REPORTING REQUIREMENTS WHEN AN <strong>IB</strong>'S ADJUSTED NET CAPITAL IS BELOW THE<br />
MINIMUM REQUIREMENTS (UNDERCAPITALIZATION)<br />
Each <strong>IB</strong> who knows, or should have known, that its adjusted net<br />
capital at any time is less than the minimum net capital required by<br />
Section 1.17 of the Regulations, or the capital rule of any selfregulatory<br />
organization of which the <strong>IB</strong> is a member, must give<br />
telegraphic notice of its undercapitalization to the principal office<br />
of the Commission in Washington, D.C., to the appropriate regional<br />
office of the Commission (see "Where to File" on page 1-3), to its<br />
DSRO, if any, to the NFA, if the firm is an applicant for<br />
registration, and to the SEC, if such <strong>IB</strong> is a securities<br />
broker/dealer. Such notice must be given within 24 hours after the <strong>IB</strong><br />
knew, or should have known, of its undercapitalization.<br />
Within 24 hours after giving notice of its undercapitalization,<br />
an <strong>IB</strong> must file with the same organizations to which it sent<br />
telegraphic notice the following statements as of the date of its<br />
undercapitalization:<br />
(1) a Statement of Financial Condition; and<br />
(2) a Statement of the Computation of the Minimum Capital<br />
Requirements Pursuant to Section 1.17 of the Regulations;
