Note 23. Contingencies
Contingent Liabilities
Under the Contaminated Sites Act 2003, the Authority is required to report known and suspected contaminated
sites to the Department of Environment and Conservation (DEC). In accordance with the Act, DEC classifies these
sites on the basis of the risk to human health, the environment and environmental values. During the reporting
period, a section of land vested in Port Hedland Port Authority was listed under the Contaminated Sites Act as
Contaminated-Remediation Required.
Where sites are classified as contaminated – remediation required or possibly contaminated – investigation
required, the Authority may have a liability in respect of investigation or remediation expenses. Port Hedland
Port Authority have made submissions under the Act and is working with the lessees to manage the
remediation.One contract as part of the delivery of the Utah Point project is currently in dispute and has
proceeded to arbitration, and PHPA have lodged a counter claim.
