Water Resources<br />

1. NS shall obtain all necessary Federal, state, and local permits if construction activities require<br />

the alteration of wetlands, ponds, lakes, streams, or rivers, or if these activities would cause soil<br />

or other materials to wash into these water resources. NS shall use appropriate techniques to<br />

minimize impacts to water bodies and wetlands.<br />

Biological Resources<br />

1. NS shall use BMPs to control erosion, runoff, and surface instability during construction,<br />

including seeding, fiber mats, straw mulch, plastic liners, slope drains, and other erosion control<br />

devices. Once the track is constructed, NS shall establish vegetation on the embankment slope<br />

to provide permanent cover and prevent potential erosion. If erosion develops, NS shall take<br />

steps to develop other appropriate erosion control procedures.<br />

2. NS shall use only EPA-approved herbicides and qualified contractors for application of right-ofway<br />

maintenance herbicides, and shall limit such application to the extent necessary for rail<br />

operations.<br />

Air Quality<br />

Noise<br />

1. NS shall comply with all applicable Federal, state, and local regulations regarding the control<br />

of fugitive dust. Fugitive dust emissions created during construction shall be minimized by<br />

using such control methods as water spraying, installation of wind barriers, and chemical<br />

treatment.<br />

1. NS shall control temporary noise from construction equipment through the use of work hour<br />

controls and maintenance of muffler systems on machinery.<br />

Cultural Resources<br />

1. In those cases where historic resources would be adversely affected, NS shall not undertake<br />

construction activities until the Section 106 of the National Historic Preservation Act (16 U.S.C.<br />

470f., as amended) review process is completed. If previously undiscovered archaeological<br />

remains are found during construction, NS shall cease work and immediately contact the <strong>Ohio</strong><br />

SHPO to initiate the appropriate Section 106 process.<br />

Energy<br />

1. There are no impacts to mitigation; therefore, there are no proposed mitigation measures.<br />
