At the outset, the Member Secretary (SEIAA) welcomed the<br />

members of the <strong>State</strong> <strong>Environment</strong> <strong>Impact</strong> <strong>Assessment</strong> <strong>Authority</strong> (SEIAA) in 31 st<br />

meeting. Thereafter, various agenda items were discussed in detail as under:<br />

Item no. SEIAA/31.01:<br />

Confirmation of the proceedings of 30 th<br />

meeting of SEIAA held on 27.04.<strong>20</strong>11.<br />

Proceedings of 30 th meeting of the <strong>State</strong> <strong>Level</strong><br />

<strong>Environment</strong> <strong>Impact</strong> <strong>Assessment</strong> <strong>Authority</strong> held on 27.04.<strong>20</strong>11 were circulated to<br />

all the members vide letter no. 1691-92 dated 16.<strong>05</strong>.<strong>20</strong>11. No observations had<br />

been received on the same, thus, the SEIAA confirmed the said proceedings.<br />

Item no. SEIAA/31.02:<br />

<strong>Assessment</strong> <strong>Authority</strong>.<br />

Follow up action on the decisions of the<br />

30 th meeting of SEIAA held on 27.04.<strong>20</strong>11.<br />

It was seen by the <strong>State</strong> <strong>Environment</strong> <strong>Impact</strong><br />

Item No. SEIAA/31.03 Application for obtaining environmental<br />

clearance for “Janta Township” a Residential<br />

Project to be established by M/s Janta Land<br />

Promoters Ltd. at Sector 90-91, Mohali.<br />

The SEIAA observed that:<br />

1. M/s Janta Land Promoters Ltd. has applied for obtaining environmental<br />

clearance under EIA Notification dated 14.9.<strong>20</strong>06 for developing “Janta<br />

Township” at Sector 90-91, Distt. Mohali in an area of 138.35 acres into<br />

plots, group housing, schools, dispensary, community centre and<br />

commercial area. The built up area of the project is 7<strong>20</strong>30.6 sq. m, thus,<br />

the project is covered under category 8 (b) of the Schedule appended to<br />

the said notification.<br />

2. The case was considered by the SEAC in its 23 rd meeting held on 6.6.<strong>20</strong>09<br />

and after detailed deliberations on the project proposal / reply submitted by


the project proponent, the Committee awarded „Silver Grading‟ to the<br />

project and recommended the project to <strong>State</strong> <strong>Level</strong> <strong>Environment</strong> <strong>Impact</strong><br />

<strong>Assessment</strong> <strong>Authority</strong> for grant of environmental clearance subject to<br />

certain conditions.<br />

3. Thereafter, the case of the project proponent was considered by the SEIAA<br />

in its 19 th meeting held on 27.06.<strong>20</strong>09 and again in its 25 th meeting held on<br />

15.12.<strong>20</strong>09, wherein, it was decided that:<br />

a) The case may be forwarded to <strong>State</strong> Expert Appraisal Committee to reexamine<br />

the matter, in view of new notification for ambient air quality<br />

standards, reply submitted by project proponent, report of PPCB<br />

regarding industries within 500 m radius of the project site and<br />

recommendations of PPCB regarding discharge of effluent into Patiala-<br />

Ki-Rao.<br />

b) The PPCB may be requested to send the report regarding discharge of<br />

effluent into Patiala-Ki-Rao directly to Secretary, SEAC with a copy to<br />

Member Secretary, SEIAA.<br />

4. The case was again considered by the SEAC in its 41 st meeting held on<br />

03.07.<strong>20</strong>10 and the Committee decided to ask the project proponent to<br />

submit the following documents:<br />

a) Revised water balance and its disposal mechanism to be adopted<br />

during rainy season as well as winter season.<br />

b) Location plan clearly describing the type of industries located within<br />

500 m from the boundary of the project.<br />

c) Plan of dual plumbing system & number of buildings which will have<br />

such plumbing system with water requirement / consumption.<br />

d) Analysis report of ambient air quality monitoring as per notification no.<br />

GSR.826 (E) dated 16/11/<strong>20</strong>09 issued by the Ministry of <strong>Environment</strong><br />

& Forests, from MoEF / NABL accredited laboratories for post monsoon<br />

season and the analysis/results.<br />

e) The latest photographs of the construction site from all the four<br />

directions.<br />

The aforesaid decision was conveyed to the project proponent<br />

by the SEAC vide letter no. 331<strong>05</strong> dated 22.7.<strong>20</strong>10.<br />

5. The case was sent to MoEF, New Delhi in the month of August, <strong>20</strong>10 due to<br />

non-functioning of SEIAA/SEAC for the <strong>State</strong> of Punjab.<br />

6. Thereafter, the project proponent vide Memo no. 5586 dated 13.9.<strong>20</strong>10<br />

submitted the requisite reply to the MoEF, New Delhi and the case was<br />

considered by the EAC of MoEF, New Delhi in its 93rd meeting held on 9-<br />

10th October, <strong>20</strong>10 and the EAC recommended the proposal for<br />

environmental clearance subject to the following conditions in the clearance<br />

letter for strict compliance by the project proponent.<br />

a) Rainwater should be stored and shall be used for domestic purposes<br />

after necessary treatment.<br />

b) Explore the possibility to maximize the use of treated wastewater<br />

including using for flushing of toilets etc.<br />

7. Now, after constitution of SEIAA/SEAC for the <strong>State</strong> of Punjab, by the<br />

MoEF, New Delhi vide order dated 7.2.<strong>20</strong>11, the case has been returned by<br />

MoEF to SEIAA, Punjab.<br />

8. The case of the project proponent was considered by the SEIAA in its 29 th<br />

meeting held on 23.03.<strong>20</strong>11, wherein, it was decided that the project<br />

proponent shall submit following documents/information within 10 days:<br />

i) Specific approval given by GMADA mentioning quantity of treated<br />

wastewater to be allowed to be discharged into sewer.<br />

ii)<br />

An undertaking/commitment to make arrangement for storage of<br />

rainwater and use of the same for domestic purpose after necessary<br />

treatment.<br />

9. The aforesaid decision was conveyed to the project proponent by the SEIAA<br />

vide letter no. 16438 dated 7.4.<strong>20</strong>11.<br />

10. The project proponent vide letter dated 17.<strong>05</strong>.<strong>20</strong>11 has submitted that the<br />

reply of the observations raised by the SEIAA in its 29 th meeting.<br />

Accordingly, the project proponent was requested vide letter no. 1768<br />

dated 17.5.<strong>20</strong>11 to attend the 31 st meeting of SEIAA on <strong>20</strong>.5.<strong>20</strong>11.<br />

The following were present on behalf of the project proponent in the<br />

31 st meeting of SEIAA held on <strong>20</strong>.<strong>05</strong>.<strong>20</strong>11 to present the reply to the observations<br />

made by the SEIAA in its 29 th meeting.<br />

2. Sh. Hardeep Singh, Deputy Chief Engineer<br />

Sh. Sandeep Garg, who is the <strong>Environment</strong>al Consultant of the<br />

project proponent and the name of his consultancy firm figures at Sr.no. 157 of<br />

the list uploaded by the MoEF at its official website, presented the reply of the<br />

observations as under:<br />

i) GMADA had accorded an approval vide letter no. 859 dated 16.<strong>05</strong>.<strong>20</strong>11 to<br />

the effect that Sector 90 & 91 is a part of the Master Plan of SAS Nagar and<br />

while designing the trunk sewer, the hydraulic load of wastewater of these<br />

sectors had been taken into account and that the laying of said sewer is<br />

under consideration of GMADA. In this said approval, the GMADA has<br />

mentioned that as and when the sewer is laid down, total discharge of<br />

wastewater of Sectors 90 & 91 will be allowed to be discharged into the<br />

sewer.<br />

No treated wastewater will be discharged into sewer during summer<br />

season, since the entire wastewater will be utilized for flushing purpose and<br />

irrigation of green area. However, during the monsoon and winter seasons,<br />

the treated wastewater to the tune of 312 KLD and 123 KLD, respectively,<br />

will be discharged into sewer.<br />

Submitted an undertaking to the effect that 80% of the rain water shall be<br />

first used to recharge the aquifer and the excess rain water will be stored<br />

and treated for further use within the project premises during the nonmonsoon<br />

period.<br />

A STP with a capacity to handle 1250 KLD of wastewater based on SAFF<br />

technology has been installed to treat the wastewater of the township<br />

which has already been put into operation since at present wastewater is<br />

being generated by 30 houses occupied by the respective plot holders.<br />

v) The site of the township is located in the residential zone as per the Master<br />

Plan of Mohali and submitted a copy of the said Master Plan as evidence in<br />

this regard and brought out that as per amendment made by the Govt. of<br />

Punjab, Deptt. of Science, Technology and <strong>Environment</strong>, Punjab vide<br />

notification dated 30.10.<strong>20</strong>09 in the Order dated 25.7.<strong>20</strong>08, in case, any<br />

development/construction project comes up in the earmarked zone, there is<br />

no need to keep any additional distance from the existing industry from the<br />

environmental point of view because these factors have already been<br />

considered while earmarking the use of land for different categories in the<br />

Master Plan.<br />

The Govt. of Punjab in the agreement executed on 24.6.<strong>20</strong><strong>05</strong> between M/s<br />

Janta Land Promoters and Deptt. of Industries & Commerce, Punjab has<br />

allowed the relief and concessions to the effect that the permission under<br />

Punjab <strong>State</strong> Tubewell Act, 1954 to dig tubewell in the project area for<br />

requirement of the project was allowed.<br />

The <strong>Authority</strong> observed that the project proponent has provided<br />

adequate and satisfactory clarifications of the observations raised by it, therefore,<br />

the <strong>Authority</strong> decided to grant environmental clearance to the project proponent<br />

subject to the following conditions, in addition to the proposed measures.<br />

PART A – Specific conditions<br />

I. Construction Phase<br />

I. “Consent to establish” shall be obtained from Punjab Pollution Control<br />

Board under Air (Prevention & Control of Pollution) Act, 1981 and Water<br />

(Prevention & Control of Pollution) Act, 1974 and a copy of the same<br />

shall be submitted to the Ministry of <strong>Environment</strong> & Forests / <strong>State</strong><br />

<strong>Level</strong> <strong>Environment</strong> <strong>Impact</strong> <strong>Assessment</strong> <strong>Authority</strong> before the start of any<br />

construction work at site.<br />

All required sanitary and hygienic measures should be in place before<br />

starting construction activities and to be maintained throughout the<br />

construction phase.<br />

A first aid room will be provided in the project both during construction<br />

and operation phase of the project.<br />

All the topsoil excavated during construction activities should be stored<br />

for use in horticulture / landscape development within the project site.<br />

V. Disposal of muck during construction phase should not create any<br />

adverse effect on the neighboring communities and be disposed off<br />

after taking the necessary precautions for general safety and health<br />

aspects of people with the approval of competent authority.<br />

Construction spoils, including bituminous material and other hazardous<br />

material, must not be allowed to contaminate watercourses and the<br />

dump sites for such material must be secured, so that they should not<br />

leach into the ground water.<br />

The diesel generator sets to be used during construction phase should<br />

be of low sulphur diesel type and should conform to the provisions of<br />

<strong>Environment</strong> (Protection) Act, 1986 prescribed for air and noise<br />

emission standards.<br />

Vehicles hired for bringing construction material to the site and other<br />

machinery to be used during construction should be in good condition<br />

and should conform to applicable air and noise emission standards.<br />

Ambient noise levels should conform to prescribed standards both<br />

during day and night. Incremental pollution loads on the ambient air<br />

and noise quality should be closely monitored during construction<br />

phase.<br />

X. Fly ash should be used as construction material in the construction as<br />

per the provisions of Fly Ash Notification of September, 1999 and as<br />

amended on August, <strong>20</strong>03 (This condition is applicable only if the<br />

project is within 100 Km of Thermal Power Station).<br />

Ready mixed concrete should be used in building construction as far as<br />

possible.<br />

Water demand during construction should be reduced by use of<br />

premixed concrete, curing agents and other best practices.<br />

Separation of drinking water supply and treated sewage supply should<br />

be done by the use of different colours.<br />

Fixtures for showers, toilet flushing and drinking should be of low flow<br />

either by use of aerators or pressure reducing devices or sensor based<br />

control.<br />

Adequate steps shall be taken to conserve energy by limiting the use of<br />

glass, provision of proper thermal insulation and taking measures as<br />

prescribed under the Energy Conservation Building Code.<br />

The approval of competent authority shall be obtained for structural<br />

safety of the buildings due to earthquakes, adequacy of fire fighting<br />

equipments etc. as per National Building Code including protection<br />

measures from lightning.<br />

Provision shall be made for the housing of construction labour within the<br />

site with all necessary infrastructure and facilities such as fuel for<br />

cooking, mobile toilets, mobile STP, disposal of waste water & solid<br />

waste in an environmentally sound manner, safe drinking water, medical<br />

health care, crèche etc. The housing may be in the form of temporary<br />

structures to be removed after the completion of the project.<br />

II. Operation Phase<br />

i) The installation of sewage treatment plant (STP) and adequacy of disposal<br />

system should be certified by Punjab Pollution Control Board and a report in<br />

this regard should be submitted to the Ministry of <strong>Environment</strong> &<br />

Forests/<strong>State</strong> <strong>Level</strong> <strong>Environment</strong> <strong>Impact</strong> <strong>Assessment</strong> <strong>Authority</strong> before the<br />

project is commissioned for operation. The discharge of treated sewage<br />

shall conform to the norms and standards prescribed by Punjab Pollution<br />

Control Board for such discharges. The project proponent shall discharge<br />

not more than 312 KLD and 123 KLD, respectively, into sewer during<br />

monsoon and winter, as per letter No. 859 dated 16.5.<strong>20</strong>11 of GMADA.<br />

The project proponent shall provide electromagnetic flow meter at the<br />

outlet of the water supply, outlet of the STP and any pipeline to be used for<br />

re-using the treated wastewater back into the system for flushing / HVAC<br />

and for horticulture purpose etc. and shall maintain a record of readings of<br />

each such meter on daily basis.<br />

Adequate & appropriate pollution control measures should be provided to<br />

control fugitive emissions to be emitted within the commercial complex.<br />

Adequate treatment facility for drinking water shall be provided, if required.<br />

v) Rainwater harvesting for roof run-off should be implemented. Before<br />

recharging the roof run-off, pretreatment must be done to remove<br />

suspended matter, oil and grease. However, no run off from gardens/green<br />

area/roads/pavements shall be connected with the ground water recharging<br />

system.<br />

The solid waste generated should be properly collected and segregated.<br />

The recyclable solid waste shall be sold out to the authorized vendors and<br />

inerts shall be sent to disposal facility. The Bio-degradable solid waste shall<br />

be adequately treated as per the scheme submitted by the project<br />

proponent. Prior approval of competent authority should be obtained, if<br />

required.<br />

Hazardous waste/E-waste should be disposed off as per Rules applicable<br />

and with the necessary approval of the Punjab Pollution Control Board.<br />

The green belt design along the periphery of the plot shall achieve<br />

attenuation factor conforming to the day and night noise standards<br />

prescribed for residential land use. The open spaces inside the plot should<br />

be suitably landscaped and covered with vegetation of indigenous<br />

species/variety.<br />

The project proponent should take adequate and appropriate measures to<br />

contain the ambient air quality with in the prescribed standards. The<br />

proposal regarding mitigation measures to be taken at site should be<br />

submitted to the Ministry of <strong>Environment</strong> & Forests/ <strong>State</strong> <strong>Level</strong><br />

<strong>Environment</strong> <strong>Impact</strong> <strong>Assessment</strong> <strong>Authority</strong> within three months.<br />

x) Incremental pollution loads on the ambient air quality, noise and water<br />

quality should be periodically monitored after commissioning of the project.<br />

Application of solar energy should be incorporated for illumination of<br />

common areas, lighting for gardens and street lighting in addition to<br />

provision for solar water heating.<br />

Traffic congestion near the entry and exit points from the roads adjoining<br />

the proposed project site must be avoided. Parking should be fully<br />

internalized and no public space should be utilized.<br />

A report on the energy conservation measures conforming to energy<br />

conservation norms finalized by Bureau of Energy Efficiency should be<br />

prepared incorporating details about machinery of air conditioning, lifts,<br />

lighting, building materials, R & U Factors etc. and submitted to the<br />

respective Regional office of MoEF, the Zonal Office of CPCB and the<br />

SPCB/SEIAA in three months time.<br />

The project proponent shall comply with the undertaking submitted vide<br />

letter dated <strong>20</strong>.5.<strong>20</strong>11 to the effect that 80% of the rain water shall be first<br />

used to recharge the aquifer and the excess rain water will be stored and<br />

treated for further using within the project premises during non-monsoon<br />

period.<br />

<strong>Environment</strong> Management Cell shall be formed during operation phase<br />

which will supervise and monitor the environment related aspects of the<br />

project.<br />

PART B – General Conditions :<br />

i) The environmental safeguards contained in the application of the promoter<br />

/ mentioned during the presentation before <strong>State</strong> <strong>Level</strong> <strong>Environment</strong><br />

<strong>Impact</strong> <strong>Assessment</strong> <strong>Authority</strong>/<strong>State</strong> Expert Appraisal Committee should be<br />

implemented in letter and spirit.<br />

ii)<br />

The entire cost of the environmental management plan (i.e. capital cost as<br />

well as recurring cost) will continue to be borne by the project proponent<br />

until the responsibility of environmental management plan is transferred to<br />

the occupier/residents society under proper MOU.<br />

The project proponent shall also submit six monthly reports on the status of<br />

compliance of the stipulated EC conditions including results of monitored<br />

data (both in hard copies as well as by mail) to the respective Regional<br />

office of MoEF, the Zonal Office of CPCB and the SPCB/SEIAA.<br />

Officials from the Regional Office of Ministry of <strong>Environment</strong> & Forests,<br />

Chandigarh / <strong>State</strong> <strong>Level</strong> <strong>Environment</strong> <strong>Impact</strong> <strong>Assessment</strong> <strong>Authority</strong> / <strong>State</strong><br />

<strong>Level</strong> Expert Appraisal Committee / Punjab Pollution Control Board who<br />

would be monitoring the implementation of environmental safeguards<br />

should be given full cooperation, facilities and documents / data by the<br />

project proponents during their inspection. A complete set of all the<br />

documents submitted to <strong>State</strong> <strong>Environment</strong> <strong>Impact</strong> <strong>Assessment</strong> <strong>Authority</strong><br />

should be forwarded to the CCF, Regional Office of Ministry of <strong>Environment</strong><br />

& Forests, Chandigarh/<strong>State</strong> <strong>Level</strong> <strong>Environment</strong> <strong>Impact</strong> <strong>Assessment</strong><br />

<strong>Authority</strong>.<br />

v) In the case of any change(s) in the scope of the project, the project would<br />

require a fresh appraisal by <strong>State</strong> <strong>Environment</strong> <strong>Impact</strong> <strong>Assessment</strong><br />

<strong>Authority</strong>.<br />

Separate distribution pipelines be laid down for use of treated effluent / raw<br />

water for horticultural/gardening purposes with different colour coding.<br />

All other statutory clearances such as the approvals for storage of diesel<br />

from Chief Controller of Explosives, Fire Department, Civil Aviation<br />

Department, Forest (Conservation) Act, 1980 and Wildlife (Protection) Act,<br />

1972 etc. shall be obtained, by project proponents from the competent<br />

authorities including Punjab Pollution Control Board and from other<br />

statutory bodies as applicable.<br />

The project proponent should advertise in at least two local newspapers<br />

widely circulated in the region, one of which shall be in the vernacular<br />

language informing that the project has been accorded environmental<br />

clearance and copies of clearance letters are available with the Punjab<br />

Pollution Control Board. The advertisement should be made within seven<br />

days from the day of issue of the clearance letter and a copy of the same<br />

should be forwarded to the Regional Office, Ministry of <strong>Environment</strong> &<br />

Forests, Chandigarh.<br />

These stipulations would be enforced among others under the provisions of<br />

Water (Prevention & Control of Pollution) Act, 1974, Air (Prevention &<br />

Control of Pollution) Act, 1981, <strong>Environment</strong>al (Protection) Act, 1986, the<br />

Public Liability (Insurance) Act, 1991 and EIA Notification, <strong>20</strong>06.<br />

x) <strong>Environment</strong>al clearance is subject to final order of the Hon'ble Supreme<br />

Court of India in the matter of Goa Foundation Vs. Union of India in Writ<br />

Petition (Civil) No. 460 of <strong>20</strong>04 as may be applicable to this project and<br />

decisions of any competent court, to the extent applicable.<br />

A copy of the clearance letter shall be sent by the proponent to concerned<br />

Panchayat, Zilla Parishad/ Municipal Corporation, Urban local body and the<br />

local NGO, if any, from whom suggestions / representations, if any, were<br />

received while processing the proposal. The clearance letter shall also be<br />

put on the website of the Company by the proponent.<br />

The proponent shall upload the status of compliance of the stipulated EC<br />

conditions, including results of monitored data on their website and shall<br />

update the same periodically. It shall simultaneously be sent to the<br />

Regional Office of MoEF, the respective Zonal Office of CPCB and the SPCB.<br />

The criteria pollutant levels namely; PM 2.5 , PM 10 , SO 2 , NO x , CO, Pb, Ozone<br />

(ambient air) shall be monitored and displayed at a convenient location<br />

near the main gate of the company in the public domain.<br />

The project proponent shall comply with the conditions imposed by the<br />

Housing & Urban Development in the permission for change of land use<br />

(CLU) granted vide No. 18/50/<strong>20</strong>03-1Hg-II/11256 dated 11.12.<strong>20</strong>03.<br />

The <strong>State</strong> <strong>Environment</strong> <strong>Impact</strong> <strong>Assessment</strong> <strong>Authority</strong> reserves the right to<br />

add additional safeguards/ measures subsequently, if found necessary, and<br />

to take action including revoking of the environmental clearance under the<br />

provisions of the <strong>Environment</strong>al (Protection) Act, 1986, to ensure effective<br />

implementation of the suggested safeguards/ measures in a time bound<br />

and satisfactory manner.<br />

Any appeal against this environmental clearance shall lie with the National<br />

<strong>Environment</strong> Appellate <strong>Authority</strong>, if preferred, within a period of 30 days as<br />

prescribed under section 11 of the National <strong>Environment</strong> Appellate Act,<br />

1987.<br />

This environmental clearance will be valid for a period of five years from<br />

the date of its issue or till the completion of the project, whichever is<br />

earlier.<br />

Item No. SEIAA/31.04 Application for obtaining environmental<br />

clearance for “Paramount Mall & Multiplex” to<br />

be developed by M/s Paramount Buildtech Pvt.<br />

Ltd., at Landran Road, Mohali<br />

The SEIAA observed that:<br />

1. The project proponent has applied for obtaining environmental clearance as<br />

required under EIA Notification for developing “Paramount Mall & Multiplex”<br />

in the revenue estate of Landran Road, Mohali. The project of promoter is<br />

covered under category 8 (a) of the Schedule appended to EIA notification<br />

dated 14/9/<strong>20</strong>06.<br />

2. The case was considered in the 10 th meeting of SEAC held on 09.08.<strong>20</strong>08<br />

and the project proponent was requested to attend the said meeting, but<br />

no representative of the promoter attended the meeting despite the fact<br />

that the project proponent was requested vide letter no.29589 dated<br />

1.8.<strong>20</strong>08 to attend the said meeting. Thus, the SEAC decided to defer the<br />

case. Accordingly, the project proponent was requested vide letter no.<br />

37137 dated 7/10/<strong>20</strong>08 to clarify whether the project proponent want to<br />

pursue the case or not, but the project proponent had failed to respond in<br />

this regard.<br />

3. The case was again considered by the SEAC in its 22 nd meeting held on<br />

9.5.<strong>20</strong>09, wherein, it was decided to give another opportunity to the<br />

project proponent to clarify, within 15 days, as to whether he wants to<br />

pursue the case or not. The said decision of the SEAC was conveyed to the<br />

project proponent vide letter no. 18832 dated 25.5.<strong>20</strong>09, which was<br />

received undelivered form the Postal Authorities.<br />

4. The case was lastly considered by the SEAC in its 41st meeting held on<br />

3.7.<strong>20</strong>10. But no representative of the promoter attended the meeting<br />

despite the fact that the project proponent was requested vide letter no.<br />

28863 dated 23.06.<strong>20</strong>11 to attend the said meeting. Accordingly, the<br />

Committee decided to recommend the case to SEIAA for refusal of<br />

environmental clearance due to the following reasons:<br />

i) The project proponent has not given power point presentation of the<br />

proposed project for its transparent appraisal despite for the same.<br />

ii)<br />

The project proponent has not responded to any letters issued by the<br />

authority.<br />

iii) The project proponent has not submitted any report despite 4<br />

reminders, regarding deliver of the letters received un-deliver from the<br />

postal authorities.<br />

5. The case was considered by the SEIAA in the 29 th meeting of SEIAA held<br />

on 23.3.<strong>20</strong>11, wherein, it was decided to afford a final opportunity to the<br />

project proponent to the effect as to whether he wants to pursue the<br />

application submitted for obtaining environmental clearance or not, within<br />

15 days and it was also decided that in case, no response is received from<br />

the project proponent within the said period, the application filed by project<br />

proponent for environmental clearance will be decided on merits and<br />

material evidences available in the record file. The said decision of the<br />

SEIAA was conveyed to the project proponent vide letter No.<br />

SEIAA/MS/<strong>20</strong>11/16441 dated 7.4.<strong>20</strong>11. A reminder was also issued by the<br />

SEIAA vide letter No. SEIAA/MS/<strong>20</strong>11/17080 dated 19.4.<strong>20</strong>11, but no<br />

response was received from the project proponent.<br />

The SEIAA further observed that the project proponent was<br />

requested vide letter no. 1769 dated 17.<strong>05</strong>.<strong>20</strong>11 to attend the 31 st meeting of<br />

SEIAA on <strong>20</strong>.<strong>05</strong>.<strong>20</strong>11 to submit the reply of observations conveyed by the<br />

<strong>Authority</strong> vide letter no. 16441 dated 07.04.<strong>20</strong>11 on or before <strong>20</strong>.<strong>05</strong>.<strong>20</strong>11, but no<br />

authorized representative of the project proponent attended the said meeting. The<br />

<strong>Authority</strong> further noted that ample opportunity has already been afforded by the<br />

SEAC as well as SEIAA to the project proponent to present the project proposal,<br />

but the project proponent has failed to respond to the communication made by<br />

the SEAC/SEIAA from time to time. The SEIAA, therefore, decided to refuse the<br />

application filed by the project proponent and to convey the said refusal orders to<br />

him.<br />

Item No. SEIAA/31.<strong>05</strong> Application for obtaining environmental<br />

clearance for “DLF Premium Homes” a<br />

Residential Group Housing Project to be<br />

developed by M/s DLF Premium Homes Pvt. Ltd.<br />

at Vill. Khajurla, Distt. Kapurthala.<br />

The SEIAA observed that:<br />

1. M/s DLF Premium Homes Pvt. Ltd. has applied for obtaining environmental<br />

clearance as required under EIA Notification dated 14.9.<strong>20</strong>06 for developing<br />

a Residential Group Housing Project namely “DLF Premium Homes” in an<br />

area of 72,600 sq. m in the revenue estate of<br />

Kapurthala.<br />

Vill. Khajurla, Distt.<br />

2. The built up area is 1,22,290.15 sq. m for residential purpose and 58<strong>20</strong>0<br />

sq. m for basement. Thus, the total built up area is 1,80,490.15 sq. m, as<br />

such, project of promoter is covered under category 8 (b) of the Schedule<br />

appended to the said notification.<br />

3. The case of the project proponent was considered in 17 th meeting of <strong>State</strong><br />

Expert Appraisal Committee held on 17.1.<strong>20</strong>09, which was attended by the<br />

authorized representative of the project proponent and environmental<br />

consultant of the promoter company. After detailed deliberations in the<br />

matter, the SEAC observed that the project proponent is required to submit<br />

the reply of following observations before taking further necessary action in<br />

the matter and it was decided to defer the case till the reply of these<br />

observations is received.<br />

i. The project proponent shall submit approval regarding change of<br />

land use for the project site, from the Competent <strong>Authority</strong>.<br />

ii.<br />

The project proponent shall submit copy of approved layout plan<br />

from the Competent <strong>Authority</strong>.<br />

iii. The project proponent will submit details of land where the 126<br />

m 3 /day of treated sewage will be used for horticulture purposes, 150<br />

m 3 /day of treated sewage will be used onto land for irrigation and<br />

the location of this land viz-a-viz the project site should be marked<br />

on the layout plan of the project.<br />

4. The decision of the Committee was conveyed to the project proponent vide<br />

letter no. 5480 dated 13.2.<strong>20</strong>09 but no response was received from the<br />

project proponent. Thereafter, a reminder was also issued vide letter no.<br />

33969 dated 14.10.<strong>20</strong>09. The project proponent in response to said letter<br />

has informed the SEAC that due to global economic melt down, the demand<br />

of real estate has got severely restricted and under the circumstances, the<br />

development of the project has been delayed. Further, the project<br />

proponent requested the SEAC to give three months time to take decision<br />

on the development of the project. After considering the request, the<br />

project proponent was given three months time vide letter no. 3396 dated<br />

28.1.<strong>20</strong>10 by the SEAC for taking decision on the development of the<br />

project.<br />

5. The case was again considered by the SEAC in its 40 th meeting held on<br />

29.5.<strong>20</strong>10, wherein, it was decided that the project proponent be asked to<br />

submit the details as already requested and the case be placed in the next<br />

meeting of SEAC for appraisal.<br />

6. The project proponent was requested vide letter No. 28856 dated<br />

25.6.<strong>20</strong>10 to attend the 41 st meeting of SEAC to be held on 3.7.<strong>20</strong>10. The<br />

case was considered by the SEAC in its 41 st meeting held on 3.7.<strong>20</strong>10 and<br />

the representative of the project proponent attended the said meeting and<br />

informed that they have applied for the CLU with CTP, Punjab. The<br />

promoter has furnished an undertaking that he is fully responsible for the<br />

information / documents submitted by the consultant and from now<br />

onwards, he shall be pursuing / presenting the case before the SEIAA/SEAC<br />

till an accredited consultant is appointed by the promoter company. Looking<br />

at the history, the Committee has recommended the case to SEIAA for<br />

refusal of environmental clearance due to the following reasons:<br />

i) The project proponent has not submitted the requisite<br />

documents/data despite of several reminders. Also, the<br />

representative of the promoter was unable to provide the<br />

information regarding submission of the requisite data.<br />

ii) The project proponent has not replied even after the expiry of 3<br />

months time.<br />

7. The case was considered by the SEIAA in the 29 th meeting of SEIAA held<br />

on 23.3.<strong>20</strong>11, wherein, it was decided to afford a final opportunity to the<br />

project proponent to the effect as to whether he wants to pursue the<br />

application submitted for obtaining environmental clearance or not, within<br />

15 days and it was also decided that in case, no response is received from<br />

the project proponent within the said period, the application filed by project<br />

proponent for environmental clearance will be decided on merits and<br />

material evidences available in the record file. The said decision of the<br />

SEIAA was conveyed to the project<br />

proponent vide letter No.<br />

SEIAA/MS/<strong>20</strong>11/16442 dated 7.4.<strong>20</strong>11. A reminder was also issued by the<br />

SEIAA vide letter No. SEIAA/MS/<strong>20</strong>11/17081 dated 18.4.<strong>20</strong>11, but no<br />

response was received from the project proponent.<br />

The SEIAA further observed that the project proponent was<br />

requested vide letter no. 1770 dated 17.<strong>05</strong>.<strong>20</strong>11 to attend the 31 st meeting of<br />

SEIAA on <strong>20</strong>.<strong>05</strong>.<strong>20</strong>11 to submit the reply of observations conveyed by the<br />

<strong>Authority</strong> vide letter no. 16441 dated 07.04.<strong>20</strong>11 on or before <strong>20</strong>.<strong>05</strong>.<strong>20</strong>11, but no<br />

authorized representative of the project proponent attended the said meeting. The<br />

<strong>Authority</strong> further noted that ample opportunity has already been afforded by the<br />

SEAC as well as SEIAA to the project proponent to present the project proposal,<br />

but the project proponent has failed to respond to the communication made by<br />

the SEAC/SEIAA from time to time. The SEIAA, therefore, decided to refuse the<br />

application filed by the project proponent and to convey the said refusal orders to<br />

him.<br />

Item No. SEIAA/31.06 Application for obtaining environmental<br />

clearance for Residential Housing Project<br />

namely “Parsvnath Greens” to be developed at<br />

Vill. Sadhe Majra, Tehsil Dera Bassi, Distt. Mohali<br />

by M/s Parsvnath Developers Ltd.<br />

The <strong>Authority</strong> observed that:<br />

1. M/s Parsvnath Developers Ltd. has applied for obtaining environmental<br />

clearance as required under EIA Notification dated 14.9.<strong>20</strong>06 to develop a<br />

residential housing project namely "Parsvnath Greens" in the revenue<br />

estate of Village Sadhe Majra, Tehsil Dera Bassi, Distt. Mohali in an area<br />

49.68 acres having 467 residential plots, 51 commercial plots and two<br />

group housing complexes having 283 dwelling units. The project is<br />

covered under category 8 (a) of the Schedule appended to the said<br />

notification.<br />

2. The case was considered in the 29 th meeting of SEIAA held on 27.03.<strong>20</strong>11,<br />

wherein, it was decided:<br />

A) To convey the following observations to the project proponent for<br />

compliance of the same within 10 days:-<br />

i) The project proponent shall obtain specific approval from the<br />

Competent <strong>Authority</strong> clearly stating as to how much quantity<br />

of wastewater will be allowed to be discharged into the<br />

sewer.<br />

ii)<br />

iii)<br />

The project proponent shall submit a concrete proposal for<br />

discharge of treated wastewater for horticulture purpose.<br />

The project proponent shall submit water balance chart<br />

prepared for all the three seasons i.e. summer, winter and<br />

rainy season indicating critical requirement.<br />

B) To call the project proponent to make a presentation on his project<br />

proposal through the accredited consultant of the MoEF in the next<br />

meeting of SEIAA.<br />

3. The case was again considered in the 30 th meeting of SEIAA held on<br />

27.04.<strong>20</strong>11 and Sh. Suman Banerjee presented the reply of the<br />

observations of the 29 th meeting of SEIAA, but the <strong>Authority</strong> was not<br />

satisfied with the reply given by the project him. After detailed deliberations<br />

in the matter, the <strong>Authority</strong> observed that the project proponent is required<br />

to submit the following documents/data before taking decision in the<br />

matter.<br />

i) Specific approval granted by M.C. Dera Bassi stating as to how<br />

much quantity of wastewater will be allowed to be discharged to<br />

the project proponent into the sewer.<br />

ii)<br />

Properly prepared site plan showing the industries within a radius<br />

of 500 m from the periphery of project site and air polluting<br />

industries within a radius of 100 m from the periphery of project<br />

site.<br />

Approved layout plan showing a provision of 15m wide green belt<br />

of broad leaved trees towards the site, where the air polluting<br />

industries are located within a radius of 100 m from the periphery<br />

of the project site.<br />

A certificate issued by the Department of Town & Country<br />

Planning, Punjab showing the classification of area as per the<br />

Master Plan.<br />

Sh. Rajesh Ravi, Manager of the promoter company, who was<br />

also present in the meeting, requested for 10 days time to submit the reply<br />

to the aforesaid observations of the <strong>Authority</strong>. The <strong>Authority</strong> agreed to<br />

accept the request of the project proponent and decided to defer the case<br />

till the proper reply of all the observations is received.<br />

3. Thereafter, the project proponent vide letter No. PDL/Strategic<br />

Planning/EIA/2272 dated 12.5.<strong>20</strong>11 has submitted the reply of the<br />

observations raised by the SEIAA in its 30 th meeting held on 27.4.<strong>20</strong>11.<br />

The project proponent was requested vide letter No. 1771 dated 17.5.<strong>20</strong>11<br />

to attend the 31 st<br />

observations.<br />

raised by the SEIAA in its 30 th meeting.<br />

1. Sh. Anand Kumar Dubey, <strong>Environment</strong>al Consultant, <strong>Environment</strong>al<br />

Consultant, M/s Ind Tech House Consults<br />

2. Sh. Rajesh Ravi, Manager, M/s Parsvnath Developers Ltd.<br />

Sh. Anand Kumar Dubey, who is the <strong>Environment</strong>al Consultant of the<br />

project proponent and the name of his consultancy firm figures at Sr. No. 216 of<br />

the list uploaded by the MoEF at its official website, presented the reply of the<br />

observations as under:<br />

i) The M.C. Dera Bassi has allowed to discharge 1000 KLD of treated<br />

wastewater into sewer, which is being laid down by the Council against the<br />

actual discharge of 301.8 KLD of wastewater during rainy season.<br />

ii)<br />

There are only two air polluting industries namely M/s Spray Engineering<br />

Sugars Ltd., and M/s Essics Bio-sciences Ltd., are located within a radius of<br />

100 m from the periphery of the project site. A provision has been made to<br />

provide 15 m width green belt alongwith the periphery of the project site<br />

towards the side of said industries.<br />

iii)<br />

The area in which the site of the project is located reserved for General<br />

Industry as per the Master Plan of Dera Bassi and permission for CLU has<br />

been obtained from the Department of Town & Country Planning, Punjab<br />

vide memo No. CTP/SP-432/466 dated 28.01.<strong>20</strong><strong>05</strong>. The area around the<br />

site of the project is also meant for General Industry.<br />

The <strong>Authority</strong> noted that the project proponent could not give the<br />

satisfactory reply in respect of following points:<br />

a) At how much distance from the boundary of the project site, the boundary<br />

wall of M/s Punjab Crops & Chemicals Ltd., Dera Bassi is located.<br />

b) The site of the project is located in the area reserved for General Industry<br />

as per the Master Plan of Dera Bassi and the surrounding area of the<br />

project is also meant for General Industry as per the said Master Plan.<br />

Therefore, the project proponent is required to provide a green belt of 15m<br />

width of broad leaved trees all along the boundary of the project site and<br />

the layout plan of the project proposal is required to be approved from the<br />

Competent <strong>Authority</strong> showing a provision of green belt all along the<br />

periphery of the project site.<br />

c) The permission for CLU was granted in the year <strong>20</strong><strong>05</strong> and the Master Plan<br />

of Dera Bassi was notified in the year <strong>20</strong>10, as such, as to whether the said<br />

permission for CLU is still valid or not?<br />

After detailed deliberations in the matter, the SEIAA observed that<br />

the project proponent is required to submit following information / data before<br />

taking decision in the matter:<br />

1. A letter issued by the Competent <strong>Authority</strong> to the effect as to whether the<br />

permission for CLU granted to the project proponent vide Memo No.<br />

CTP/SP-432/466 dated 28.01.<strong>20</strong><strong>05</strong> is still valid or not in light of the fact<br />

that as per Master Plan of Dera Bassi notified in the year <strong>20</strong>10, the site of<br />

the project is located in the area reserved for General Industry.<br />

2. Submit a layout plan duly approved by the Competent <strong>Authority</strong> showing a<br />

buffer of green belt of 15m width of broad leaved trees all along the<br />

boundary of the project site since the site of the project is surrounded by<br />

the area meant for General Industry.<br />

Sh. Rajesh Ravi, Manager requested for 2 months time to submit the<br />

reply to the aforesaid observations of the <strong>Authority</strong>.<br />

The <strong>Authority</strong> agreed to accept the request of the project proponent<br />

and decided to defer the case till the proper reply of all the observations is<br />

received.<br />

Item No. SEIAA/31.07 Application for obtaining environmental<br />

clearance for residential colony namely "Super<br />

Mega Mixed Use Integrated Industrial Park<br />

Project –Phase-I" to be established in the<br />

revenue estate of Village Nagla, Tehsil Zirakpur,<br />

Distt. Mohali by M/s Shipra Estates Limited.<br />

Sh. Sanjeet Singh, DGM of the promoter company<br />

attended the meeting of SEIAA and he presented the case as under:<br />

1. M/s Shipra Estates Limited has applied for obtaining environmental<br />

clearance as required under EIA Notification dated 14.9.<strong>20</strong>06 for developing<br />

a residential colony namely "Super Mega Mixed Use Integrated Industrial<br />

Park Project –Phase-I" in the revenue estate of Village Nagla, Tehsil<br />

Zirakpur, Distt. Mohali. The project is covered under category 8 (b) of the<br />

Schedule appended to the said notification.<br />

2. The total area for the proposed project is 445633.616 sq.m (44.5 hectare)<br />

and the built-up area is 5,68,150.02 sq m. The layout plan has been<br />

approved by the Department Town & Country Planning, Punjab vide letter<br />

no. 6246 CTP (Pb)/SMP (M)-2 dated 12.8.<strong>20</strong>10.<br />

3. The total area of the project of Phase-I is 44.5 hectares, which will to be<br />

divided into IT / ITES Industry (40.33%), Residential (28.42%),<br />

Commercial (1.37%), Utilities (0.22%), Park (6.32%) and Roads (22.91%).<br />

No industry of category A & B falling in the Schedule appended to the EIA<br />

Notification dated 14/9/<strong>20</strong>06 will be housed in the industrial component of<br />

the project.<br />

4. Initially, during five years, the total water requirement will be about 1700<br />

KLD, out of which 909 KLD will be met from ground water by way of<br />

installing tubewells and remaining will be met from the treated wastewater.<br />

Permission has been obtained from the Govt. of India, Central Ground<br />

Water <strong>Authority</strong> vide letter dated 9.2.<strong>20</strong>11 for abstraction of 909 KLD of<br />

ground water. However, after five years i.e after fully development of the<br />

Integrated Industrial Park, the requirement of ground water will be about<br />

<strong>20</strong>13KLD and permission for abstraction of additional quantity of ground<br />

water i.e 1104 KLD is yet to be obtained from CGWA.<br />

5. Initially, during five years, about 833 KLD of domestic wastewater will be<br />

generated from the proposed project and a STP of capacity 1000 KLD<br />

based on Moving Media Reactor technology will be installed to treat the<br />

said wastewater. However, after five years i.e. after fully development of<br />

the Integrated Industrial Park, about 2492 KLD of wastewater will be<br />

generated and at that time the capacity of STP will be enhanced to 3000<br />

KLD.<br />

6. The total raw water requirement for drinking purpose for the complex will<br />

be 259 KLD, which will be treated in RO. After treatment in RO, about <strong>20</strong>7<br />

KLD and 52 KLD of permeate and RO reject water, respectively, will be<br />

generated. The reject water will have conc. of TDS to the tune of 3436<br />

mg/l conc. , which will be mixed with treated sewage of quantity 2492 KLD<br />

having about 1300-1400 mg/l conc. of TDS. Therefore, after mixing reject<br />

water of RO and treated sewage , the conc. of TDS in the treated<br />

wastewater will become 1441 mg/l.<br />

7. During first five years, the treated wastewater will be used for D.G. set<br />

cooling, flushing and horticulture purposes by providing proper distribution<br />

network. No wastewater shall be discharged into drain/Ghaggar river,<br />

excess treated wastewater shall be discharged to artificial water ponds and<br />

irrigation of roadside plantation. The sewer connection will be made<br />

available by Municipal Council, Zirakpur in next 2-3 years. Therefore, after 5<br />

years, the excess treated water shall be discharged into public sewer.<br />

8. Rain water from the roof-top surface and paved areas will be sent to rain<br />

water harvesting pits and surface run-off from green areas shall be sent to<br />

artificial water pond to be constructed at site.<br />

9. Garland drain will be provided at the project site to channelise the run-off<br />

from adjoining areas.<br />

10. Total 48<strong>20</strong> Kg/day of solid waste will be generated, which will be<br />

segregated at source into bio-degradable and non-biodegradable waste by<br />

providing adequate number of collection bins as per the Municipal Solid<br />

Waste(Management and Handling) Rules, <strong>20</strong>00. The bio-degradable solid<br />

waste shall be converted into manure by way of vermi-composting<br />

<strong>20</strong>


technique. The area earmarked for management and handling of solid<br />

waste is 1447 sq. m and this area has been marked on the layout plan.<br />

11. The hazardous waste such as used oil from D.G. sets will be handled and<br />

disposed off as per the provisions of the Hazardous Wastes (Management,<br />

12. The E-waste to be generated from the industries will be given to the<br />

approved E-waste recyclers.<br />

The SEIAA further observed that:<br />

a. The case was considered by the SEAC in its 45 th meeting held on 8.4.<strong>20</strong>11<br />

and Sh. Parveen Bhargav, Director M/s Perfect Enviro Solution, New Delhi,<br />

who is the environmental consultant of the promoter company, presented<br />

the case before the SEAC. After discussions, certain observations were<br />

raised by the SEAC, which were conveyed to the project proponent vide<br />

letter no. 17113 dated 19.4.<strong>20</strong>11 for making compliance of the same.<br />

b. The project proponent vide letter dated 18.04.<strong>20</strong>11 has submitted the reply<br />

of the observations raised by the SEAC.<br />

c. The case was again considered by the SEAC in 46 th meeting of held on<br />

24.4.<strong>20</strong>11 and Sh. Sanjeet Singh, DGM of the promoter company attended<br />

the said meeting and he presented pointwise reply of the observations of<br />

the SEAC.<br />

d. The SEAC in its 46 th meeting of held on 24.4.<strong>20</strong>11 noted that the project<br />

proponent has provided adequate and satisfactory clarifications of the<br />

observations raised by it, therefore, the Committee awarded 'Silver Grading'<br />

to the project proposal and decided to forward the case to the SEIAA, with<br />

the recommendation to grant environmental clearance to the project<br />

proponent subject to the following conditions, in addition to the proposed<br />

measures for establishment of "Super Mega Mixed Use Integrated Industrial<br />

Park Project- Phase -I" an area of 445633.616 sq.m in the revenue estate<br />

of Village Nagla, Tehsil Zirakpur, Distt. Mohali.<br />

PART A – Specific conditions<br />

I. Construction Phase<br />

I. “Consent to establish” shall be obtained from Punjab Pollution Control<br />

Board under Air (Prevention & Control of Pollution) Act, 1981 and Water<br />

(Prevention & Control of Pollution) Act, 1974 and a copy of the same<br />

shall be submitted to the Ministry of <strong>Environment</strong> & Forests / <strong>State</strong><br />

A first aid room will be provided in the project both during construction<br />

and operation phase of the project.<br />

Adequate drinking water and sanitary facilities should be provided for<br />

construction workers at the site. The disposal of wastewater and solid<br />

wastes generated during the construction phase should be in<br />

environmentally sound manner.<br />

V. Provision should be made for the supply of fuel (kerosene or cooking<br />

gas), utensils such as pressure cookers etc. to the laborers during<br />

construction phase.<br />

All the labourers to be engaged for construction should be screened for<br />

health and adequately treated, if required, before engaging them to<br />

work at the site.<br />

Disinfection of wastewater shall be done with UV unit.<br />

for use in horticulture / landscape development within the project site.<br />

Disposal of muck during construction phase should not create any<br />

adverse effect on the neighboring communities and be disposed off<br />

after taking the necessary precautions for general safety and health<br />

aspects of people with the approval of competent authority.<br />

X. Construction spoils, including bituminous material and other hazardous<br />

material, must not be allowed to contaminate watercourses and the<br />

dump sites for such material must be secured, so that they should not<br />

leach into the ground water.<br />

The diesel generator sets to be used during construction phase should<br />

be of low sulphur diesel type and should conform to the provisions of<br />

<strong>Environment</strong> (Protection) Act, 1986 prescribed for air and noise<br />

emission standards.<br />

Vehicles hired for bringing construction material to the site should be in<br />

good condition and should conform to applicable air and noise emission<br />

standards and should be operated only during non peak hours.<br />

Ambient noise levels should conform to prescribed standards both<br />

during day and night. Incremental pollution loads on the ambient air<br />

and noise quality should be closely monitored during construction<br />

phase.<br />

Fly ash should be used as construction material in the construction as<br />

per the provisions of Fly Ash Notification of September, 1999 and as<br />

amended on August, <strong>20</strong>03 (The above condition is applicable only if the<br />

project is within 100 Km of Thermal Power Station).<br />

Ready mixed concrete must be used in building construction.<br />

The project proponent shall construct a pucca garland drain of adequate<br />

size around the periphery of the project site to drain the storm water of<br />

the nearby areas. No internal drain of the project site shall be connected<br />

with the said garland drain.<br />

Water demand during construction should be reduced by use of<br />

premixed concrete, curing agents and other best practices referred.<br />

Separation of drinking water supply and treated sewage supply should<br />

be done by the use of dual plumbing line of different colours for<br />

separation of drinking water and treated sewage.<br />

Fixtures for showers, toilet flushing and drinking should be of low flow<br />

either by use of aerators or pressure reducing devices or sensor based<br />

control.<br />

Use of glass may be reduced up to 40% to reduce the electricity<br />

consumption and load on air-conditioning. If necessary, use high quality<br />

double glass with special reflective coating in windows.<br />

Roof should meet prescriptive requirement as per Energy Conservation<br />

Building Code by using appropriate thermal insulation material to fulfill<br />

requirement.<br />

Opaque wall should meet prescriptive requirement as per Energy<br />

Conservation Building Code which is proposed to be mandatory for all<br />

air conditioned spaces while it is aspirational for non air-conditioned<br />

spaces by use of appropriate thermal insulation material to fulfill<br />

requirement.<br />

The approval of competent authority shall be obtained for structural<br />

safety of the buildings due to earthquakes, adequacy of fire fighting<br />

equipments etc. as per National Building Code including protection<br />

measures from lightening.<br />

Provisions shall be made for the housing of construction labour within<br />

the site with all necessary infrastructure and facilities such as fuel for<br />

cooking, mobile toilets, mobile STP, Safe drinking water, medical health<br />

care, crèche etc. The housing may be in the form to temporary<br />

structure to be removed after the completion of the project.<br />

Piezometeric wells shall be established on all the four directions of the<br />

project site to monitor the impact on the groundwater quality due to<br />

discharge of effluents from the project site and shall maintain proper<br />

record of monitoring of underground water quality data.<br />

The STP shall be installed only at ground level by adjusting the same in<br />

the vacant land as shown in the approved layout plan.<br />

The site for the vermi-composting process shall be shifted near to the<br />

proposed site of the first aid room since the present site earmarked on<br />

the approved layout plan for the said purpose is not in order as the<br />

same is located adjoining to Sukhna Choe and there is likelihood of<br />

generation of leachate from the vermi-composting process during rainy<br />

season, which may contaminate the quality of water of the Sukhna<br />

choe.<br />

II. Operation Phase<br />

I. The installation of sewage treatment plant (STP) and adequacy of<br />

disposal system should be certified by Punjab Pollution Control Board<br />

and a report in this regard should be submitted to the Ministry of<br />

<strong>Environment</strong> & Forests/<strong>State</strong> <strong>Level</strong> <strong>Environment</strong> <strong>Impact</strong> <strong>Assessment</strong><br />

<strong>Authority</strong> before the project is commissioned for operation. The<br />

discharge of treated sewage shall conform to the norms and standards<br />

prescribed by Punjab Pollution Control Board for such discharges. There<br />

shall be no discharge of treated wastewater outside the premises of the<br />

project/complex.<br />

Adequate & appropriate pollution control measures should be provided<br />

to control fugitive emissions to be emitted within the commercial<br />

complex and IT/ITES industry.<br />

III. Adequate treatment facility for drinking water shall be provided, if<br />

required.<br />

IV. Rainwater harvesting for roof run-off should be implemented. Before<br />

recharging the roof run-off, pretreatment must be done to remove<br />

suspended matter, oil and grease. However, no run off from<br />

gardens/green area be connected with the ground water recharging<br />

system.<br />

V. The solid waste generated should be properly collected and segregated.<br />

The recyclable solid waste shall be sold out to the authorized vendors<br />

and inerts shall be sent to disposal facility. The Bio-degradable solid<br />

waste shall be treated on-site composting facility. Prior approval of<br />

competent authority should be obtained, if required.<br />

VI. Hazardous waste/E-waste should be disposed off as per Rules applicable<br />

and with the necessary approvals of the Punjab Pollution Control Board.<br />

VII. The green belt design along the periphery of the plot shall achieve<br />

attenuation factor conforming to the day and night noise standards<br />

prescribed for residential land use. The open spaces inside the plot<br />

should be suitably landscaped and covered with vegetation of<br />

indigenous variety.<br />

VIII. Separate distribution pipelines be laid down for use of treated effluent<br />

for horticultural/gardening purpose with different colour coding.<br />

IX. The project proponent should take adequate and appropriate measures<br />

to contain the ambient air quality with in the prescribed standards. The<br />

proposal regarding mitigation measures to be taken at site should be<br />

submitted to the Ministry of <strong>Environment</strong> & Forests/ <strong>State</strong> <strong>Level</strong><br />

<strong>Environment</strong> <strong>Impact</strong> <strong>Assessment</strong> <strong>Authority</strong> within 3 months.<br />

X. Incremental pollution loads on the ambient air quality, noise and water<br />

quality should be periodically monitored after commissioning of the<br />

project.<br />

Application of solar energy should be incorporated for illumination of<br />

common areas, lighting for gardens and street lighting in addition to<br />

provision for solar water heating.<br />

Traffic congestion near the entry and exit points from the roads<br />

adjoining the proposed project site must be avoided. Parking should be<br />

fully internalized and no public space should be utilized.<br />

A report on the energy conservation measures conforming to energy<br />

conservation norms finalized by Bureau of Energy Efficiency should be<br />

prepared incorporating details about machinery of air conditioning, lifts,<br />

lighting, building materials, R & U Factors etc. and submitted to the<br />

Ministry of <strong>Environment</strong> & Forests/SEAC in three months time.<br />

<strong>Environment</strong> Management Cell shall be formed during operation phase<br />

which will supervise and monitor the environment related aspects of the<br />

project.<br />

PART B – General Conditions :<br />

I. This environmental clearance will be valid for a period of five years from<br />

the date of its issue or till the completion of the project, whichever is<br />

earlier.<br />

II. The environmental safeguards contained in the application of the<br />

promoter / mentioned during the presentation before <strong>State</strong> <strong>Level</strong><br />

<strong>Environment</strong> <strong>Impact</strong> <strong>Assessment</strong> <strong>Authority</strong>/<strong>State</strong> Expert Appraisal<br />

Committee should be implemented in letter and spirit.<br />

The entire cost of the environmental management plan (i.e. capital cost<br />

as well as recurring cost) will continue to be borne by the project<br />

proponent until the responsibility of environmental management plan is<br />

transferred to the occupier/residents society under proper MOU.<br />

The project proponent shall also submit six monthly reports on the<br />

status of compliance of the stipulated EC conditions including results of<br />

monitored data (both in hard copies as well as bye-mail) to the<br />

respective Regional office of MoEF, the respective Zonal Office of CPCB<br />

and the SPCB/SEIAA.<br />

V. Officials from the Regional Office of Ministry of <strong>Environment</strong> & Forests,<br />

Chandigarh / <strong>State</strong> <strong>Level</strong> <strong>Environment</strong> <strong>Impact</strong> <strong>Assessment</strong> <strong>Authority</strong> /<br />

<strong>State</strong> <strong>Level</strong> Expert Appraisal Committee / Punjab Pollution Control Board<br />

who would be monitoring the implementation of environmental<br />

safeguards should be given full cooperation, facilities and documents /<br />

data by the project proponents during their inspection. A complete set<br />

of all the documents submitted to <strong>State</strong> <strong>Environment</strong> <strong>Impact</strong><br />

<strong>Assessment</strong> <strong>Authority</strong> should be forwarded to the CCF, Regional Office<br />

of Ministry of <strong>Environment</strong> & Forests, Chandigarh/<strong>State</strong> <strong>Level</strong><br />

<strong>Environment</strong> <strong>Impact</strong> <strong>Assessment</strong> <strong>Authority</strong>.<br />

In the case of any change(s) in the scope of the project, the project<br />

would require a fresh appraisal by <strong>State</strong> <strong>Environment</strong> <strong>Impact</strong><br />

<strong>Assessment</strong> <strong>Authority</strong>.<br />

The <strong>State</strong> <strong>Environment</strong> <strong>Impact</strong> <strong>Assessment</strong> <strong>Authority</strong> reserves the right<br />

to add additional safeguard/ measures subsequently, if found necessary,<br />

and to take action including revoking of the environmental clearance<br />

under the provisions of the <strong>Environment</strong>al (Protection) Act, 1986, to<br />

ensure effective implementation of the suggested safeguard/ measures<br />

in a time bound and satisfactory manner.<br />

All other statutory clearances such as the approvals for storage of diesel<br />

from Chief Controller of Explosives, Fire Department, Civil Aviation<br />

Department, Forest (Conservation) Act, 1980 and Wildlife (Protection)<br />

Act, 1972 etc. shall be obtained, by project proponents from the<br />

competent authorities including Punjab Pollution Control Board and from<br />

other statutory bodies as applicable.<br />

The project proponent should advertise in at least two local newspapers<br />

widely circulated in the region, one of which shall be in the vernacular<br />

language informing that the project has been accorded environmental<br />

clearance and copies of clearance letters are available with the Punjab<br />

Pollution Control Board. The advertisement should be made within<br />

seven days from the day of issue of the clearance letter and a copy of<br />

the same should be forwarded to the Regional Office, Ministry of<br />

<strong>Environment</strong> & Forests, Chandigarh.<br />

X. These stipulations would be enforced among others under the<br />

provisions of Water (Prevention & Control of Pollution) Act, 1974, Air<br />

(Prevention & Control of Pollution) Act, 1981, <strong>Environment</strong>al<br />

(Protection) Act, 1986, the Public Liability (Insurance) Act, 1991 and EIA<br />

Notification, <strong>20</strong>06.<br />

<strong>Environment</strong>al clearance is subject to final order of the Hon'ble Supreme<br />

Court of India in the matter of Goa Foundation Vs. Union of India in<br />

Writ Petition (Civil) No. 460 of <strong>20</strong>04 as may be applicable to this project<br />

and decisions of any competent court, to the extent applicable.<br />

A copy of the clearance letter shall be sent by the proponent to<br />

concerned Panchayat, Zilla Parishad/ Municipal Corporation, Urban local<br />

body and the local NGO, if any, from whom suggestions /<br />

representations, if any, were received while processing the proposal.<br />

The clearance letter shall also be put on the website of the Company by<br />

the proponent.<br />

The proponent shall upload the status of compliance of the stipulated<br />

EC conditions, including results of monitored data on their website and<br />

shall update the same periodically. It shall simultaneously be sent to the<br />

Regional Office of MoEF, the respective Zonal Office of CPCB and the<br />

SPCB. The criteria pollutant levels namely; SPM, RSPM, SO 2 , NO x<br />

(ambient levels as well as stack emissions) shall be monitored and<br />

displayed at a convenient location near the main gate of the company in<br />

the public domain.<br />

The project proponent shall comply with the conditions imposed by the<br />

Govt. of India, Central Ground Water <strong>Authority</strong>, Ministry of Water<br />

Resources in the permission granted vide the letter no. No. 21-<br />

4(388)/NWR/CGWA/<strong>20</strong>10-153 dated 09 Feb, <strong>20</strong>11 for abstraction of 909<br />

KLD of ground water.<br />

The project proponent shall comply with the conditions imposed by the<br />

Department of Town and Country Planning, Punjab, in the permission<br />

for CLU granted vide the letter no. No. 161 CTP (Pb)/SP-432(m) dated<br />

11.01.<strong>20</strong>10.<br />

Only IT/ITES industries shall be established in the Integrated Industrial<br />

Park and no other category of industries shall be established in the said<br />

Park.<br />

Any appeal against this environmental clearance shall lie with the<br />

National <strong>Environment</strong> Appellate <strong>Authority</strong>, if preferred, within a period<br />

of 30 days as prescribed under section 11 of the National <strong>Environment</strong><br />

Appellate Act, 1987.<br />

The <strong>Authority</strong> further observed that the condition no. iv, v,<br />

vi, vii, xx, xxi & xxii of construction phase recommended by the SEAC<br />

are not in order, therefore, these conditions are not required to be<br />

imposed in the environmental clearance to be granted to the project<br />

proponent.<br />

The <strong>Authority</strong> observed that the case stands recommended<br />

by the SEAC and looked into all aspects of the project proposal in detail<br />

and was satisfied with the same, therefore, the <strong>Authority</strong> decided to<br />

grant environmental clearance to the project proponent subject to the<br />

following conditions, in addition to the proposed measures:<br />

project is commissioned for operation. The discharge of treated sewage<br />

shall conform to the norms and standards prescribed by Punjab Pollution<br />

Control Board for such discharges. There shall be no discharge of treated<br />

wastewater outside the premises of the project/complex.<br />

The project proponent shall provide electromagnetic flow meter at the<br />

outlet of the water supply, outlet of the STP and any pipeline to be used for<br />

re-using the treated wastewater back into the system for flushing / HVAC<br />

and for horticulture purpose etc. and shall maintain a record of readings of<br />

each such meter on daily basis.<br />

Adequate & appropriate pollution control measures should be provided to<br />

control fugitive emissions to be emitted within the commercial complex and<br />

IT/ITES industries.<br />

Application of solar energy should be incorporated for illumination of<br />

common areas, lighting for gardens and street lighting in addition to<br />

provision for solar water heating.<br />

Traffic congestion near the entry and exit points from the roads adjoining<br />

the proposed project site must be avoided. Parking should be fully<br />

internalized and no public space should be utilized.<br />

A report on the energy conservation measures conforming to energy<br />

conservation norms finalized by Bureau of Energy Efficiency should be<br />

prepared incorporating details about machinery of air conditioning, lifts,<br />

lighting, building materials, R & U Factors etc. and submitted to the<br />

respective Regional office of MoEF, the Zonal Office of CPCB and the<br />

SPCB/SEIAA in three months time.<br />

<strong>Environment</strong> Management Cell shall be formed during operation phase<br />

which will supervise and monitor the environment related aspects of the<br />

project.<br />

PART B – General Conditions :<br />

i) This environmental clearance will be valid for a period of five years from<br />

the date of its issue or till the completion of the project, whichever is<br />

earlier.<br />

ii) The environmental safeguards contained in the application of the promoter<br />

/ mentioned during the presentation before <strong>State</strong> <strong>Level</strong> <strong>Environment</strong><br />

<strong>Impact</strong> <strong>Assessment</strong> <strong>Authority</strong>/<strong>State</strong> Expert Appraisal Committee should be<br />

implemented in letter and spirit.<br />

The entire cost of the environmental management plan (i.e. capital cost as<br />

well as recurring cost) will continue to be borne by the project proponent<br />

until the responsibility of environmental management plan is transferred to<br />

the occupier/residents society under proper MOU.<br />

The project proponent shall also submit six monthly reports on the status of<br />

compliance of the stipulated EC conditions including results of monitored<br />

data (both in hard copies as well as by mail) to the respective Regional<br />

office of MoEF, the Zonal Office of CPCB and the SPCB/SEIAA.<br />

v) Officials from the Regional Office of Ministry of <strong>Environment</strong> & Forests,<br />

Chandigarh / <strong>State</strong> <strong>Level</strong> <strong>Environment</strong> <strong>Impact</strong> <strong>Assessment</strong> <strong>Authority</strong> / <strong>State</strong><br />

<strong>Level</strong> Expert Appraisal Committee / Punjab Pollution Control Board who<br />

would be monitoring the implementation of environmental safeguards<br />

should be given full cooperation, facilities and documents / data by the<br />

project proponents during their inspection. A complete set of all the<br />

documents submitted to <strong>State</strong> <strong>Environment</strong> <strong>Impact</strong> <strong>Assessment</strong> <strong>Authority</strong><br />

should be forwarded to the CCF, Regional Office of Ministry of <strong>Environment</strong><br />

& Forests, Chandigarh/<strong>State</strong> <strong>Level</strong> <strong>Environment</strong> <strong>Impact</strong> <strong>Assessment</strong><br />

<strong>Authority</strong>.<br />

In the case of any change(s) in the scope of the project, the project would<br />

require a fresh appraisal by <strong>State</strong> <strong>Environment</strong> <strong>Impact</strong> <strong>Assessment</strong><br />

<strong>Authority</strong>.<br />

Separate distribution pipelines be laid down for use of treated effluent / raw<br />

water for horticultural/gardening purposes with different colour coding.<br />

All other statutory clearances such as the approvals for storage of diesel<br />

from Chief Controller of Explosives, Fire Department, Civil Aviation<br />

Department, Forest (Conservation) Act, 1980 and Wildlife (Protection) Act,<br />

1972 etc. shall be obtained, by project proponents from the competent<br />

authorities including Punjab Pollution Control Board and from other<br />

statutory bodies as applicable.<br />

The project proponent should advertise in at least two local newspapers<br />

widely circulated in the region, one of which shall be in the vernacular<br />

language informing that the project has been accorded environmental<br />

clearance and copies of clearance letters are available with the Punjab<br />

Pollution Control Board. The advertisement should be made within seven<br />

days from the day of issue of the clearance letter and a copy of the same<br />

should be forwarded to the Regional Office, Ministry of <strong>Environment</strong> &<br />

Forests, Chandigarh.<br />

x) These stipulations would be enforced among others under the provisions of<br />

Water (Prevention & Control of Pollution) Act, 1974, Air (Prevention &<br />

Control of Pollution) Act, 1981, <strong>Environment</strong>al (Protection) Act, 1986, the<br />

Public Liability (Insurance) Act, 1991 and EIA Notification, <strong>20</strong>06.<br />

<strong>Environment</strong>al clearance is subject to final order of the Hon'ble Supreme<br />

Court of India in the matter of Goa Foundation Vs. Union of India in Writ<br />

Petition (Civil) No. 460 of <strong>20</strong>04 as may be applicable to this project and<br />

decisions of any competent court, to the extent applicable.<br />

A copy of the clearance letter shall be sent by the proponent to concerned<br />

Panchayat, Zilla Parishad/ Municipal Corporation, Urban local body and the<br />

local NGO, if any, from whom suggestions / representations, if any, were<br />

received while processing the proposal. The clearance letter shall also be<br />

put on the website of the Company by the proponent.<br />

The proponent shall upload the status of compliance of the stipulated EC<br />

conditions, including results of monitored data on their website and shall<br />

update the same periodically. It shall simultaneously be sent to the<br />

Regional Office of MoEF, the respective Zonal Office of CPCB and the SPCB.<br />

The criteria pollutant levels namely; PM 2.5 , PM 10 , SO 2 , NO x , CO, Pb, Ozone<br />

(ambient air as well as stack emissions) shall be monitored and displayed at<br />

a convenient location near the main gate of the company in the public<br />

domain.<br />

The project proponent shall comply with the conditions imposed by the<br />

Govt. of India, Central Ground Water <strong>Authority</strong>, Ministry of Water<br />

Resources in the permission granted vide the letter no. No. 21-<br />

4(388)/NWR/CGWA/<strong>20</strong>10-153 dated 09 Feb, <strong>20</strong>11 for abstraction of 909<br />

KLD of ground water.<br />

The project proponent shall comply with the conditions imposed by the<br />

Department of Town and Country Planning, Punjab, in the permission for<br />

CLU granted vide the letter no. No. 161 CTP (Pb)/SP-432(m) dated<br />

11.01.<strong>20</strong>10.<br />

Only IT/ITES industries shall be established in the Integrated Industrial<br />

Park and no other category of industries shall be established in the said<br />

Park.<br />

xvii)<br />

The <strong>State</strong> <strong>Environment</strong> <strong>Impact</strong> <strong>Assessment</strong> <strong>Authority</strong> reserves the right to<br />

add additional safeguards/ measures subsequently, if found necessary, and<br />

to take action including revoking of the environmental clearance under the<br />

provisions of the <strong>Environment</strong>al (Protection) Act, 1986, to ensure effective<br />

implementation of the suggested safeguards/ measures in a time bound<br />

and satisfactory manner.<br />

xviii) Any appeal against this environmental clearance shall lie with the National<br />

<strong>Environment</strong> Appellate <strong>Authority</strong>, if preferred, within a period of 30 days as<br />

prescribed under section 11 of the National <strong>Environment</strong> Appellate Act,<br />

1987.<br />

Item No. SEIAA/31.08 Application for <strong>Environment</strong>al Clearance for<br />

Hotel, Shopping Mall cum Multiplex to be<br />

developed by M/s Best City Infrastructure<br />

(India) Pvt. Ltd. at Old Civil Hospital Site, Mall<br />

Road, Bathinda.<br />

The SEIAA observed that:<br />

1. M/s Best City Infrastructure (India) Pvt. Ltd has applied for obtaining<br />

environmental clearance for developing a Hotel, Shopping Mall-cum-<br />

Multiplex in an area of 18,211 sq. m at Old Civil Hospital Site, Mall Road,<br />

Bathinda as required under EIA Notification dated 14.9.<strong>20</strong>06. The project of<br />

the promoter is covered under category 8 (a) of the Schedule appended to<br />

the EIA Notification dated 14.9.<strong>20</strong>06.<br />

2. The case was considered by the SEAC in its 46 th meeting held on 24.4.<strong>20</strong>11<br />

and the Committee observed that the project proponent has provided<br />

adequate and satisfactory clarifications of the observations raised by it,<br />

therefore, the Committee awarded 'Bronze Grading' to the project<br />

proposal and decided to forward the case to the SEIAA, with the<br />

recommendation to grant environmental clearance to the project proponent<br />

subject to certain conditions alongwith following condition in addition to the<br />

proposed measures.<br />

" The project proponent shall not install any tubewell for<br />

abstraction of groundwater required at the construction as well<br />

as operation stage of the project since the project proponent<br />

has mentioned in the application / presented before the<br />

Committee that the entire requirement of water will be met<br />

from the M.C. Water supply".<br />

The project proponent was requested vide letter No. 1764 dated<br />

17.5.<strong>20</strong>11 to attend the 31 st meeting of SEIAA on <strong>20</strong>.5.<strong>20</strong>11 to present the project<br />

proposal.<br />

Following were present in the meeting of SEIAA held on 27.4.<strong>20</strong>11<br />

on behalf of the project proponent to present the reply of the observations<br />

conveyed by the <strong>Authority</strong> vide letter No. 16640 dated 7.4.<strong>20</strong>11.<br />

1. Sh. Jagdeep Arora, AGM.<br />

2. Sh. Yashpal Jain, <strong>Environment</strong>al Consultant, M/s Ace<br />

Engineers & Consultants, Patiala.<br />

Sh. Yashpal Jain of M/s Ace Engineers & Consultants, Patiala, who is<br />

the <strong>Environment</strong>al Consultant for the project proponent and the name of his<br />

consultancy firm figures at Sr. no. 153 of the list uploaded by the MoEF at its<br />

official website, informed that:-<br />

1. A tubewell will be installed to meet with the requirement of water during<br />

construction stage and this tubewell will also be used to meet with the<br />

requirement of water during the period of failure of Municipal water supply<br />

in operation phase.<br />

2. The Bathinda block comes under safe category as per letter issued by the<br />

CGWA in case of M/s PACL India Ltd., for its residential township being<br />

developed in Bathinda block, as such, no permission is required to be<br />

obtained for abstraction of ground water since this site is also located in the<br />

said block.<br />

3. R.O. Plant will be installed to treat the ground water since the quantity of<br />

ground water of Bathinda Block is not potable in nature. The R.O. reject will<br />

be mixed with treated wastewater.<br />

4. The wastewater will be treated in a S.T.P. consisting of oil/grease trap,<br />

collection tank, primary clarifier, aeration tank, secondary clarifier, sand<br />

filter, ozonation and sludge drying beds will be provided to treat the<br />

wastewater. The treated wastewater will be utilized for flushing purpose,<br />

HVAC, horticulture and remaining will be discharged into sewer.<br />

5. The solid waste about 500 kg/day shall be generated and the same will be<br />

segregated at source. The recyclable fraction will be sent directly to<br />

recyclers and the remaining waste will be disposed off at the site<br />

earmarked by M.C. Bathinda and the Corporation has issued permission in<br />

this regard.<br />

6. The construction work of the project has already been started.<br />

The <strong>Authority</strong> noted that the project proponent has violated the<br />

provisions of the <strong>Environment</strong> (Protection) Act, 1986 by starting construction work<br />

of the project without obtaining environmental clearance as required under the<br />

EIA Notification dated 14.9.<strong>20</strong>06. Therefore, in compliance to Govt. of India,<br />

Ministry of <strong>Environment</strong> & Forests, New Delhi Office Memorandum dated<br />

16.11.<strong>20</strong>10, the project proponent is required to place the matter before the<br />

Board of Directors of the Company for starting construction work of the project in<br />

violation of the provision of the EIA Notification framed under the <strong>Environment</strong><br />

(Protection) Act, 1986 and is required to submit a written commitment in the form<br />

of a formal resolution to the SEIAA to the effect that the violation of the<br />

<strong>Environment</strong> (Protection) Act, 1986 will not be repeated in future.<br />

The <strong>Authority</strong> further observed that the project proponent is<br />

required to submit the following information / data before taking further necessary<br />

action in the matter.<br />

a) How much quantity of R.O. reject water will be generated and what will<br />

be the concentration of TSS and TDS in the same?<br />

b) Calculations showing as to what will be the conc. of TSS & TDS in the<br />

treated wastewater after mixing with R.O. reject water.<br />

c) Which mixing mechanism will be provided to ensure complete mixing of<br />

R.O. reject water and treated wastewater.<br />

d) Water balance chart for all the three seasons, i.e. summer, winter and<br />

rainy including R.O. permeate and reject water.<br />

e) The project proponent shall place the matter before the Board of<br />

Directors of the Company for starting construction work of the project in<br />

violation of the provisions of the EIA Notification framed under the<br />

<strong>Environment</strong> (Protection) Act, 1986 and shall submit a written<br />

commitment in the form of a formal resolution to the SEIAA to the<br />

effect that the violation of <strong>Environment</strong> (Protection) Act, 1986 will not<br />

be repeated in future.<br />

Sh. Yash Pal Jain requested for 15days time to submit the reply to<br />

the aforesaid observations of the <strong>Authority</strong>.<br />

The <strong>Authority</strong> agreed to accept the request of the project proponent<br />

and decided to defer the case till the proper reply of all the observations is<br />

received.<br />

Item No. SEIAA/31.09: Application for <strong>Environment</strong>al Clearance for<br />

developing a Residential Group Housing Project<br />

namely „DD Mittal Towers" at Multania Road,<br />

Bathinda by M/s BCL Industries & Infrastructure<br />

Ltd.<br />

The SEIAA observed that:<br />

1. M/s BCL Industries & Infrastructure Ltd has applied for obtaining<br />

environmental clearance for developing a Residential Group Housing Project<br />

namely „DD Mittal Towers" at Multania Road, Bathinda as required under<br />

EIA Notification dated 14.9.<strong>20</strong>06. The total plot area of the proposed<br />

project is 16274.27 Sq. m, which has been allotted by PIDB and has<br />

submitted a copy of the allotment letter as an evidence in this regard. The<br />

site of the project falls within M.C. limits of Bathinda and is for mixed land<br />

use. Total built up area will be 488<strong>20</strong> Sq. m. and the project of the<br />

promoter is covered under category 8 (a) of the Schedule appended to the<br />

said notification.<br />

2. The case was considered by the SEAC in its 46 th meeting held on<br />

24.4.<strong>20</strong>11 and the Committee observed that the project proponent has<br />

provided adequate and satisfactory clarifications of the observations raised<br />

by it, therefore, the Committee awarded 'Bronze Grading' to the project<br />

proposal and decided to forward the case to the SEIAA, with the<br />

recommendation to grant environmental clearance to the project proponent<br />

subject to certain conditions alongwith following condition in addition to the<br />

proposed measures .<br />

Following were present in the meeting of SEIAA held on <strong>20</strong>.5.<strong>20</strong>11<br />

on behalf of the project proponent to present the project proposal.<br />

2. Sh. Yashpal Jain, <strong>Environment</strong>al Consultant, M/s Ace<br />

Engineers & Consultants, Patiala.<br />

clarifier, sand filter, ozonation and sludge drying beds will be<br />

will be segregated at source. The recyclable fraction will be sent<br />

directly to recyclers and the remaining waste will be disposed off at<br />

the site earmarked by M.C. Bathinda and the Corporation has<br />

issued permission in this regard.<br />

The <strong>Authority</strong> further observed that the project proponent is<br />

required to submit the following information / data before taking further necessary<br />

action in the matter.<br />

developing a Housing Project namely „Golf<br />

Links-II' at Sector 116, Landran-Khard Road,<br />

Mohali by M/s Ansal Properties &<br />

Infrastructures Ltd.<br />

Following were present on <strong>20</strong>.5.<strong>20</strong>11 to present the<br />

case before the SEIAA on behalf of the project promoter:<br />

1. Sh. Sanjay Gupta, Additional General Manager of the<br />

promoter company.<br />

2. Sh. Yash Pal Jain, <strong>Environment</strong>al Consultant, M/s Ace<br />

Engineers & Consultants, Patiala.<br />

Sh. Yash Pal Jain of M/s Ace Engineers & Consultants, Patiala, who is<br />

the <strong>Environment</strong>al Consultant of the project proponent and the name of his<br />

consultancy firm figures at sr. no. 153 of the list uploaded by the MoEF at its<br />

official website, presented the case before the SEAC.<br />

1. M/s Ansal Properties & Infrastructures Ltd., has submitted application for<br />

obtaining environmental clearance for developing a Group Housing Project<br />

namely „Golf Links-II' at Sector 116, Landran-Khard Road, Mohali as<br />

required under EIA notification dated 14.9.<strong>20</strong>06. The project of the<br />

promoter is covered under category 8 (a) of the Schedule appended to the<br />

said notification. The expected cost of the project is Rs. 166 Crores.<br />

2. The total plot area of the proposed project is 1<strong>05</strong>.72 acres and total built<br />

up area is 1,<strong>20</strong>,000 Sq. m. The detail of the total plot area is as under:<br />

‣ 29.93 acres will be developed as residential area containing 501<br />

plots<br />

‣ 13.56 acres will be developed as group housing area having 650<br />

apartments.<br />

‣ 5.090 acres as EWS housing, 4.83 acres for commercial shops/SCO<br />

having 189 such establishments.<br />

‣ The remaining area has been kept for public facilities/institutional<br />

buildings, park/green area, roads and open space.<br />

2. The site of the project falls within M.C. limits of Mohali and CLU has been<br />

granted by the Town & Country Planning Department for an land area<br />

measuring 99.54 acres vide letter no. 544 dated 27.1.<strong>20</strong>10, however, CLU<br />

for remaining 4.6771 acres proposed to be acquired by the <strong>State</strong> Govt. shall<br />

be approved after its acquisition and handing over the possession to the<br />

promoter.<br />

3. The total water requirement for the project is 1755 KLD, which will be met<br />

with tubewells and also municipal water supply will be made available for<br />

the complex. The requisite permission from the Central Ground Water<br />

<strong>Authority</strong> is yet to be obtained.<br />

5. The total wastewater generation from the proposed project will be about<br />

1300 KLD, out of which 250 KLD of treated sewage will be utilized for<br />

flushing and 1<strong>05</strong>0 KLD for plantation.<br />

6. The project proponent proposed to set up two identical STPs, in a phased<br />

manner. Each of the STP will have sewage handling capacity of 700 KLD<br />

consisting of collection tank, primary clarifier, aeration tank, secondary<br />

clarifier, pressure sand filter and sludge drying bed within the premises to<br />

treat the wastewater. In one STP, ozonation treatment facility will be<br />

provided whose, wastewater will be used for flushing purpose.<br />

7. 55 recharging wells will be installed in the complex for rainwater<br />

harvesting.<br />

8. The total quantity of MSW has been estimated 5,000 kg/day, out of which<br />

1000 kg/day of recyclable solid waste, 2500 kg/day of biodegradable and<br />

1500 kg/day of non-biodegradable waste will be generated. This waste will<br />

be segregated at source by providing adequate number of collection bins<br />

separately for bio-degradable and non-biodegradable waste as per the<br />

MSW Rules, <strong>20</strong>00. The bio-degradable solid waste will be disposed off in<br />

approved landfill sites and non-biodegradable & recyclable would be sold<br />

the recyclers.<br />

9. The total power requirement is <strong>20</strong> MW will be supplied by <strong>State</strong> Electricity<br />

Board. The project has provision to provide DG sets of capacity <strong>20</strong>00 KVA,<br />

which will be provided with acoustic enclosures.<br />

10. The analysis results of ambient air, groundwater and ambient noise level<br />

got analyzed by M/s Industrial Testing Laboratory and Consulting House<br />

have been submitted. These reports indicate that the ambient air quality of<br />

the area is conforming to the standards laid down by the MoEF , ground<br />

water is potable and ambient noise levels are of the area is conforming to<br />

the standards laid down by the MoEF.<br />

11. Green belt will be developed in about 70,000 sq. m area.<br />

The SEIAA observed that:<br />

a. The case of the project proponent was considered by the SEAC on its 43 rd<br />

meeting held on 19.3.<strong>20</strong>11, which was attended by the representative of<br />

the promoter company and its <strong>Environment</strong>al Consultant to present the<br />

project proposal.<br />

b. The SEAC decided to defer the case till the reply of the observations raised<br />

by it, is received. The Committee was conveyed its decision to the project<br />

proponent vide letter No. 15427 dated 31.3.<strong>20</strong>11,<br />

c. Thereafter, the project proponent vide letter no. APIL/<strong>20</strong>11/1918 dated<br />

4.4.<strong>20</strong>11 has submitted the reply of the observations of the SEAC.<br />

d. The reply submitted by the project proponent was considered by the SEAC<br />

in its 46th meeting held on 24.4.<strong>20</strong>11 and the Committee observed that the<br />

project proponent has provided adequate and satisfactory clarifications of<br />

the observations raised by it, therefore, the Committee awarded 'Silver<br />

Grading' to the project proposal and decided to forward the case to the<br />

SEIAA, with the recommendation to grant environmental clearance to the<br />

project proponent subject to the following conditions, in addition to the<br />

proposed measures for establishment of a group housing project in an area<br />

measuring as 1<strong>05</strong>.72 acres at Sector-116, Landran-Kharar Road, Mohali.<br />

PART A – Specific conditions<br />

I. Construction Phase<br />

I. “Consent to establish” shall be obtained from Punjab Pollution Control<br />

Board under Air (Prevention & Control of Pollution) Act, 1981 and Water<br />

(Prevention & Control of Pollution) Act, 1974 and a copy of the same<br />

shall be submitted to the Ministry of <strong>Environment</strong> & Forests / <strong>State</strong><br />

Vehicles hired for bringing construction material to the site should be in<br />

good condition and should conform to applicable air and noise emission<br />

standards and should be operated only during non peak hours.<br />

Ambient noise levels should conform to prescribed standards both<br />

during day and night. Incremental pollution loads on the ambient air<br />

and noise quality should be closely monitored during construction<br />

phase.<br />

Fly ash should be used as construction material in the construction as<br />

per the provisions of Fly Ash Notification of September, 1999 and as<br />

amended on August, <strong>20</strong>03 (The above condition is applicable only if the<br />

project is within 100 Km of Thermal Power Station).<br />

Ready mixed concrete must be used in building construction.<br />

Water demand during construction should be reduced by use of<br />

premixed concrete, curing agents and other best practices referred.<br />

Separation of drinking water supply and treated sewage supply should<br />

be done by the use of dual plumbing line of different colours for<br />

separation of drinking water and treated sewage.<br />

Fixtures for showers, toilet flushing and drinking should be of low flow<br />

either by use of aerators or pressure reducing devices or sensor based<br />

control.<br />

Use of glass may be reduced up to 40% to reduce the electricity<br />

consumption and load on air-conditioning. If necessary, use high quality<br />

double glass with special reflective coating in windows.<br />

Roof should meet prescriptive requirement as per Energy Conservation<br />

Building Code by using appropriate thermal insulation material to fulfill<br />

requirement.<br />

Opaque wall should meet prescriptive requirement as per Energy<br />

Conservation Building Code which is proposed to be mandatory for all<br />

air conditioned spaces while it is aspirational for non air-conditioned<br />

spaces by use of appropriate thermal insulation material to fulfill<br />

requirement.<br />

The approval of competent authority shall be obtained for structural<br />

safety of the buildings due to earthquakes, adequacy of fire fighting<br />

equipments etc. as per National Building Code including protection<br />

measures from lightening.<br />

Provisions shall be made for the housing of construction labour within<br />

the site with all necessary infrastructure and facilities such as fuel for<br />

cooking, mobile toilets, mobile STP, Safe drinking water, medical health<br />

care, crèche etc. The housing may be in the form to temporary<br />

structure to be removed after the completion of the project.<br />

II. Operation Phase<br />

I. The installation of sewage treatment plant (STP) and adequacy of<br />

disposal system should be certified by Punjab Pollution Control Board<br />

and a report in this regard should be submitted to the Ministry of<br />

<strong>Environment</strong> & Forests/<strong>State</strong> <strong>Level</strong> <strong>Environment</strong> <strong>Impact</strong> <strong>Assessment</strong><br />

<strong>Authority</strong> before the project is commissioned for operation. The<br />

discharge of treated sewage shall conform to the norms and standards<br />

prescribed by Punjab Pollution Control Board for such discharges. There<br />

shall be no discharge of treated wastewater outside the premises of the<br />

project/complex.<br />

Adequate & appropriate pollution control measures should be provided<br />

to control fugitive emissions to be emitted within the commercial<br />

complex.<br />

required.<br />

Rainwater harvesting for roof run-off should be implemented. Before<br />

recharging the surface run-off, pretreatment must be done to remove<br />

suspended matter, oil and grease. However, no run off from<br />

gardens/green area be connected with the ground water recharging<br />

V. The solid waste generated should be properly collected and segregated.<br />

The recyclable solid waste shall be sold out to the authorized vendors<br />

and inerts shall be sent to disposal facility. The Bio-degradable solid<br />

waste shall be sent to the municipal solid waste dump site as per the<br />

provisions of the Municipal Solid Waste (Management & Handling)<br />

Rules, <strong>20</strong>00 with the prior approval of competent authority.<br />

and with the necessary approvals of the Punjab Pollution Control Board.<br />

The green belt design along the periphery of the plot shall achieve<br />

prescribed for residential land use. The open spaces inside the plot<br />

should be suitably landscaped and covered with vegetation of<br />

indigenous variety.<br />

Separate distribution pipelines be laid down for use of treated effluent<br />

for horticultural/gardening purpose with different colour coding.<br />

The project proponent should take adequate and appropriate measures<br />

to contain the ambient air quality with in the prescribed standards. The<br />

proposal regarding mitigation measures to be taken at site should be<br />

submitted to the Ministry of <strong>Environment</strong> & Forests/ <strong>State</strong> <strong>Level</strong><br />

<strong>Environment</strong> <strong>Impact</strong> <strong>Assessment</strong> <strong>Authority</strong> within 3 months.<br />

X. Incremental pollution loads on the ambient air quality, noise and water<br />

quality should be periodically monitored after commissioning of the<br />

project.<br />

Application of solar energy should be incorporated for illumination of<br />

common areas, lighting for gardens and street lighting in addition to<br />

provision for solar water heating.<br />

Traffic congestion near the entry and exit points from the roads<br />

adjoining the proposed project site must be avoided. Parking should be<br />

fully internalized and no public space should be utilized.<br />

A report on the energy conservation measures conforming to energy<br />

conservation norms finalized by Bureau of Energy Efficiency should be<br />

prepared incorporating details about machinery of air conditioning, lifts,<br />

lighting, building materials, R & U Factors etc. and submitted to the<br />

Ministry of <strong>Environment</strong> & Forests/SEAC in three months time.<br />

<strong>Environment</strong> Management Cell shall be formed during operation phase<br />

which will supervise and monitor the environment related aspects of the<br />

project.<br />

Committee should be implemented in letter and spirit.<br />

The entire cost of the environmental management plan (i.e. capital cost<br />

as well as recurring cost) will continue to be borne by the project<br />

proponent until the responsibility of environmental management plan is<br />

transferred to the occupier/residents society under proper MOU.<br />

The project proponent shall also submit six monthly reports on the<br />

status of compliance of the stipulated EC conditions including results of<br />

monitored data (both in hard copies as well as by mail) to the respective<br />

Regional office of MoEF, the respective Zonal Office of CPCB and the<br />

SPCB/SEIAA.<br />

who would be monitoring the implementation of environmental<br />

safeguards should be given full cooperation, facilities and documents /<br />

data by the project proponents during their inspection. A complete set<br />

of all the documents submitted to <strong>State</strong> <strong>Environment</strong> <strong>Impact</strong><br />

<strong>Assessment</strong> <strong>Authority</strong> should be forwarded to the CCF, Regional Office<br />

of Ministry of <strong>Environment</strong> & Forests, Chandigarh/<strong>State</strong> <strong>Level</strong><br />

<strong>Environment</strong> <strong>Impact</strong> <strong>Assessment</strong> <strong>Authority</strong>.<br />

In the case of any change(s) in the scope of the project, the project<br />

would require a fresh appraisal by <strong>State</strong> <strong>Environment</strong> <strong>Impact</strong><br />

<strong>Assessment</strong> <strong>Authority</strong>.<br />

The <strong>State</strong> <strong>Environment</strong> <strong>Impact</strong> <strong>Assessment</strong> <strong>Authority</strong> reserves the right<br />

to add additional safeguard/ measures subsequently, if found necessary,<br />

and to take action including revoking of the environmental clearance<br />

under the provisions of the <strong>Environment</strong>al (Protection) Act, 1986, to<br />

ensure effective implementation of the suggested safeguard/ measures<br />

in a time bound and satisfactory manner.<br />

All other statutory clearances such as the approvals for storage of diesel<br />

from Chief Controller of Explosives, Fire Department, Civil Aviation<br />

Department, Forest (Conservation) Act, 1980 and Wildlife (Protection)<br />

Act, 1972 etc. shall be obtained, by project proponents from the<br />

competent authorities including Punjab Pollution Control Board and from<br />

other statutory bodies as applicable.<br />

The project proponent should advertise in at least two local newspapers<br />

widely circulated in the region, one of which shall be in the vernacular<br />

language informing that the project has been accorded environmental<br />

clearance and copies of clearance letters are available with the Punjab<br />

Pollution Control Board. The advertisement should be made within<br />

seven days from the day of issue of the clearance letter and a copy of<br />

the same should be forwarded to the Regional Office, Ministry of<br />

<strong>Environment</strong> & Forests, Chandigarh.<br />

X. These stipulations would be enforced among others under the<br />

provisions of Water (Prevention & Control of Pollution) Act, 1974, Air<br />

(Prevention & Control of Pollution) Act, 1981, <strong>Environment</strong>al<br />

(Protection) Act, 1986, the Public Liability (Insurance) Act, 1991 and EIA<br />

Notification, <strong>20</strong>06.<br />

<strong>Environment</strong>al clearance is subject to final order of the Hon'ble Supreme<br />

Court of India in the matter of Goa Foundation Vs. Union of India in<br />

Writ Petition (Civil) No. 460 of <strong>20</strong>04 as may be applicable to this project<br />

and decisions of any competent court, to the extent applicable.<br />

A copy of the clearance letter shall be sent by the proponent to<br />

concerned Panchayat, Zilla Parishad/ Municipal Corporation, Urban local<br />

body and the local NGO, if any, from whom suggestions /<br />

representations, if any, were received while processing the proposal.<br />

The clearance letter shall also be put on the website of the Company by<br />

the proponent.<br />

The proponent shall upload the status of compliance of the stipulated<br />

EC conditions, including results of monitored data on their website and<br />

shall update the same periodically. It shall simultaneously be sent to the<br />

Regional Office of MoEF, the respective Zonal Office of CPCB and the<br />

SPCB. The criteria pollutant levels namely; SPM, RSPM, SO 2 , NO x<br />

(ambient levels as well as stack emissions) shall be monitored and<br />

displayed at a convenient location near the main gate of the company in<br />

the public domain.<br />

The project proponent shall obtain permission from Central Ground<br />

Water <strong>Authority</strong>, Ministry of Water Resources for abstraction of<br />

groundwater before starting any construction activity at site.<br />

The project proponent shall comply with the conditions imposed by the<br />

Department of Town & Country Planning, Punjab in the permission for<br />

CLU granted vide no. 544 CTP (Pb)SP-432 (M) dated 27.1.<strong>20</strong>10.<br />

Any appeal against this environmental clearance shall lie with the<br />

National <strong>Environment</strong> Appellate <strong>Authority</strong>, if preferred, within a period<br />

of 30 days as prescribed under section 11 of the National <strong>Environment</strong><br />

Appellate Act, 1987.<br />

The <strong>Authority</strong> further observed that the additional condition<br />

no. iv, v, vi, vii, xix, xx & xxi of Construction Phase recommended by the<br />

SEAC are not in order, therefore, these conditions are not required to be<br />

imposed in the environmental clearance to be granted to the project<br />

proponent.<br />

The <strong>Authority</strong> observed that the case stands recommended<br />

by the SEAC and looked into all aspects of the project proposal in detail<br />

and was satisfied with the same. However, the project proponent is<br />

required to submit permission of CGWA for abstraction of ground water<br />

before grant of environmental clearance. The <strong>Authority</strong>, therefore,<br />

decided that the project proponent will submit the said permission<br />

within one month. Further, the <strong>Authority</strong> authorized the Member<br />

Secretary of the SEIAA for grant of environmental clearance to the<br />

project proponent without bringing the case in the agenda of SEIAA, as<br />

and when the permission of CGWA for abstraction of ground water is<br />

submitted by the project proponent, subject to the following conditions,<br />

in addition to the proposed measures:<br />

language informing that the project has been accorded environmental<br />

clearance and copies of clearance letters are available with the Punjab<br />

Pollution Control Board. The advertisement should be made within<br />

seven days from the day of issue of the clearance letter and a copy of<br />

the same should be forwarded to the Regional Office, Ministry of<br />

<strong>Environment</strong> & Forests, Chandigarh.<br />

x) These stipulations would be enforced among others under the<br />

provisions of Water (Prevention & Control of Pollution) Act, 1974, Air<br />

(Prevention & Control of Pollution) Act, 1981, <strong>Environment</strong>al<br />

(Protection) Act, 1986, the Public Liability (Insurance) Act, 1991 and EIA<br />

<strong>Environment</strong>al clearance is subject to final order of the Hon'ble Supreme<br />

Court of India in the matter of Goa Foundation Vs. Union of India in<br />

Writ Petition (Civil) No. 460 of <strong>20</strong>04 as may be applicable to this project<br />

and decisions of any competent court, to the extent applicable.<br />

A copy of the clearance letter shall be sent by the proponent to<br />

concerned Panchayat, Zilla Parishad/ Municipal Corporation, Urban local<br />

body and the local NGO, if any, from whom suggestions /<br />

representations, if any, were received while processing the proposal.<br />

The clearance letter shall also be put on the website of the Company by<br />

the proponent.<br />

The proponent shall upload the status of compliance of the stipulated<br />

EC conditions, including results of monitored data on their website and<br />

shall update the same periodically. It shall simultaneously be sent to the<br />

Regional Office of MoEF, the respective Zonal Office of CPCB and the<br />

SPCB. The criteria pollutant levels namely; PM 2.5 , PM 10 , SO 2 , NO x , CO,<br />

Pb, Ozone (ambient air as well as stack emissions) shall be monitored<br />

and displayed at a convenient location near the main gate of the<br />

company in the public domain.<br />

The project proponent shall comply with the conditions imposed by the<br />

Central Ground Water <strong>Authority</strong>, Ministry of Water Resources, Govt. of<br />

India.<br />

The project proponent shall comply with the conditions imposed by the<br />

Department of Town & Country Planning, Punjab in the permission for<br />

CLU granted vide no. 544 CTP (Pb)SP-432 (M) dated 27.1.<strong>20</strong>10.<br />

The <strong>State</strong> <strong>Environment</strong> <strong>Impact</strong> <strong>Assessment</strong> <strong>Authority</strong> reserves the right<br />

to add additional safeguards/ measures subsequently, if found<br />

necessary, and to take action including revoking of the environmental<br />

clearance under the provisions of the <strong>Environment</strong>al (Protection) Act,<br />

1986, to ensure effective implementation of the suggested safeguards/<br />

measures in a time bound and satisfactory manner.<br />

Any appeal against this environmental clearance shall lie with the<br />

National <strong>Environment</strong> Appellate <strong>Authority</strong>, if preferred, within a period<br />

of 30 days as prescribed under section 11 of the National <strong>Environment</strong><br />

Appellate Act, 1987.<br />

Item No. SEIAA/31.11 Application for obtaining <strong>Environment</strong>al<br />

Clearance for developing a Residential Colony<br />

namely „Janpath Estates' at Village Jhammat,<br />

Opposite Sidhwan Canal Road, District Ludhiana<br />

(Punjab) by M/s Janpath Estates (P) Ltd.<br />

The SEIAA observed that:<br />

1. M/s Janpath Estates (P) Ltd. has submitted application for obtaining<br />

environmental clearance for developing a Residential Colony namely<br />

„Janpath Estates' at Village Jhammat, Opposite Sidhwan Canal Road,<br />

District Ludhiana as required under EIA notification dated 14/9/<strong>20</strong>06.The<br />

project promoter is covered under category 8 (a) of the Schedule appended<br />

to the said notification.<br />

2. The total plot area of the proposed project is 40426.772 Sq. m and total<br />

built up area is 30<strong>05</strong>1.942 Sq m.,which comprises of 67 no. of residential<br />

villas , commercial activities and community centre. Therefore, the total<br />

population of the township will be 1022 including 352 floating population.<br />

3. The site of the project is located outside MC limits of Ludhiana in the<br />

residential zone as per the Master Plan and submitted a letter issued by<br />

DTP, Ludhiana vide memo no. 1348 dated 19.4.<strong>20</strong>11 to the effect that the<br />

site is located in the residential zone(RD-2).<br />

4. The total water consumption will be 46.99 KLD and permission has been<br />

obtained from the Govt. of India, Central Ground Water <strong>Authority</strong>, Ministry<br />

of Water Resources vide the letter no. 408 dated 15.4.<strong>20</strong>11 for abstraction<br />

of 1<strong>05</strong> KLD of groundwater.<br />

5. About 60.627 KLD of wastewater will be generated, which will be treated in<br />

a STP of capacity 73 KLD. After treatment, about 54.564 KLD of treated<br />

wastewater will be generated from the STP, out of which <strong>20</strong>.374 KLD will<br />

be used for flushing purpose and remaining 34.19 KLD will be used for<br />

horticulture purpose.<br />

6. About 304.80 Kg/day of solid waste will be generated, which will be<br />

segregated at source. The bio-degradable component of the waste will be<br />

sent to composting plant and non bio-degradable part will be sold out.<br />

7. The case was considered by the SEAC in its 46 th held on 24.4.<strong>20</strong>11 and<br />

observed that the project proponent has provided adequate and<br />

satisfactory clarifications of the observations raised by it, therefore, the<br />

Committee awarded 'Silver Grading' to the project proposal and decided to<br />

forward the case to the SEIAA, with the recommendation to grant<br />

environmental clearance to the project proponent subject to the following<br />

conditions, in addition to the proposed measures for establishment of a<br />

residential colony in area measuring as 40426.772 sq. m at Village<br />

Jhammat, Opp. Sidhwan Canal, District Ludhiana.<br />

PART A – Specific conditions<br />

I. Construction Phase<br />

i) “Consent to establish” shall be obtained from Punjab Pollution Control<br />

Board under Air (Prevention & Control of Pollution) Act, 1981 and Water<br />

(Prevention & Control of Pollution) Act, 1974 and a copy of the same shall<br />

be submitted to the Ministry of <strong>Environment</strong> & Forests / <strong>State</strong> <strong>Level</strong><br />

<strong>Environment</strong> <strong>Impact</strong> <strong>Assessment</strong> <strong>Authority</strong> before the start of any<br />

construction work at site.<br />

All required sanitary and hygienic measures should be in place before<br />

starting construction activities and to be maintained throughout the<br />

construction phase.<br />

A first aid room will be provided in the project both during construction and<br />

operation phase of the project.<br />

Adequate drinking water and sanitary facilities should be provided for<br />

construction workers at the site. The disposal of wastewater and solid<br />

wastes generated during the construction phase should be in<br />

environmentally sound manner.<br />

v) Provision should be made for the supply of fuel (kerosene or cooking gas),<br />

utensils such as pressure cookers etc. to the laborers during construction<br />

phase.<br />

All the labourers to be engaged for construction should be screened for<br />

health and adequately treated, if required, before engaging them to work<br />

at the site.<br />

Disinfection of wastewater shall be done with UV unit.<br />

All the topsoil excavated during construction activities should be stored for<br />

use in horticulture / landscape development within the project site.<br />

Disposal of muck during construction phase should not create any adverse<br />

effect on the neighboring communities and be disposed off after taking the<br />

necessary precautions for general safety and health aspects of people with<br />

the approval of competent authority.<br />

x) Construction spoils, including bituminous material and other hazardous<br />

material, must not be allowed to contaminate watercourses and the dump<br />

sites for such material must be secured, so that they should not leach into<br />

the ground water.<br />

The diesel generator sets to be used during construction phase should be<br />

of low sulphur diesel type and should conform to the provisions of<br />

<strong>Environment</strong> (Protection) Act, 1986 prescribed for air and noise emission<br />

standards.<br />

Vehicles hired for bringing construction material to the site should be in<br />

good condition and should conform to applicable air and noise emission<br />

standards and should be operated only during non peak hours.<br />

Ambient noise levels should conform to prescribed standards both during<br />

day and night. Incremental pollution loads on the ambient air and noise<br />

quality should be closely monitored during construction phase.<br />

Fly ash should be used as construction material in the construction as per<br />

the provisions of Fly Ash Notification of September, 1999 and as amended<br />

on August, <strong>20</strong>03 (The above condition is applicable only if the project is<br />

within 100 Km of Thermal Power Station).<br />

Ready mixed concrete must be used in building construction.<br />

Water demand during construction should be reduced by use of premixed<br />

concrete, curing agents and other best practices referred.<br />

Separation of drinking water supply and treated sewage supply should be<br />

done by the use of dual plumbing line of different colours for separation of<br />

drinking water and treated sewage.<br />

xviii) Fixtures for showers, toilet flushing and drinking should be of low flow<br />

either by use of aerators or pressure reducing devices or sensor based<br />

control.<br />

Use of glass may be reduced up to 40% to reduce the electricity<br />

consumption and load on air-conditioning. If necessary, use high quality<br />

double glass with special reflective coating in windows.<br />

Roof should meet prescriptive requirement as per Energy Conservation<br />

Building Code by using appropriate thermal insulation material to fulfill<br />

requirement.<br />

Opaque wall should meet prescriptive requirement as per Energy<br />

Conservation Building Code which is proposed to be mandatory for all air<br />

conditioned spaces while it is aspirational for non air-conditioned spaces by<br />

use of appropriate thermal insulation material to fulfill requirement.<br />

The approval of competent authority shall be obtained for structural safety<br />

of the buildings due to earthquakes, adequacy of fire fighting equipments<br />

etc. as per National Building Code including protection measures from<br />

lightening.<br />

xxiii) Provisions shall be made for the housing of construction labour within the<br />

site with all necessary infrastructure and facilities such as fuel for cooking,<br />

mobile toilets, mobile STP, Safe drinking water, medical health care, crèche<br />

etc. The housing may be in the form to temporary structure to be removed<br />

after the completion of the project.<br />

II. Operation Phase<br />

i) The installation of sewage treatment plant (STP) and adequacy of disposal<br />

system should be certified by Punjab Pollution Control Board and a report in<br />

this regard should be submitted to the Ministry of <strong>Environment</strong> &<br />

Forests/<strong>State</strong> <strong>Level</strong> <strong>Environment</strong> <strong>Impact</strong> <strong>Assessment</strong> <strong>Authority</strong> before the<br />

project is commissioned for operation. The discharge of treated sewage<br />

shall conform to the norms and standards prescribed by Punjab Pollution<br />

Control Board for such discharges. There shall be no discharge of treated<br />

wastewater outside the premises of the project/complex.<br />

ii)<br />

Adequate & appropriate pollution control measures should be provided to<br />

control fugitive emissions to be emitted within the commercial complex.<br />

iii) Adequate treatment facility for drinking water shall be provided, if<br />

required.<br />

iv)<br />

Rainwater harvesting for roof run-off should be implemented. Before<br />

recharging the roof run-off, pretreatment must be done to remove<br />

suspended matter, oil and grease. However, no run off from gardens/green<br />

area be connected with the ground water recharging system.<br />

v) The solid waste generated should be properly collected and segregated.<br />

The recyclable solid waste shall be sold out to the authorized vendors and<br />

inerts shall be sent to disposal facility. The Bio-degradable solid waste shall<br />

be treated on-site composting facility. Prior approval of competent authority<br />

should be obtained, if required.<br />

Hazardous waste/E-waste should be disposed off as per Rules applicable<br />

and with the necessary approvals of the Punjab Pollution Control Board.<br />

The green belt design along the periphery of the plot shall achieve<br />

attenuation factor conforming to the day and night noise standards<br />

prescribed for residential land use. The open spaces inside the plot should<br />

be suitably landscaped and covered with vegetation of indigenous variety.<br />

Separate distribution pipelines be laid down for use of treated effluent for<br />

horticultural/gardening purpose with different colour coding.<br />

The project proponent should take adequate and appropriate measures to<br />

contain the ambient air quality with in the prescribed standards. The<br />

proposal regarding mitigation measures to be taken at site should be<br />

submitted to the Ministry of <strong>Environment</strong> & Forests/ <strong>State</strong> <strong>Level</strong><br />

<strong>Environment</strong> <strong>Impact</strong> <strong>Assessment</strong> <strong>Authority</strong> within 3 months.<br />

x) Incremental pollution loads on the ambient air quality, noise and water<br />

quality should be periodically monitored after commissioning of the project.<br />

Application of solar energy should be incorporated for illumination of<br />

common areas, lighting for gardens and street lighting in addition to<br />

provision for solar water heating.<br />

Traffic congestion near the entry and exit points from the roads adjoining<br />

the proposed project site must be avoided. Parking should be fully<br />

internalized and no public space should be utilized.<br />

A report on the energy conservation measures conforming to energy<br />

conservation norms finalized by Bureau of Energy Efficiency should be<br />

prepared incorporating details about machinery of air conditioning, lifts,<br />

lighting, building materials, R & U Factors etc. and submitted to the Ministry<br />

of <strong>Environment</strong> & Forests/SEAC in three months time.<br />

<strong>Environment</strong> Management Cell shall be formed during operation phase<br />

which will supervise and monitor the environment related aspects of the<br />

project.<br />

PART B – General Conditions :<br />

i) This environmental clearance will be valid for a period of five years from<br />

the date of its issue or till the completion of the project, whichever is<br />

earlier.<br />

The environmental safeguards contained in the application of the promoter<br />

/ mentioned during the presentation before <strong>State</strong> <strong>Level</strong> <strong>Environment</strong><br />

<strong>Impact</strong> <strong>Assessment</strong> <strong>Authority</strong>/<strong>State</strong> Expert Appraisal Committee should be<br />

implemented in letter and spirit.<br />

The entire cost of the environmental management plan (i.e. capital cost as<br />

well as recurring cost) will continue to be borne by the project proponent<br />

until the responsibility of environmental management plan is transferred to<br />

the occupier/residents society under proper MOU.<br />

The project proponent shall also submit six monthly reports on the status of<br />

compliance of the stipulated EC conditions including results of monitored<br />

data (both in hard copies as well as by mail) to the respective Regional<br />

office of MoEF, the respective Zonal Office of CPCB and the SPCB/SEIAA.<br />

v) Officials from the Regional Office of Ministry of <strong>Environment</strong> & Forests,<br />

Chandigarh / <strong>State</strong> <strong>Level</strong> <strong>Environment</strong> <strong>Impact</strong> <strong>Assessment</strong> <strong>Authority</strong> / <strong>State</strong><br />

<strong>Level</strong> Expert Appraisal Committee / Punjab Pollution Control Board who<br />

would be monitoring the implementation of environmental safeguards<br />

should be given full cooperation, facilities and documents / data by the<br />

project proponents during their inspection. A complete set of all the<br />

documents submitted to <strong>State</strong> <strong>Environment</strong> <strong>Impact</strong> <strong>Assessment</strong> <strong>Authority</strong><br />

should be forwarded to the CCF, Regional Office of Ministry of <strong>Environment</strong><br />

& Forests, Chandigarh/<strong>State</strong> <strong>Level</strong> <strong>Environment</strong> <strong>Impact</strong> <strong>Assessment</strong><br />

<strong>Authority</strong>.<br />

In the case of any change(s) in the scope of the project, the project would<br />

require a fresh appraisal by <strong>State</strong> <strong>Environment</strong> <strong>Impact</strong> <strong>Assessment</strong><br />

The <strong>State</strong> <strong>Environment</strong> <strong>Impact</strong> <strong>Assessment</strong> <strong>Authority</strong> reserves the right to<br />

add additional safeguard/ measures subsequently, if found necessary, and<br />

to take action including revoking of the environmental clearance under the<br />

provisions of the <strong>Environment</strong>al (Protection) Act, 1986, to ensure effective<br />

implementation of the suggested safeguard/ measures in a time bound and<br />

satisfactory manner.<br />

All other statutory clearances such as the approvals for storage of diesel<br />

from Chief Controller of Explosives, Fire Department, Civil Aviation<br />

Department, Forest (Conservation) Act, 1980 and Wildlife (Protection) Act,<br />

1972 etc. shall be obtained, by project proponents from the competent<br />

authorities including Punjab Pollution Control Board and from other<br />

statutory bodies as applicable.<br />

The project proponent should advertise in at least two local newspapers<br />

widely circulated in the region, one of which shall be in the vernacular<br />

language informing that the project has been accorded environmental<br />

clearance and copies of clearance letters are available with the Punjab<br />

Pollution Control Board. The advertisement should be made within seven<br />

days from the day of issue of the clearance letter and a copy of the same<br />

Resources in the permission granted vide the letter no. 408 dated<br />

15.4.<strong>20</strong>11 for abstraction of 1<strong>05</strong> KLD of groundwater.<br />

Any appeal against this environmental clearance shall lie with the National<br />

<strong>Environment</strong> Appellate <strong>Authority</strong>, if preferred, within a period of 30 days as<br />

prescribed under section 11 of the National <strong>Environment</strong> Appellate Act,<br />

1987.<br />

Sh. Rajesh Gupta, General Manager of the promoter<br />

company attended the meeting of SEIAA on <strong>20</strong>.5.<strong>20</strong>11 and he replied<br />

the queries of the SEIAA. After detailed deliberations in the matter, the<br />

<strong>Authority</strong> observed that the condition no. iv, v, vi, vii, xix, xx & xxi of<br />

Construction Phase are not in order, therefore, these conditions are not<br />

required to be imposed in the environmental clearance to be granted to<br />

the project proponent.<br />

The <strong>Authority</strong> observed that the case stands recommended<br />

by the SEAC and looked into all aspects of the project proposal in detail<br />

and was satisfied with the same, therefore, the <strong>Authority</strong> decided to<br />

grant environmental clearance to the project proponent subject to the<br />

following conditions, in addition to the proposed measures:<br />

outlet of the water supply, outlet of the STP and any pipeline to be used for<br />

re-using the treated wastewater back into the system for flushing / HVAC<br />

and for horticulture purpose etc. and shall maintain a record of readings of<br />

each such meter on daily basis.<br />

Adequate & appropriate pollution control measures should be provided to<br />

control fugitive emissions to be emitted within the commercial complex.<br />

Adequate treatment facility for drinking water shall be provided, if required.<br />

v) Rainwater harvesting for roof run-off should be implemented. Before<br />

recharging the roof run-off, pretreatment must be done to remove<br />

suspended matter, oil and grease. However, no run off from gardens/green<br />

area/roads/pavements shall be connected with the ground water recharging<br />

system.<br />

The solid waste generated should be properly collected and segregated.<br />

The recyclable solid waste shall be sold out to the authorized vendors and<br />

inerts shall be sent to disposal facility. The Bio-degradable solid waste shall<br />

be adequately treated as per the scheme submitted by the project<br />

proponent. Prior approval of competent authority should be obtained, if<br />

required.<br />

Hazardous waste/E-waste should be disposed off as per Rules applicable<br />

and with the necessary approval of the Punjab Pollution Control Board.<br />

The green belt design along the periphery of the plot shall achieve<br />

attenuation factor conforming to the day and night noise standards<br />

prescribed for residential land use. The open spaces inside the plot should<br />

be suitably landscaped and covered with vegetation of indigenous<br />

species/variety.<br />

The project proponent should take adequate and appropriate measures to<br />

contain the ambient air quality with in the prescribed standards. The<br />

proposal regarding mitigation measures to be taken at site should be<br />

submitted to the Ministry of <strong>Environment</strong> & Forests/ <strong>State</strong> <strong>Level</strong><br />

<strong>Environment</strong> <strong>Impact</strong> <strong>Assessment</strong> <strong>Authority</strong> within three months.<br />

x) Incremental pollution loads on the ambient air quality, noise and water<br />

quality should be periodically monitored after commissioning of the project.<br />

Application of solar energy should be incorporated for illumination of<br />

common areas, lighting for gardens and street lighting in addition to<br />

provision for solar water heating.<br />

Traffic congestion near the entry and exit points from the roads adjoining<br />

the proposed project site must be avoided. Parking should be fully<br />

internalized and no public space should be utilized.<br />

A report on the energy conservation measures conforming to energy<br />

conservation norms finalized by Bureau of Energy Efficiency should be<br />

prepared incorporating details about machinery of air conditioning, lifts,<br />

lighting, building materials, R & U Factors etc. and submitted to the<br />

respective Regional office of MoEF, the Zonal Office of CPCB and the<br />

SPCB/SEIAA in three months time.<br />

<strong>Environment</strong> Management Cell shall be formed during operation phase<br />

which will supervise and monitor the environment related aspects of the<br />

project.<br />

PART B – General Conditions :<br />

i) This environmental clearance will be valid for a period of five years from<br />

the date of its issue or till the completion of the project, whichever is<br />

earlier.<br />

The environmental safeguards contained in the application of the promoter<br />

/ mentioned during the presentation before <strong>State</strong> <strong>Level</strong> <strong>Environment</strong><br />

<strong>Impact</strong> <strong>Assessment</strong> <strong>Authority</strong>/<strong>State</strong> Expert Appraisal Committee should be<br />

implemented in letter and spirit.<br />

The entire cost of the environmental management plan (i.e. capital cost as<br />

well as recurring cost) will continue to be borne by the project proponent<br />

until the responsibility of environmental management plan is transferred to<br />

the occupier/residents society under proper MOU.<br />

The project proponent shall also submit six monthly reports on the status of<br />

compliance of the stipulated EC conditions including results of monitored<br />

data (both in hard copies as well as by mail) to the respective Regional<br />

office of MoEF, the Zonal Office of CPCB and the SPCB/SEIAA.<br />

v) Officials from the Regional Office of Ministry of <strong>Environment</strong> & Forests,<br />

Chandigarh / <strong>State</strong> <strong>Level</strong> <strong>Environment</strong> <strong>Impact</strong> <strong>Assessment</strong> <strong>Authority</strong> / <strong>State</strong><br />

<strong>Level</strong> Expert Appraisal Committee / Punjab Pollution Control Board who<br />

would be monitoring the implementation of environmental safeguards<br />

should be given full cooperation, facilities and documents / data by the<br />

project proponents during their inspection. A complete set of all the<br />

documents submitted to <strong>State</strong> <strong>Environment</strong> <strong>Impact</strong> <strong>Assessment</strong> <strong>Authority</strong><br />

should be forwarded to the CCF, Regional Office of Ministry of <strong>Environment</strong><br />

& Forests, Chandigarh/<strong>State</strong> <strong>Level</strong> <strong>Environment</strong> <strong>Impact</strong> <strong>Assessment</strong><br />

<strong>Authority</strong>.<br />

In the case of any change(s) in the scope of the project, the project would<br />

require a fresh appraisal by <strong>State</strong> <strong>Environment</strong> <strong>Impact</strong> <strong>Assessment</strong><br />

<strong>Authority</strong>.<br />

Separate distribution pipelines be laid down for use of treated effluent / raw<br />

water for horticultural/gardening purposes with different colour coding.<br />

All other statutory clearances such as the approvals for storage of diesel<br />

from Chief Controller of Explosives, Fire Department, Civil Aviation<br />

Department, Forest (Conservation) Act, 1980 and Wildlife (Protection) Act,<br />

1972 etc. shall be obtained, by project proponents from the competent<br />

authorities including Punjab Pollution Control Board and from other<br />

statutory bodies as applicable.<br />

The project proponent should advertise in at least two local newspapers<br />

widely circulated in the region, one of which shall be in the vernacular<br />

language informing that the project has been accorded environmental<br />

clearance and copies of clearance letters are available with the Punjab<br />

Pollution Control Board. The advertisement should be made within seven<br />

days from the day of issue of the clearance letter and a copy of the same<br />

should be forwarded to the Regional Office, Ministry of <strong>Environment</strong> &<br />

Forests, Chandigarh.<br />

x) These stipulations would be enforced among others under the provisions of<br />

Water (Prevention & Control of Pollution) Act, 1974, Air (Prevention &<br />

Control of Pollution) Act, 1981, <strong>Environment</strong>al (Protection) Act, 1986, the<br />

Public Liability (Insurance) Act, 1991 and EIA Notification, <strong>20</strong>06.<br />

<strong>Environment</strong>al clearance is subject to final order of the Hon'ble Supreme<br />

Court of India in the matter of Goa Foundation Vs. Union of India in Writ<br />

Petition (Civil) No. 460 of <strong>20</strong>04 as may be applicable to this project and<br />

decisions of any competent court, to the extent applicable.<br />

A copy of the clearance letter shall be sent by the proponent to concerned<br />

Panchayat, Zilla Parishad/ Municipal Corporation, Urban local body and the<br />

local NGO, if any, from whom suggestions / representations, if any, were<br />

received while processing the proposal. The clearance letter shall also be<br />

put on the website of the Company by the proponent.<br />

The proponent shall upload the status of compliance of the stipulated EC<br />

conditions, including results of monitored data on their website and shall<br />

update the same periodically. It shall simultaneously be sent to the<br />

Regional Office of MoEF, the respective Zonal Office of CPCB and the SPCB.<br />

The criteria pollutant levels namely; PM 2.5 , PM 10 , SO 2 , NO x , CO, Pb, Ozone<br />

(ambient air as well as stack emissions) shall be monitored and displayed at<br />

a convenient location near the main gate of the company in the public<br />

domain.<br />

The project proponent shall comply with the conditions imposed by the<br />

Govt. of India, Central Ground Water <strong>Authority</strong>, Ministry of Water<br />

Resources in the permission granted vide the letter no. 408 dated<br />

15.4.<strong>20</strong>11 for abstraction of 1<strong>05</strong> KLD of groundwater.<br />

The <strong>State</strong> <strong>Environment</strong> <strong>Impact</strong> <strong>Assessment</strong> <strong>Authority</strong> reserves the right to<br />

add additional safeguards/ measures subsequently, if found necessary, and<br />

to take action including revoking of the environmental clearance under the<br />

provisions of the <strong>Environment</strong>al (Protection) Act, 1986, to ensure effective<br />

implementation of the suggested safeguards/ measures in a time bound<br />

and satisfactory manner.<br />

Any appeal against this environmental clearance shall lie with the National<br />

<strong>Environment</strong> Appellate <strong>Authority</strong>, if preferred, within a period of 30 days as<br />

prescribed under section 11 of the National <strong>Environment</strong> Appellate Act,<br />

1987.<br />

Item No. SEIAA/31.12 Application for obtaining environmental<br />

clearance under EIA Notification for increase in<br />

the production capacity of existing cement<br />

grinding unit from 75 TPD to 150 TPD of M/s<br />

Shri Bala Ji Cement Industries, in the revenue<br />

estate of Village Jai Singh Wala, Bagha Purana,<br />

Distt. Moga.<br />

The <strong>Authority</strong> observed that:<br />

1. M/s Shri Bala Ji Cement Industries has applied for obtaining environmental<br />

clearance as required under EIA Notification dated 14.9.<strong>20</strong>06 for increase in<br />

the production capacity of existing cement grinding unit from 75 TPD to<br />

150 TPD located in the revenue estate of Village Jai Singh Wala, Bagha<br />

Purana, Distt. Moga. The project of the promoter pertains to category 'B'<br />

and it falls under category 3 (b) of the Schedule appended to the said<br />

notification.<br />

2. Presently, the Industry is engaged in the business of producing 75 TPD of<br />

cement by way of grinding process. The industry has proposal to install one<br />

more ball mill to increase the production of cement from 75 TPD to 150<br />

TPD.<br />

3. The industry has installed its own tubewell for abstraction of 1.5 KLD water<br />

required for domestic purpose.<br />

4. The domestic effluent is discharged onto land for plantation after passing<br />

through septic tank.<br />

5. The existing grinding and mixing sections are equipped with bag filter<br />

house as APCD and the industry has proposal to install separate bag filter<br />

house as APCD for the additional ball mill to be installed.<br />

6. Ambient air quality of the area has been monitored at 7 stations, the results<br />

of which are as under:<br />

7. <strong>Impact</strong> on the ambient air quality due to increase in the capacity of existing<br />

industrial plant through ISC-ST-3 Air dispersion model was assessed by the<br />

consultant of the industry and he calculated that the maximum increase in<br />

the concentration of particulate matter in the ambient air will be 1.5 g/m 3 ,<br />

therefore, the conc. of particulate matter in the ambient air will remain<br />

within the prescribed standards even after increase in the capacity of<br />

existing cement grinding unit.<br />

8. Green belt along the boundary wall and within the industry in the open<br />

space will be provided in an area of 1416 sq. m.<br />

9. The case was considered by the SEAC in its 47 th meeting held on<br />

6.5.<strong>20</strong>11,which was attended by the<br />

partner of the industry and its<br />

consultant to present their case.The SEAC looked into the proceedings of<br />

the public hearing conducted by the Punjab Pollution Control Board on<br />

3.1.<strong>20</strong>11 and it has been noted that the said public hearing was attended<br />

by 94 persons, out of which more than 90% were in favour of expansion of<br />

the existing unit. The Committee also looked into 5 complaints received<br />

after conducting the public hearing in which it has been stated that the<br />

existing unit of the industry is causing air pollution in the area.<br />

Committee observed that the project proponent has provided adequate and<br />

satisfactory clarifications of the observations raised by it, therefore, it was<br />

decided to forward the case to the SEIAA, with the recommendation to<br />

grant environmental clearance to the project proponent subject to the<br />

following conditions, in addition to the proposed measures:<br />

A. SPECIFIC CONDITIONS :<br />

i. All other necessary statutory clearances from the concerned<br />

Departments including consent to establish/operate from the Punjab<br />

Pollution Control Board shall be obtained prior to commencement of<br />

construction and / or operation.<br />

ii.<br />

The<br />

Adequate pollution control measures and energy efficient technology<br />

shall be provided to control emissions from various sources within the<br />

limits prescribed.<br />

iii.<br />

Bag house and bag filters shall be provided to contain particulate matter<br />

concentration from various units within the limits prescribed by the<br />

Punjab Pollution Control Board. Interlocking facility shall be provided in<br />

the pollution control equipment, so that, in the event of the pollution<br />

control equipment not working, the respective unit (s) is shut down<br />

automatically.<br />

iv.<br />

The National Ambient Air Quality Emission Standards issued by the<br />

Ministry vide G.S.R. No. 826(E) dated 16 th November, <strong>20</strong>09 shall be<br />

followed. Ambient air quality monitoring (AAQM) stations shall be set up<br />

as per statutory requirement in consultation with the Punjab <strong>State</strong><br />

Pollution Control Board and relevant parameters including noise levels<br />

shall not exceed the standards stipulated under EPA or by the <strong>State</strong><br />

authorities. Monitoring of ambient air quality and stack emissions shall<br />

be carried out regularly in consultation with PPCB and reports submitted<br />

to the Board quarterly and to the Ministry's Regional Office at<br />

Chandigarh/SEIAA, Punjab, half-yearly.<br />

v. The fugitive emissions during loading and unloading shall be suitably<br />

controlled. The company shall install adequate dust collection and<br />

extraction system to control fugitive dust emissions at various transfer<br />

points. The dust collected from the pollution control equipment shall be<br />

recycled back into the process. Storage of raw material shall be in<br />

closed roof sheds. Dust suppression and containment system be<br />

provided in raw material stock yard and cement bag loading areas.<br />

vi.<br />

Secondary fugitive emissions shall be controlled and shall be within the<br />

prescribed limits and regularly monitored. Guidelines / Code of Practice<br />

issued by the CPCB/PPCB in this regard shall be followed.<br />

vii.<br />

<strong>Impact</strong> of transport system due to movement of raw material and<br />

finished products on the surrounding environment shall be assessed and<br />

all the necessary precautions shall be taken to control dust emissions.<br />

Transportation of raw materials shall be in covered means.<br />

Total water requirement shall not exceed 1.5 m 3 /day and prior<br />

permission shall be obtained from the concerned department. No<br />

wastewater shall be discharged outside the factory premises and 'zero'<br />

discharge shall be strictly followed. The domestic wastewater shall be<br />

treated in septic tank and used for irrigation of green belt within the<br />

premises.<br />

ix.<br />

Rainwater harvesting measures shall be adopted to replenish the<br />

groundwater only by collecting run-off from the roof top.<br />

x. All the solid waste viz. fly ash and dust etc. shall be properly recycled<br />

and reutilized in the process itself. The sludge from the septic tank shall<br />

be used as manure for green belt development after appropriate<br />

treatment. Used/spent oil shall be sold to authorized recyclers<br />

/reprocessors only.<br />

As proposed, green belt shall be developed in at least 1416 m 2 out of<br />

total 4046.8 m 2 area within the plant premises to mitigate the impact of<br />

emissions on the surrounding environment as per the Central Pollution<br />

Control Board guidelines in consultation with local DFO.<br />

Proper house keeping and adequate occupational health programmes<br />

shall be taken up.<br />

xiii. All the recommendations made in the Charter on Corporate<br />

Responsibility for <strong>Environment</strong> Protection (CREP) for the Cement Plants<br />

shall be implemented.<br />

xiv. The company shall undertake eco-development measures including<br />

community welfare measures in the project area.<br />

B. GENERAL CONDITIONS :<br />

i) The project authority shall adhere to the stipulations laid down by<br />

Punjab Pollution Control Board and <strong>State</strong> Government.<br />

No further expansion or modification of the plant shall be carried out<br />

without prior approval of the Competent <strong>Authority</strong>.<br />

The gaseous (SPM, SO 2 , NO X , CO) and particulate matter emissions from<br />

various units shall conform to the standards prescribed by the Punjab<br />

Pollution Control Board. At no time, particulate emissions from the<br />

cement plant shall exceed the prescribed standards. Continuous on-line<br />

monitors for particulate emissions shall be installed. Inter-locking facility<br />

shall be provided in the pollution control equipment so that in the event<br />

of the pollution control equipment not working, the respective unit(s) is<br />

shut down automatically.<br />

Industrial wastewater shall be properly collected and treated so as to<br />

conform to the standards prescribed under GSR 422 (E) dated 19 th May,<br />

1993 and 31 st December, 1993 or as amended from time to time. The<br />

treated wastewater shall be utilized for plantation purpose.<br />

v) The overall noise levels in and around the plant area within the premises<br />

shall be kept well within the standards (85 dBA) by providing noise<br />

control measures including acoustic hoods, silencers, enclosures etc. on<br />

all sources of noise generation. The ambient noise levels shall conform<br />

to the standards prescribed under <strong>Environment</strong>al (Protection) Act, 1986<br />

Rules, 1989 viz. 75 dBA (day time) and 70 dBA (night time).<br />

Proper housekeeping and adequate occupational health programmes<br />

must be taken up. Occupational Health Surveillance programme shall be<br />

done on a regular basis and records maintained properly for at least 30-<br />

40 years. The programme must include lung function and sputum<br />

analysis tests once in six months. Sufficient preventive measures shall be<br />

adopted to avoid direct exposure to dust etc.<br />

The company shall undertake eco-development measures including<br />

community welfare measures in the project area.<br />

viii)<br />

The project proponent shall also comply with all the environmental<br />

protection measures and safeguards recommended in the EIA/ EMP.<br />

ix)<br />

As proposed, Rs 12.00 Lakhs and Rs. 2.<strong>20</strong> Lakhs shall be allocated<br />

towards environment management plan and recurring cost/annum,<br />

respectively and use exclusively to implement the conditions stipulated<br />

by the Ministry of <strong>Environment</strong> and Forests as well as the <strong>State</strong><br />

Government. Time bound implementation schedule for implementing all<br />

the conditions stipulated herein shall be submitted to the Ministry's<br />

Regional Office at Chadigarh/SEIAA, Punjab. The funds so provided shall<br />

not be diverted for any other purpose.<br />

x) A separate environmental management cell with full fledged laboratory<br />

facilities to carry out various management and monitoring functions<br />

shall be set up under the control of Senior Executive.<br />

The Regional Office of the Ministry at Chandigarh/ Central Pollution<br />

Control Board, Lucknow/ Punjab Pollution Control Board shall monitor<br />

the stipulated conditions. A six monthly compliance report and the<br />

monitored data alongwith statistical interpretation shall be submitted to<br />

them regularly.<br />

A copy of clearance letter shall be sent by the proponent to concerned<br />

Panchayat, Zila Parishad / Municipal Corporation, Urban Local Body and<br />

the local NGO, if any, from whom suggestions / representations, if any,<br />

were received while processing the proposal. The clearance letter shall<br />

also be put on the web site of the company by the proponent.<br />

The project proponent shall upload the status of compliance of the<br />

stipulated environment clearance conditions, including results of<br />

monitoring data on their website and shall update the same periodically.<br />

It shall simultaneously be sent to the Regional Office of the MOEF, the<br />

respective Zonal Office of CPCB and the PPCB. The criteria pollutant<br />

levels namely; SPM, RSPM, SO 2 , NOx (ambient levels as well as stack<br />

emissions) shall be monitored and displayed at a convenient location<br />

near the main gate of the company in the public domain.<br />

The project proponent shall also submit six monthly reports on the<br />

status of the compliance of the stipulated environmental conditions<br />

including results of monitoring data (both in hard copies as well as by e-<br />

mail) to the Regional Office of MOEF, the respective Zonal Office of<br />

CPCB and the PPCB. The Regional Office of this Ministry / CPCB / PPCB<br />

shall monitor the stipulated conditions.<br />

The environmental statement for each financial year ending 31 st March<br />

on Form-V as is mandated to be submitted by the project proponent to<br />

the concerned <strong>State</strong> Pollution Control Board as prescribed under the<br />

<strong>Environment</strong> (Protection) Rules, 1986, as amended subsequently, shall<br />

also be put on the website of the company alongwith the status of<br />

compliance of environmental conditions and shall also be sent to the<br />

respective Regional Offices of the MOEF/SEIAA, Punjab by e-mail.<br />

The Project Proponent shall inform the public that the project has been<br />

accorded environmental clearance by the SEIAA, Punjab and copies of<br />

the clearance letter are available with the PPCB and may also be seen at<br />

Website of the SEIAA at http:/seiaapunjab.co.in. This shall be advertised<br />

within seven days from the date of issue of the clearance letter, at least<br />

in two local newspapers that are widely circulated in the region of which<br />

one shall be in the vernacular language of the locality concerned and a<br />

copy of the same should be forwarded to the Regional office.<br />

Project authorities shall inform the Regional Office as well as the<br />

Ministry/SEIAA, Punjab, the date of financial closure and final approval<br />

of the project by the concerned authorities and the date of commencing<br />

the land development work.<br />

xviii) This environmental clearance will be valid for a period of five years from<br />

the date of its issue or till the completion of the project, whichever is<br />

earlier.<br />

The <strong>Authority</strong> observed that the case stands recommended by<br />

the SEAC and looked into all aspects of the project proposal in detail and was<br />

satisfied with the same, therefore, the <strong>Authority</strong> decided to grant environmental<br />

clearance to the project proponent subject to the conditions recommended by the<br />

SEAC, in addition to the proposed measures.<br />
