Hurt<br />
214. Whoever causes bodily pain, disease or infirmity to any person is said to cause hurt. 297<br />
215. The following kinds of hurt only are designated as grievous: 298<br />
(a) emasculation;<br />
(b) permanent deprivation of the sight of an eye, of the hearing of an ear, of the<br />
power of speech, taste, smell or sound mind; 299<br />
(c) deprivation of any member or joint;<br />
(d) destruction or permanent impairing of the powers of any member or joint;<br />
(e) permanent disfiguration of the head or face;<br />
(f) fracture or dislocation of a bone or tooth;<br />
(g) any hurt which endangers life or which causes the sufferer to be 300 in severe<br />
bodily pain or unable to follow his ordinary pursuits.<br />
216. Whoever does any act with the intention of thereby causing hurt to any person or with<br />
the knowledge that he is likely thereby to cause hurt to any person and does thereby cause<br />
hurt to any person, is said <strong>vol</strong>untarily to cause hurt. 301<br />
217. Whoever <strong>vol</strong>untarily causes hurt, if the hurt which he intends to cause or knows<br />
himself to be likely to cause is grievous hurt and if the hurt which he causes is grievous hurt,<br />
is said <strong>vol</strong>untarily to cause grievous hurt. 302<br />
218. Whoever <strong>vol</strong>untarily causes hurt to any person shall be punished with imprisonment<br />
for a term which may extend to six months or with caning which may extend to twenty<br />
lashes and shall also be liable to pay compensation. 303<br />
219. Whoever <strong>vol</strong>untarily causes grievous hurt to any person shall be punished:<br />
(a) with qisas; or<br />

Kaduna: ta’azir. All others as here except Kano and Katsina use “diyah” instead of “compensation”,<br />
and the others use “damages”. PC varies the punishments for <strong>vol</strong>untarily causing hurt depending on<br />
whether it is done “on grave and sudden provocation” (1 month/fine of £10/both) or without<br />
provocation (1 year/ fine of £20/both); and then a series of PC sections punishes causing either hurt<br />
or grievous hurt: by dangerous means (3 years/fine/both for hurt, 14 years and fine for grievous hurt);<br />
“by means of poison or any stupefying, intoxicating or unwholesome drug” (10 years and fine simply<br />
for administration with intent); for the purpose of extorting property to constrain an illegal act (10<br />
years and fine for hurt, 14 years and fine for grievous hurt); to extort confession or to compel<br />
restoration of property (7 years and fine for hurt, 10 years and fine for grievous hurt); to deter public<br />
servant from his duty (3 years/fine/both for hurt, 10 years and fine for grievous hurt); by act<br />
endangering life or personal safety of others (1 year/fine/both for hurt, 2 years/fine/both for grievous<br />
hurt).<br />
