e) The project proponent shall place the matter before the Board of Directors of the Company for starting construction work of the project in violation of the provisions of the EIA Notification framed under the Environment (Protection) Act, 1986 and shall submit a written commitment in the form of a formal resolution to the SEIAA to the effect that the violation of Environment (Protection) Act, 1986 will not be repeated in future. Sh. Yash Pal Jain requested for 15days time to submit the reply to the aforesaid observations of the Authority. The Authority agreed to accept the request of the project proponent and decided to defer the case till the proper reply of all the observations is received. Item No. SEIAA/31.09: Application for Environmental Clearance for developing a Residential Group Housing Project namely „DD Mittal Towers" at Multania Road, Bathinda by M/s BCL Industries & Infrastructure Ltd. The SEIAA observed that: 1. M/s BCL Industries & Infrastructure Ltd has applied for obtaining environmental clearance for developing a Residential Group Housing Project namely „DD Mittal Towers" at Multania Road, Bathinda as required under EIA Notification dated 14.9.2006. The total plot area of the proposed project is 16274.27 Sq. m, which has been allotted by PIDB and has submitted a copy of the allotment letter as an evidence in this regard. The site of the project falls within M.C. limits of Bathinda and is for mixed land use. Total built up area will be 48820 Sq. m. and the project of the promoter is covered under category 8 (a) of the Schedule appended to the said notification. 2. The case was considered by the SEAC in its 46 th meeting held on 24.4.2011 and the Committee observed that the project proponent has provided adequate and satisfactory clarifications of the observations raised by it, therefore, the Committee awarded 'Bronze Grading' to the project proposal and decided to forward the case to the SEIAA, with the recommendation to grant environmental clearance to the project proponent subject to certain conditions alongwith following condition in addition to the proposed measures . 34
"The project proponent shall not install any tubewell for abstraction of groundwater required at the construction as well as operation stage of the project since the project proponent has mentioned in the application / presented before the Committee that the entire requirement of water will be met from the M.C. Water supply". The project proponent was requested vide letter No. 1765 dated 17.5.2011 to attend the 31 st meeting of SEIAA on 20.5.2011 to present the project proposal. Following were present in the meeting of SEIAA held on 20.5.2011 on behalf of the project proponent to present the project proposal. 1. Sh. K.M. Gupta, GM of the promoter company 2. Sh. Yashpal Jain, Environmental Consultant, M/s Ace Engineers & Consultants, Patiala. Sh. Yashpal Jain of M/s Ace Engineers & Consultants, Patiala, who is the Environmental Consultant for the project proponent and the name of his consultancy firm figures at Sr. no. 153 of the list uploaded by the MoEF at its official website, informed that:- 1. A tubewell will be installed to meet with the requirement of water during construction stage and this tubewell will also be used to meet with the requirement of water during the period of failure of Municipal water supply in operation phase. 2. The Bathinda block comes under safe category as per letter issued by the CGWA in case of M/s PACL India Ltd., for its residential township being developed in Bathinda block, as such, no permission is required to be obtained for abstraction of ground water since this site is also located in the said block. 3. R.O. Plant will be installed to treat the ground water since the quantity of ground water of Bathinda Block is not potable in nature. The R.O. reject will be mixed with treated wastewater. 4. The wastewater will be treated in a S.T.P. consisting of oil/grease trap, collection tank, primary clarifier, aeration tank, secondary clarifier, sand filter, ozonation and sludge drying beds will be provided to treat the wastewater. The treated wastewater will be utilized for flushing purpose, HVAC, horticulture and remaining will be discharged into sewer. 35
