c. The resident’s condition requires twenty-four (24) hour nursing care as<br />

defined in Section 300;<br />

d. The resident’s behavior or condition poses an immediate threat to the<br />

health or safety of self or others;<br />

e. The resident or his or her responsible party refuses to cooperate in an<br />

examination by a physician or advance practice nurse or licensed<br />

psychologist of his or her own choosing to determine the resident’s health<br />

or mental status <strong>for</strong> the purpose of establishing appropriateness <strong>for</strong><br />

retention or termination;<br />

f. The resident’s fees have not been paid, provided the resident or his or her<br />

responsible party was notified <strong>and</strong> given thirty (30) days to pay any<br />

deficiency;<br />

g. The resident or his or her responsible party refuses to enter into a<br />

negotiated compliance agreement, refuses to revise the compliance<br />

agreement when there is a documented medical reason <strong>for</strong> the need of a<br />

negotiated compliance agreement or revision thereto, or refuses to comply<br />

with the terms of the compliance agreement (See Section 704, Compliance<br />

Agreements);<br />

h. Other written conditions as may be mutually established between the<br />

resident or his or her responsible party <strong>and</strong> the <strong>assisted</strong> <strong>living</strong> facility at<br />

the time of admission or any time thereafter.<br />

603 BILL OF RIGHTS<br />

603.1 Residents’ Bill of Rights<br />

1. Each <strong>assisted</strong> <strong>living</strong> facility must post the Residents’ Bill of Rights, as<br />

provided by the Department, in a prominent place in the facility. The<br />

Residents’ Bill of Rights must prominently display the toll-free number<br />

<strong>for</strong> contacting the Office of Long Term Care <strong>and</strong> filing a complaint, or the<br />

facility must post the number <strong>and</strong> its purpose beside the Residents’ Bill of<br />

Rights. Further, the facility shall prominently display the contact<br />

in<strong>for</strong>mation <strong>for</strong> the State Ombudsman’s office. A copy of the Residents’<br />

Bill of Rights must be given to each resident in a manner <strong>and</strong> <strong>for</strong>m<br />

comprehendible to the resident or his or her responsible party.<br />

2. A resident has all the rights, benefits, responsibilities, <strong>and</strong> privileges<br />

granted by the constitution <strong>and</strong> laws <strong>and</strong> <strong>regulations</strong> of this state <strong>and</strong> the<br />

United States except where lawfully restricted. The resident has the right<br />

to be free of interference, coercion, discrimination, or reprisal in<br />
