms and conditions of this agreement and to the authority of the State Board<br />

of Education under Education Article of the Annotated Code of Maryland, it shall be the<br />

exclusive function of the Superintendent of <strong>Schools</strong> and the Board to determine the mission<br />

of the county public education system, set the standards of service to be offered, maintain<br />

the efficiency of operations, determine the methods, means, and personnel by which such<br />

operations are to be conducted, and to take whatever action and issue rules, policies, and<br />

regulations necessary to carry out the mission of the county public education system for<br />

which they are responsible and which is entrusted to them.<br />
