(2) Notwithstanding the provisions of subsection (1), no agreement except an<br />

agreement to commit an offence shall amount to a criminal conspiracy unless some<br />

act besides the agreement is done by one or more <strong>part</strong>ies to such agreement in<br />

pursuance thereof.<br />

Explanation 1:<br />

It is immaterial whether the illegal act is the ultimate object of such agreement, or is merely incidental to<br />

that object.<br />

Explanation 2:<br />

This section shall not apply to an agreement of two or more persons to do or cause to be done any act in<br />

contemplation or furtherance of a trade dispute if such act committed by one person would not be<br />

punishable as an offence. 156<br />

122. (1) Whoever is a <strong>part</strong>y to a criminal conspiracy to commit an offence punishable with<br />

death or with imprisonment shall where no express provision is made in this law for<br />

the punishment of such a conspiracy be punished in the same manner as if he had<br />

abetted such offence.<br />

(2) Whoever is a <strong>part</strong>y to a criminal conspiracy other than a criminal conspiracy to<br />

commit an offence punishable as aforesaid shall be punished with imprisonment for a<br />

term not exceeding six months or with fine or with both. 157<br />

123. Any society which by its composition, nature, or conduct is anti-social, counter<br />

productive or opposed to the general belief and culture of the people of the State, or is<br />

dangerous and obstructive to the good governance of the State or any <strong>part</strong> thereof, is said to<br />

be an unlawful society. 158<br />

124. Whoever manages or is a member of an unlawful society shall be punished with<br />

imprisonment for a term which may extend to seven years and shall also be liable to caning<br />

which may extend to sixty lashes. 159<br />
