■ 4. The role of the legal guardian (or “responsible<br />

adult” in the absence of the appointment of a legal<br />

guardian) should be to ensure that the child’s best<br />

interests are met during the asylum interview.<br />

■ 5. Unaccompanied or separated children should<br />

always be provided with an independent interpreter<br />

at an interview to ensure the accuracy of<br />

interpretation provided <strong>by</strong> the Home Office and<br />

also to ensure that the child’s legal representative<br />

can remind the child of the function and format<br />

of the interview just before it takes place. It is also<br />

important to have an interpreter present to reassure<br />

the child or answer any questions he or she<br />

may have immediately after the interview finishes.<br />

The initial decision about whether to grant<br />

asylum to an unaccompanied or separated<br />

child is taken <strong>by</strong> a case worker within the<br />

Immigration and Nationality Directorate, who<br />

assumes the delegated duties and powers of the<br />

Secretary of State for the Home Department. As<br />

civil servants these case workers are supposed to<br />

be politically neutral but many legal representatives<br />

and non-governmental <strong>org</strong>anizations have noted<br />

a distinct blurring in recent years between the<br />

objectivity generally expected of civil servants and<br />

the IND expectation that their staff will respond to<br />

the “political” targets set <strong>by</strong> Ministers for the number<br />

of asylum seekers to be granted protection and<br />

the number of failed asylum seekers to be removed<br />
