Why <strong>Kansas</strong> Does Not Belong to the<br />

Nurse Licensure Compact (NLC)<br />

<strong>Board</strong> Members and staff at the <strong>Kansas</strong> State<br />

<strong>Board</strong> <strong>of</strong> <strong>Nursing</strong> receive many calls and e-mails<br />

asking why <strong>Kansas</strong> does not belong to the nurse<br />

licensure compact. <strong>The</strong> Nurse Licensure Compact<br />

(NLC) was launched in 2000 to allow for nurses to<br />

have one multistate license and be able to practice<br />

in their home state (the state they live in) and<br />

other states which belong to the NLC.<br />

In 1999 the <strong>Kansas</strong> State <strong>Board</strong> <strong>of</strong> <strong>Nursing</strong><br />

requested the <strong>Kansas</strong> Attorney General review<br />

the Compact language and issue an opinion. On<br />

February 9, 1999 Attorney General Carla Stovall<br />

issued an opinion (99-3) that if <strong>Kansas</strong> joined<br />

the Compact it would be an unconstitutional<br />

delegation <strong>of</strong> legislative authority because it grants<br />

other states the unqualified rights to determine<br />

the qualifications for the practice <strong>of</strong> nursing in<br />

<strong>Kansas</strong> by nonresidents.<br />

<strong>The</strong> mission <strong>of</strong> the <strong>Board</strong> <strong>of</strong> <strong>Nursing</strong> is to<br />

assure the citizens <strong>of</strong> <strong>Kansas</strong> safe and competent<br />

practice by nurses and that mission is met by the<br />

requirement set forth in statutes and regulations<br />

enacted by legislation by the Legislatures and<br />

the <strong>Board</strong> <strong>of</strong> <strong>Nursing</strong>. By joining the compact at<br />

this time, we would not be fulfilling the statutory<br />

mission as it would allow nurses to work in <strong>Kansas</strong><br />

and not meet <strong>Kansas</strong> requirements. Listed are a<br />

few <strong>of</strong> the examples why joining the compact would<br />

be unconstitutional and not fulfilling the <strong>Board</strong><br />

mission.<br />

<strong>Kansas</strong> requires fingerprints for licensure<br />

but there are currently five states in the<br />

compact (Colorado, Maine, Nebraska,<br />

Virginia, and Wisconsin) that do not<br />

require fingerprints. States require<br />

fingerprints for a blueprint <strong>of</strong> the history<br />

<strong>of</strong> the applicant. It assures the state that<br />

the applicant is worthy <strong>of</strong> the public trust<br />

to practice as a nurse. If <strong>Kansas</strong> was<br />

in the compact, we would be allowing<br />

nurses from five states to practice in<br />

<strong>Kansas</strong> without the knowledge <strong>of</strong> their<br />

background. It is unconstitutional to<br />

let a nurse from another state to come<br />

to <strong>Kansas</strong> with a compact license who<br />

has not been fingerprinted. It is also a<br />

question <strong>of</strong> fairness for the nurses who<br />

live and apply for licensure in <strong>Kansas</strong>.<br />

Why should a nurse from another state be<br />

allowed to work in <strong>Kansas</strong> on a compact<br />

license if they have a criminal history<br />

that would perhaps prohibited licensure<br />

if they lived in <strong>Kansas</strong>? Why should a<br />

<strong>Kansas</strong> nurse have the added expense <strong>of</strong><br />

fingerprints when a nurse from a state<br />

that does not require fingerprints can<br />

work in <strong>Kansas</strong> with a compact license?<br />

<strong>Kansas</strong> statute K.S.A. 65-1120 (2) states<br />

that no license or authorization to practice<br />

shall be granted to a person with a felony<br />

conviction for a crime against persons as<br />

specified in article 34 <strong>of</strong> chapter 21 (prior<br />

to the repeal it is now Article 54 chapter<br />

21) <strong>of</strong> the <strong>Kansas</strong> Statutes Annotated.<br />

Crimes listed in this article are murder<br />

and aggravated <strong>of</strong>fenses against a person.<br />

This absolute bar helps protect the public.<br />

<strong>The</strong>re are many states in the Compact<br />

that do not have an absolute bar for<br />

licensure. It would be unconstitutional for<br />

<strong>Kansas</strong> to join the Compact as it would<br />

allow for a nurse who was convicted <strong>of</strong> a<br />

felony against person to live in a state that<br />

doesn’t have the absolute bar (example,<br />

Missouri, Nebraska, Colorado, etc) and<br />

come to <strong>Kansas</strong> to work as a nurse, but if<br />

they lived in <strong>Kansas</strong>, they would never be<br />

licensed as a nurse.<br />

Pr<strong>of</strong>essional and practical nursing<br />

programs prepare a graduate for licensure<br />

as a RN or LPN. Clinical experiences<br />

in conjunction with didactic instruction<br />

lead to a competent graduate. <strong>Kansas</strong><br />

nursing education requirements include<br />

didactic and clinical experiences across the<br />

lifespan to ensure a comprehensive nursing<br />

education. <strong>The</strong> licensure examination<br />

(NCLEX) is designed to test knowledge,<br />

skills and abilities essential for the safe<br />

and effective practice <strong>of</strong> nursing at the<br />

entry level. Clinical experiences across the<br />

lifespan assist the nursing student to apply<br />

About Me<br />

Karen McGill is the new Senior Administrative<br />

Assistant in Renewal Licensing Department for<br />

the KSBN. Karen is married and has 4 grown<br />

children and a step-daughter. When not at<br />

work Karen enjoys taking long walks with her<br />

husband Walter around Lake Shawnee. She Loves<br />

spending time with her children and dabbles<br />

with scrapbooking and taking photographs <strong>of</strong> her<br />

<strong>The</strong> U.S. Department <strong>of</strong> Labor is recruiting to contract with Registered<br />

Nurses, intermittently and part-time in Garden City/Scott City, KS and<br />

the greater <strong>Kansas</strong> City area to coordinate medical management <strong>of</strong><br />

injured Federal workers.<br />

Contractual agreement is for one year with the option to renew based on<br />

performance. Minimum requirements are: applicable state licensure(s),<br />

case management experience in the workers compensation/occupational<br />

health field and medical-surgical experience for 1 to 3 years. Applicants<br />

must have computer skills and provide their own personal computers and<br />

internet connectivity to work on these cases. Due to privacy concerns, use <strong>of</strong><br />

public access internet is not acceptable. <strong>The</strong> reimbursement rate is $90.00<br />

per hour for pr<strong>of</strong>essional time and $45.00 for administrative/travel time.<br />

their knowledge in acquiring competent<br />

skills. <strong>The</strong>re are nursing educational<br />

programs in the United States that do not<br />

provide clinical experiences across the<br />

lifespan. <strong>Kansas</strong> does not license a new<br />

graduate from nursing programs that do<br />

not provide clinical across the lifespan.<br />

Again, if <strong>Kansas</strong> would join the compact,<br />

we would be allowing a nurse to work in<br />

<strong>Kansas</strong> that would not be licensed and<br />

allowed to work if they lived in <strong>Kansas</strong>.<br />

<strong>The</strong>re are other unconstitutional issues with the<br />

compact, this article only list three major issues.<br />

<strong>The</strong> Attorney General Opinion can be found at<br />

Oklahoma and Louisiana have similar Attorney<br />

General Opinions.<br />

<strong>The</strong>re are currently 24 jurisdictions (states<br />

and territories) in the compact-there are 60 who<br />

have the option to join. <strong>The</strong> last state to join the<br />

compact was Missouri in 2010. With only 24<br />

jurisdictions in the compact, the approximate<br />

financial impact annually to the <strong>Kansas</strong> State<br />

<strong>Board</strong> <strong>of</strong> <strong>Nursing</strong> would be a revenue loss <strong>of</strong><br />

$376,667 from renewal and verifications fees. <strong>The</strong><br />

FY 14 budget for KSBN was $2,253,539 and if<br />

the agency joined the compact the loss <strong>of</strong> revenue<br />

would be at least 16.7% <strong>of</strong> the annual budget. This<br />

would require the <strong>Board</strong> to increase fees for all<br />

licensees.<br />

In 2013 the National Council <strong>of</strong> State <strong>Board</strong>s<br />

<strong>of</strong> <strong>Nursing</strong> conducted a national workforce survey<br />

<strong>of</strong> registered nurses. In this survey questions<br />

were asked about the compact. Of respondents to<br />

the survey who lived in a state who belong to the<br />

compact, only 8% indicated that they had practiced<br />

in multiple compact states. Joining the compact<br />

would be a large financial burden for the agency<br />

with just a small number <strong>of</strong> nurses using the<br />

compact license.<br />

During 2013 and <strong>2014</strong> there has been several<br />

meeting <strong>of</strong> the Executive Officers from the<br />

jurisdictions to discuss the future <strong>of</strong> licensure<br />

models. Dialogue continues between the<br />

jurisdictions to work towards identifying the<br />

issues and to come to a resolution which will allow<br />

more jurisdictions to join the compact.<br />

Patsy Zeller MSN<br />

City, <strong>Kansas</strong>. Patsy<br />

is a native <strong>of</strong> western<br />

raised in Leoti, <strong>Kansas</strong><br />

and living most <strong>of</strong> her<br />

Hutchinson Community<br />

College and received an AS degree in 1975 and later<br />

received her ADN from Garden City Community<br />

College and was licensed as an RN in 1979. After 20<br />

years <strong>of</strong> medical /surgical experience in acute care at<br />

St. Catherine Hospital in Garden City, <strong>Kansas</strong> she<br />

returned to school to complete her BSN from Newman<br />

University in 1999.<br />

Acute care experience at St. Catherine Hospital<br />

included, staff nurse, charge nurse, employee<br />

health nurse, nurse educator, house supervisor,<br />

nursing coordinator and Department supervisor<br />

for Medical / Surgical. Patsy helped as adjunct<br />

educator for nursing at Garden City Community<br />

College in Jan <strong>of</strong> 2005 and became full time<br />

nursing instructor by May <strong>of</strong> 2005. In 2009 Patsy<br />

was Assistant Director <strong>of</strong> <strong>Nursing</strong> Education at<br />

GCCC and with completion <strong>of</strong> her MSN degree<br />

and APRN Family Nurse Practitioner course<br />

work in August <strong>of</strong> 2010 she was able to become the<br />

Director <strong>of</strong> <strong>Nursing</strong> Education at GCCC. In 2012<br />

Patsy became a part <strong>of</strong> the Education Committee<br />

for the KSBN.<br />

Patsy has been married to husband Bob for 38<br />

years and has two children. Her son is married<br />

and has the first grandchild (Grayson now 2 years<br />

old). Patsy also has a daughter that will be getting<br />

married this fall <strong>2014</strong>. All immediate family are<br />

natives <strong>of</strong> western <strong>Kansas</strong> and currently live in<br />

the area.<br />

<strong>The</strong> March CNE Committee was called to<br />

order March 25, <strong>2014</strong> at 9:30 a.m. in room 560 <strong>of</strong><br />

the Landon State Office Building in Topeka by<br />

Judy Hiner, Vice Chair. <strong>The</strong>re was no addition to<br />

the agenda. <strong>The</strong> minutes from the December 10,<br />

2013 meeting were approved as distributed.<br />

William Anderson reported there were sixty<br />

one IOA’s denied since last meeting. Eleven were<br />

denied for timeliness, thirty six for submission <strong>of</strong><br />

no documentation, six not appropriate as APRN<br />

CNE and eight did not fit the definition <strong>of</strong> CNE.<br />

<strong>The</strong> following long term provider applications<br />

moved to revise K.A.R. 60-4-103 (a) (2) and (a) (4)<br />

to delete the word “renewal and insert the word<br />

“report.”<br />

<strong>The</strong> meeting was adjourned at 10:29 am.<br />

March Finance<br />

Committee<br />

<strong>The</strong> March Finance Committee was called to<br />

order March 26, <strong>2014</strong> at 8:30 a.m. in room 560<br />

<strong>of</strong> the Landon State Office Building in Topeka<br />

by Bernard Becker, Chair. <strong>The</strong> minutes <strong>of</strong> the<br />

December 11, 2013 Finance Committee were<br />

approved as written.<br />

Mary Blubaugh reported that the agency<br />

was currently $90,000 under budget for FY<br />

14 but still waiting to receive the invoice<br />

for approximately $8,000 from facilities<br />

management for the <strong>of</strong>fice remodel. She<br />

reported that for the agency to go forward with<br />

the online applications the agency will need<br />

to upgrade the licensing system at the cost <strong>of</strong><br />

$40,000 to $50,000. <strong>The</strong> agency should have the<br />

funds to purchase the upgrade this fiscal year.<br />

It was moved to allow Brenda M<strong>of</strong>fit, <strong>Board</strong><br />

President and Bernard Becker, Chairman <strong>of</strong><br />

the Finance Committee to meet with Mary<br />

Blubaugh, Executive Administrator and Adrian<br />

Guerrero, Director <strong>of</strong> Operations to spend up to<br />

$25,000 for the upgrade and implementation <strong>of</strong><br />

licensing s<strong>of</strong>tware and up to $35,000 to do all<br />

necessary work to implement online application<br />

for all applicants.<br />

Mary Blubaugh reported that K.S.A. 65-4208<br />

legislative bill that would raise the limit on the<br />

fee for the exam for the Licensed Mental Health<br />

Technician did not get introduced.<br />

Committee member Garet King did research<br />

and came up with three different proposed<br />

amounts the agency should have in the fee fund<br />

should a disaster occur. Two <strong>of</strong> the proposed<br />

amounts were around $1.7 million. Staff will<br />

write a policy to propose the agency keep $1.7<br />

million in the Fee Fund.<br />

<strong>The</strong> meeting adjourned at 9:05 am.<br />

Insurance for Nurse Midwife<br />

<strong>The</strong> March ARNP Committee was called to<br />

order March 25, <strong>2014</strong> at 1:30 p.m. in room 509 <strong>of</strong><br />

the Landon State Office Building in Topeka by<br />

Brenda M<strong>of</strong>fitt, Chair. Bill Anderson reviewed<br />

items for discussion in the onsite packet. <strong>The</strong><br />

agenda was amended to add under new business<br />

Medical University <strong>of</strong> South Carolina CRNA<br />

program. <strong>The</strong> minutes from the December 10, 2013<br />

meeting were approved as distributed.<br />

<strong>The</strong> following out <strong>of</strong> states schools and their<br />

roles were approved:<br />

Brenda M<strong>of</strong>fit discussed that the APRN<br />

Program for University <strong>of</strong> Cincinnati had previous<br />

been approved by this committee for Adult and<br />

this is just a title change to Adult/Gero.<br />

<strong>The</strong>re was no representative from the APRN<br />

Task Force. Senate Bill No. 326 was introduced in<br />

the Committee on Ways and Means at the request<br />

<strong>of</strong> the APRN Task Force. <strong>The</strong>re has been no action<br />

on this bill at the time <strong>of</strong> the meeting.<br />

<strong>The</strong> meeting was adjourned at 1:45 pm.<br />

As a result <strong>of</strong> passage <strong>of</strong> House Bill 2516 by<br />

the <strong>2014</strong> Legislature, beginning January 1,<br />

2015 Advance Practice Registered Nurses who<br />

are certified in the role <strong>of</strong> Nurse Midwife will be<br />

defined as health care providers under the Health<br />

Care Provider Insurance Availability Act. This<br />

means each Nurse Midwife with an active <strong>Kansas</strong><br />

license will be required to obtain pr<strong>of</strong>essional<br />

liability insurance and also participate in the<br />

<strong>Kansas</strong> Health Care Stabilization Fund. Any<br />

Nurse Midwife who cannot obtain pr<strong>of</strong>essional<br />

liability insurance from a company approved by<br />

the <strong>Kansas</strong> Commissioner <strong>of</strong> Insurance will be<br />

eligible to purchase the required coverage from the<br />

Health Care Provider Insurance Availability Plan.<br />

<strong>The</strong> Availability Plan will also <strong>of</strong>fer prior acts<br />

coverage to a Nurse Midwife who wishes to obtain<br />

“tail” coverage for their liability exposure prior<br />

An Advanced Practice Registered Nurse (APRN) in the role <strong>of</strong> Clinical<br />

Nurse Specialist, Nurse Midwife or Nurse Practitioner licensed in <strong>Kansas</strong><br />

may prescribe drugs following a written protocol as authorized by a<br />

responsible physician. This is a separate requirement from the collaborative<br />

agreement. Each written protocol shall contain a precise and detailed<br />

medical plan <strong>of</strong> care for each classification <strong>of</strong> disease or injury for which<br />

the APRN is authorized to prescribe and shall specify all drugs which may<br />

be prescribed by the APRN. Any written prescription order shall include<br />

the name, address, and telephone number <strong>of</strong> the responsible physician.<br />

<strong>The</strong> APRN may not dispense drugs, but may request, receive and sign for<br />

pr<strong>of</strong>essional samples and may distribute pr<strong>of</strong>essional samples to patients<br />

following a written protocol as authorized by a responsible physician. In order<br />

to prescribe controlled substances, the APRN must:<br />

1) Register with the federal drug enforcement administration; and<br />

2) Notify the board <strong>of</strong> the name and address <strong>of</strong> the responsible physician<br />

or physicians. In no case shall the scope <strong>of</strong> authority <strong>of</strong> the APRN<br />

exceed the normal and customary practice <strong>of</strong> the responsible physician.<br />

A Controlled Substance Verification Form (CSVF) is the form used<br />

to notify the <strong>Board</strong> and must be on file with the <strong>Kansas</strong> State <strong>Board</strong> <strong>of</strong><br />

<strong>Nursing</strong> before the federal drug administration will issue a DEA number<br />

to the APRN. <strong>The</strong> CSVF must be filed with the <strong>Board</strong> <strong>of</strong> <strong>Nursing</strong> initially<br />

before obtaining a DEA number and also when there are any changes in the<br />

responsible physician or drug prescription authorization <strong>of</strong> the APRN. It is<br />

not necessary to send a copy <strong>of</strong> the written protocol between the responsible<br />

physician and APRN to the <strong>Board</strong> <strong>of</strong> <strong>Nursing</strong>. <strong>The</strong> CSVF is available on our<br />

website under the “Forms” link. A CSVF is not necessary for an APRN in the<br />

role <strong>of</strong> Registered Nurse Anesthetist while functioning as a registered nurse<br />

anesthetist as per K.S.A 65-1158.<br />

Committee<br />

<strong>The</strong> Education Committee met March 25, <strong>2014</strong> and was called to order by<br />

Brenda M<strong>of</strong>fitt, APRN, CNS-BC, Vice-Chair at 8:30 a.m. in Room 509 <strong>of</strong> the<br />

Landon State Office Building. <strong>The</strong> minutes from December 10, 2013 were<br />

approved. <strong>The</strong> Education Specialist report was given by Carol Moreland,<br />

MSN, RN.<br />

National American University, Overland park BSN Program had a re-<br />

<br />

visit report with recommendations and to reapprove the program for a period<br />

consistent with CCNE accreditation.<br />

North Central <strong>Kansas</strong> Technical College PN Program at Beloit had a re-<br />

visit report with recommendations and to reapprove the PN program for five<br />

years.<br />

<strong>The</strong> following schools presented major curriculum changes:<br />

Practice Committee<br />

<strong>The</strong> Practice Committee met on Tuesday June 17th. . <strong>The</strong> final update <strong>of</strong><br />

the School Delegation Table was approved for posting. <strong>The</strong> second meeting<br />

<strong>of</strong> the multidisciplinary committee reviewing the Joint Policy Statement on<br />

the Use <strong>of</strong> Controlled Substances has been scheduled. Brenda M<strong>of</strong>fitt and<br />

Diane Glynn will be attending on behalf <strong>of</strong> the agency. A review <strong>of</strong> <strong>Kansas</strong><br />

Administrative Regulations 60-15-101 and 102 was performed and no<br />

changes were suggested. A task force to work on updating the IV <strong>The</strong>rapy<br />

Exam Question Pool and study the need for a live stick in the competency<br />

check <strong>of</strong>f was requested by the committee and then authorized by the <strong>Board</strong>.<br />

<strong>The</strong> committee will be chaired by Rex Patty.<br />

Investigative Committee<br />

<strong>The</strong> Investigative Committee met on Monday and Tuesday June 16 and<br />

17. <strong>The</strong> Committee reviewed 194 cases. A new format for the newsletter<br />

postings was approved and will be implemented with the next newsletter.<br />

<strong>The</strong> review <strong>of</strong> the LMHT Act will be carried to the September meeting.<br />

Three statutes were reviewed as part <strong>of</strong> the 5 year legislative review process.<br />

Information was presented on the NCSBN Competency Study was passed<br />

until the September meeting so that pending information from NCSBN can<br />

be included. <strong>The</strong> new AG opinion on the BEMS committee process for case<br />

review was noted and further discussion was had at the <strong>Board</strong> meeting.

What is KNAP?<br />

KNAP is a pr<strong>of</strong>essional assistance program<br />

designed to assist all nurses and mental health<br />

technicians who have a problem or illness that has<br />

or could impair their ability to practice safely.<br />

<strong>The</strong> Goal <strong>of</strong> KNAP<br />

Mental and physical illness, including alcohol<br />

and other drug addiction, can potentially impair<br />

practice and health. We estimate that at any<br />

given time, approximately 10% <strong>of</strong> the population<br />

is affected. This same percentage is thought to be<br />

true <strong>of</strong> healthcare pr<strong>of</strong>essionals.<br />

Alcohol and other drug addiction, as well as<br />

mental and physical illnesses, are treatable.<br />

KNAP works with the program participants to<br />

obtain an evaluation, treatment (if indicated), and<br />

monitoring throughout the recovery process.<br />

Referrals<br />

Self-referrals to the program are encouraged,<br />

but referrals may be made by a family member,<br />

a friend, employer or anyone concerned about the<br />
