b. Selection of Offeror<br />
a) The acceptability of the technical portion of your contract proposal<br />
will be evaluated by a technical review committee. The committee<br />
will evaluate your proposal in strict conformity with the evaluation<br />
criteria of the <strong>RFP</strong>, utilizing point scores and written critiques.<br />
The committee may suggest that the Contracting Officer request<br />
clarifying information from an offeror.<br />
b) The business portion of your contract proposal will be subjected to<br />
a cost, cost realism and price analysis. Proposed costs which are<br />
found to be unrealistic may be adjusted, in order to allow better<br />
evaluation of the total price of the offer.<br />
c) If award will be made without conducting discussions, you may be<br />
given the opportunity to clarify certain aspects of their proposal or<br />
to resolve minor or clerical errors.<br />
d) The Government reserves the right to make a single award or no<br />
award at all to the <strong>RFP</strong>. In addition, the <strong>RFP</strong> may be amended or<br />
canceled as necessary to meet government’s requirements.<br />
e) Salary Rate Limitation Legislation<br />
Pursuant to P.L. 109-149, no Fiscal Year 20<strong>06</strong> (October 1, 2005 –<br />
September 30, 20<strong>06</strong>) funds may be used to pay the direct salary of an<br />
individual through this contract at a rate in excess of the direct salary<br />
rate for Executive Level I of the Federal Executive Pay Scale. That<br />
rate is $183,000 per year for the period of January 1, 20<strong>06</strong> through<br />
December 31, 20<strong>06</strong>. Direct salary is exclusive of overhead, fringe<br />
benefits, and general and administrative expenses. The salary limit<br />
also applies to individuals proposed under subcontracts. If this is a<br />
multi-year contract, it may be subject to unilateral modifications by the<br />
Government if any salary rate ceilings are established in future DHHS<br />
appropriation acts. P.L. 109-149 states in pertinent part:<br />
None of the funds appropriated in this Act for the National Institutes of<br />
Health, the Agency for Healthcare Research and Quality, and the<br />
Substance Abuse and Mental Health services Administration shall be<br />
used to pay the salary of an individual, through a grant or other<br />
extramural mechanism, at a rate in excess of Executive Level I.<br />
Contractors shall absorb that portion of an employee’s salary (plus the<br />
dollar amount for fringe benefits and indirect costs associated with the<br />
excess) that exceeds a rate of $183,500 a year.<br />
