HOW TO DO FORMAL CAPTIONS FOR AN APPEAL<br />

If Mary Stern and Joseph Lynch in the above pleading are the appellants<br />

in this court and all defendants are appellees, the formal caption would<br />

read:<br />

STERN ET AL., APPELLANTS, v. XYZ CORPORATION ET AL.,<br />

APPELLEES.<br />

If Mary Stern is the sole appellant:<br />

STERN, APPELLANT, ET AL., v. XYZ CORPORATION ET AL., APPELLEES.<br />

If Lynch is the sole appellant:<br />

STERN; LYNCH, APPELLANT, v. XYZ CORPORATION ET AL.,<br />

APPELLEES.<br />

If Stern and Lynch are appellees, and XYZ is the sole appellant:<br />

STERN ET AL., APPELLEES, v. XYZ CORPORATION, APPELLANT, ET AL.<br />

If Kent is the sole appellant:<br />

14.2. The “Cite-As Line.”<br />

In the formal case caption, the first defendant listed in the original pleading is always the<br />

first to appear after the “v.” In the cite-as line, the first defendant is the only name to<br />

appear after the “v.,” even if that party has long ago disappeared from the litigation and<br />

has filed nothing in this court. Thus, for all <strong>of</strong> the examples in “14.1. The Formal Case<br />

Caption” above, the cite-as line would read:<br />
