(1) Surety (Bürgschaft) by the State for the performance of the obligations of another (Administrative Rule No.<br />

1 to Section 39 of the Budgeting Principles Act of <strong>Baden</strong>-Württemberg (Landeshaushaltsordnung) in<br />

connection with Sections 765 et seq. of the German Civil Code (Bürgerliches Gesetzbuch — BGB)).<br />

(2) Agreements, independent of the underlying agreement, by which the state secures a monetary interest of the<br />

recipient of the guaranty by agreeing to assume the responsibility for the occurrence of a specific event, in<br />

particular to assume, in whole or in part, the risk of a future contingent loss (Administration Rule No. 2 to<br />

Section 39 of the Budgeting Principles Act of <strong>Baden</strong>-Württemberg).<br />

(3) A suretyship for a surety (Rückbürgschaft) is a suretyship within the meaning of Sections 765 et seq. BGB<br />

that is given by the State in favor of a surety by which the State promises to reimburse the surety, in whole<br />

or in part, for payments made by the surety under his suretyship.<br />

(4) A guaranty for a guarantor (Rückgarantie) is a guaranty, being an agreement independent of the underlying<br />

agreement, that is given by the State in favor of a guarantor by which the State promises to reimburse the<br />

guarantor, in whole or in part, for payments made by the guarantor under his guaranty.<br />

(5) In addition to the contingent liabilities arising from Bürgschaften, Garantien, and other warranties shown in<br />

the table above, <strong>Baden</strong>-Württemberg is currently liable under existing support mechanisms, such as<br />

maintenance obligation (Anstaltslast), explicit guaranty or guaranty obligation (Gewährträgerhaftung) with<br />

respect to liabilities of certain state-owned entities organized under public law.<br />
