2. Sh. Hardeep Singh, Deputy Chief Engineer Sh. Sandeep Garg, who is the Environmental Consultant of the project proponent and the name of his consultancy firm figures at Sr.no. 157 of the list uploaded by the MoEF at its official website, presented the reply of the observations as under: i) GMADA had accorded an approval vide letter no. 859 dated 16.05.2011 to the effect that Sector 90 & 91 is a part of the Master Plan of SAS Nagar and while designing the trunk sewer, the hydraulic load of wastewater of these sectors had been taken into account and that the laying of said sewer is under consideration of GMADA. In this said approval, the GMADA has mentioned that as and when the sewer is laid down, total discharge of wastewater of Sectors 90 & 91 will be allowed to be discharged into the sewer. ii) iii) iv) No treated wastewater will be discharged into sewer during summer season, since the entire wastewater will be utilized for flushing purpose and irrigation of green area. However, during the monsoon and winter seasons, the treated wastewater to the tune of 312 KLD and 123 KLD, respectively, will be discharged into sewer. Submitted an undertaking to the effect that 80% of the rain water shall be first used to recharge the aquifer and the excess rain water will be stored and treated for further use within the project premises during the nonmonsoon period. A STP with a capacity to handle 1250 KLD of wastewater based on SAFF technology has been installed to treat the wastewater of the township which has already been put into operation since at present wastewater is being generated by 30 houses occupied by the respective plot holders. v) The site of the township is located in the residential zone as per the Master Plan of Mohali and submitted a copy of the said Master Plan as evidence in this regard and brought out that as per amendment made by the Govt. of Punjab, Deptt. of Science, Technology and Environment, Punjab vide notification dated 30.10.2009 in the Order dated 25.7.2008, in case, any development/construction project comes up in the earmarked zone, there is no need to keep any additional distance from the existing industry from the environmental point of view because these factors have already been 6
considered while earmarking the use of land for different categories in the Master Plan. vi) The Govt. of Punjab in the agreement executed on 24.6.2005 between M/s Janta Land Promoters and Deptt. of Industries & Commerce, Punjab has allowed the relief and concessions to the effect that the permission under Punjab State Tubewell Act, 1954 to dig tubewell in the project area for requirement of the project was allowed. The Authority observed that the project proponent has provided adequate and satisfactory clarifications of the observations raised by it, therefore, the Authority decided to grant environmental clearance to the project proponent subject to the following conditions, in addition to the proposed measures. PART A – Specific conditions I. Construction Phase I. “Consent to establish” shall be obtained from Punjab Pollution Control Board under Air (Prevention & Control of Pollution) Act, 1981 and Water (Prevention & Control of Pollution) Act, 1974 and a copy of the same shall be submitted to the Ministry of Environment & Forests / State Level Environment Impact Assessment Authority before the start of any construction work at site. II. III. IV. All required sanitary and hygienic measures should be in place before starting construction activities and to be maintained throughout the construction phase. A first aid room will be provided in the project both during construction and operation phase of the project. All the topsoil excavated during construction activities should be stored for use in horticulture / landscape development within the project site. V. Disposal of muck during construction phase should not create any adverse effect on the neighboring communities and be disposed off after taking the necessary precautions for general safety and health aspects of people with the approval of competent authority. VI. VII. VIII. IX. Construction spoils, including bituminous material and other hazardous material, must not be allowed to contaminate watercourses and the dump sites for such material must be secured, so that they should not leach into the ground water. The diesel generator sets to be used during construction phase should be of low sulphur diesel type and should conform to the provisions of Environment (Protection) Act, 1986 prescribed for air and noise emission standards. Vehicles hired for bringing construction material to the site and other machinery to be used during construction should be in good condition and should conform to applicable air and noise emission standards. Ambient noise levels should conform to prescribed standards both during day and night. Incremental pollution loads on the ambient air 7
