summary judgment dismissing <strong>Cammarata</strong>’s counterclaim. <strong>Cammarata</strong>’s motion for summary<br />

judgment to recover on his counterclaim is denied.<br />

VII.<br />

Conclusion<br />

<strong>Rimkus</strong>’s motions for sanctions are granted in part and denied in part. <strong>Rimkus</strong> is not<br />

entitled to an order striking the defendants’ pleadings and entering a default judgment. Based<br />

on the defendants’ spoliation of evidence, <strong>Rimkus</strong> is entitled to an adverse inference<br />

instruction at trial. <strong>Rimkus</strong> is also entitled to the reasonable costs and fees it incurred in<br />

investigating the spoliation, obtaining emails via third-party subpoenas, moving for sanctions,<br />

and taking the additional depositions of Bell and <strong>Cammarata</strong>. By March 1, 2010, <strong>Rimkus</strong> will<br />

submit evidence of the costs and attorneys’ fees.<br />

The defendants’ motion for summary judgment is granted in part and denied in part.<br />

Summary judgment is granted dismissing <strong>Rimkus</strong>’s claims for disparagement, tortious<br />

interference, and damages for breach of the noncompetition and nonsolicitation provisions.<br />

Summary judgment is denied on <strong>Rimkus</strong>’s claims for misappropriation of trade secrets, breach<br />

of fiduciary duty to the extent it is based on misappropriation, unfair competition, and civil<br />

conspiracy. With respect to the counterclaim for attorneys’ fees, <strong>Cammarata</strong>’s motion for<br />

summary judgment is denied and <strong>Rimkus</strong>’s motions for summary judgment are granted. A<br />

status conference is set for February 26, 2010, at 10:00 a.m.<br />
