CHAPTER 4: THE SHARIA PENAL CODES<br />
(a) where the person allowed to escape is to serve a term of imprisonment, with the<br />
same penalty that the person allowed to escape or attempt to escape from lawful<br />
custody is liable to, such public servant being deemed an accomplice;<br />
(b) where the person allowed to escape is awaiting death penalty the public servant<br />
shall be subject to a term of imprisonment which may extend to five years;<br />
(c) in any other case, with a term of imprisonment which shall extend to any such<br />
time that the person who was allowed to escape from lawful custody is reapprehended;<br />
(d) nothing in this section shall prevent the additional punishment of caning which<br />
may extend to fifty lashes.<br />
302. Whoever, being a public servant whose duty it is as such public servant to arrest any<br />
person or to keep any person in confinement or custody, negligently omits to arrest that<br />
person or negligently suffers that person to escape from confinement or custody, shall be<br />
punished with a term of imprisonment which may extend to one year and shall be liable to<br />
caning which may extend to twenty lashes. 407<br />
303. Whoever, being a public servant wilfully omits to perform any duty pertaining to his<br />
office which he is legally bound to perform, shall if such omission causes or tends to cause<br />
danger to human life, health or safety or causes or tends to cause a riot, be punished with<br />
imprisonment for a term which may extend to one year and shall also be liable to caning<br />
which may extend to forty lashes. 408<br />
304. Whoever, being a public servant, abandons 409 his duties in prearranged agreement<br />
with two or more other such public servants 410 shall, if the intention or effect of such<br />
abandonment is to interfere with the performance of public service to an extent that will<br />
cause an injury or damage or grave inconvenience to the community, 411 be punished with a<br />
to 10 years: 3 years or fine or both. (d) other cases: 2 years or fine or both. Gombe, Jigawa, Kano,<br />
Katsina, Kebbi, Sokoto, Yobe, Zamfara: “(a) with the same penalty that the person allowed to escape<br />
or attempt to escape from lawful custody is liable to, such public servant being deemed an accomplice;<br />
(b) where the person allowed to escape is awaiting death penalty the public servant shall be subject to a<br />
term of imprisonment which may extend to life [except that Gombe omits the last 5 words]; (c) with a<br />
term of imprisonment which shall extend to any such time that the person who was allowed to escape<br />
from lawful custody is reapprehended. (d) Nothing in this section shall prevent the additional<br />
punishment of caning which may extend to 50 lashes [but Sokoto and Kebbi omit (d).” Bauchi: does<br />
not have subsections, saying only: “shall be punished with a term of imprisonment which shall extend<br />
to any such time that the person who was allowed to escape from lawful custody is reapprehended:<br />
provided the aggregate term of imprisonment where appropriate shall not be higher than the term of<br />
the original, actual offender shall have served”; and Bauchi allows a further 40 lashes. Kaduna: ta’azir.<br />
