The case was again considered by the SEAC in its 22 nd meeting held on 9.5.2009, wherein, it was decided to give another opportunity to the project proponent to clarify, within 15 days, as to whether he wants to pursue the case or not. The said decision of the SEAC was conveyed to the project proponent vide letter no. 18832 dated 25.5.2009, which was received undelivered form the Postal Authorities. 4. The case was lastly considered by the SEAC in its 41st meeting held on 3.7.2010. But no representative of the promoter attended the meeting despite the fact that the project proponent was requested vide letter no. 28863 dated 23.06.2011 to attend the said meeting. Accordingly, the Committee decided to recommend the case to SEIAA for refusal of environmental clearance due to the following reasons: i) The project proponent has not given power point presentation of the proposed project for its transparent appraisal despite for the same. ii) The project proponent has not responded to any letters issued by the authority. iii) The project proponent has not submitted any report despite 4 reminders, regarding deliver of the letters received un-deliver from the postal authorities. 5. The case was considered by the SEIAA in the 29 th meeting of SEIAA held on 23.3.2011, wherein, it was decided to afford a final opportunity to the project proponent to the effect as to whether he wants to pursue the application submitted for obtaining environmental clearance or not, within 15 days and it was also decided that in case, no response is received from the project proponent within the said period, the application filed by project proponent for environmental clearance will be decided on merits and material evidences available in the record file. The said decision of the SEIAA was conveyed to the project proponent vide letter No. SEIAA/MS/2011/16441 dated 7.4.2011. A reminder was also issued by the SEIAA vide letter No. SEIAA/MS/2011/17080 dated 19.4.2011, but no response was received from the project proponent. The SEIAA further observed that the project proponent was requested vide letter no. 1769 dated 17.05.2011 to attend the 31 st meeting of SEIAA on 20.05.2011 to submit the reply of observations conveyed by the Authority vide letter no. 16441 dated 07.04.2011 on or before 20.05.2011, but no 12
authorized representative of the project proponent attended the said meeting. The Authority further noted that ample opportunity has already been afforded by the SEAC as well as SEIAA to the project proponent to present the project proposal, but the project proponent has failed to respond to the communication made by the SEAC/SEIAA from time to time. The SEIAA, therefore, decided to refuse the application filed by the project proponent and to convey the said refusal orders to him. Item No. SEIAA/31.05 Application for obtaining environmental clearance for “DLF Premium Homes” a Residential Group Housing Project to be developed by M/s DLF Premium Homes Pvt. Ltd. at Vill. Khajurla, Distt. Kapurthala. The SEIAA observed that: 1. M/s DLF Premium Homes Pvt. Ltd. has applied for obtaining environmental clearance as required under EIA Notification dated 14.9.2006 for developing a Residential Group Housing Project namely “DLF Premium Homes” in an area of 72,600 sq. m in the revenue estate of Kapurthala. Vill. Khajurla, Distt. 2. The built up area is 1,22,290.15 sq. m for residential purpose and 58200 sq. m for basement. Thus, the total built up area is 1,80,490.15 sq. m, as such, project of promoter is covered under category 8 (b) of the Schedule appended to the said notification. 3. The case of the project proponent was considered in 17 th meeting of State Expert Appraisal Committee held on 17.1.2009, which was attended by the authorized representative of the project proponent and environmental consultant of the promoter company. After detailed deliberations in the matter, the SEAC observed that the project proponent is required to submit the reply of following observations before taking further necessary action in the matter and it was decided to defer the case till the reply of these observations is received. i. The project proponent shall submit approval regarding change of land use for the project site, from the Competent Authority. ii. The project proponent shall submit copy of approved layout plan from the Competent Authority. iii.
