SECTION FIVE: SECONDARY SOURCES<br />

5.1. Restatements.<br />

When citing a Restatement, place the elements <strong>of</strong> the citation in the following order:<br />

• The volume number, if the Restatement has more than one volume;<br />

• The phrase “Restatement <strong>of</strong> the Law” or “Restatement <strong>of</strong> the Law 2d,” etc.,<br />

followed by a comma;<br />

• The title <strong>of</strong> the Restatement (Contracts, Torts, Agency, etc.), followed by a<br />

comma;<br />

• The section number, if desired, preceded by the word “Section”;<br />

• The year, within parentheses.<br />

HOW TO CITE RESTATEMENTS<br />

1 Restatement <strong>of</strong> the Law 3d, Foreign Relations, Section 111 (1986).<br />

NOTE: Do not use a page number when citing the section in general.<br />

4 Restatement <strong>of</strong> the Law 2d, Torts, Section 895C(2)(b), Comment a<br />

(1965).<br />

NOTE: The letter designating the comment is no longer italicized. Do not use a<br />

page number when citing a comment.<br />

1 Restatement <strong>of</strong> the Law 2d, Conflict <strong>of</strong> Laws, Section 187, at 561<br />

(1971).<br />

NOTE: Use a page number when citing a specific passage or when quoting.<br />

1 Restatement <strong>of</strong> the Law 2d, Contracts, Section 168, at 20 (Tent.Draft<br />

1967).<br />

1 Restatement <strong>of</strong> the Law 2d, Contracts, Misrepresentation, Section 159 et<br />

seq. (1981).<br />

5.2. Texts, Treatises, and Dictionaries.<br />

When citing a text, treatise, or dictionary, generally refer to the most recent edition and<br />

place the elements <strong>of</strong> the citation in the following order:<br />

• The volume number, if the source has more than one volume;<br />

• The last name or full name <strong>of</strong> the author(s) <strong>of</strong> the source, if one is named,<br />

followed by a comma;<br />

• The title <strong>of</strong> the source, in italics, followed by a comma;<br />

• The section number, if desired, preceded by the word “Section”;<br />

• The page number, if desired, preceded by a comma;<br />

• The year, within parentheses. If the volume is later than a first edition,<br />

include the number inside the parentheses before the year, e.g., (2d Ed.2009).<br />
