{ 10} Because XYZ has demonstrated that no genuine issue<br />
<strong>of</strong> fact exists as to an essential element <strong>of</strong> Doe’s claim, XYZ is<br />
entitled to judgment as a matter <strong>of</strong> law. The trial court therefore<br />
did not err in entering summary judgment for XYZ.<br />
{ 11} Accordingly, the judgment <strong>of</strong> the court <strong>of</strong> appeals is<br />
affirmed.<br />
