5.7.2. Community support<br />
5.7.2.1. Positive feedback during operations<br />
Ombudsman observers regularly heard members <strong>of</strong> <strong>the</strong> public stopped at check points voice <strong>the</strong>ir support for <strong>the</strong><br />
police efforts. The <strong>Police</strong> Association <strong>of</strong> <strong>NSW</strong> advised that:<br />
Information we have received from members indicates that <strong>the</strong> majority <strong>of</strong> persons subjected to screening<br />
during <strong>the</strong>se operations [were] supportive <strong>of</strong> <strong>the</strong> police effort and agree that it is not any way intrusive. 415<br />
One senior <strong>of</strong>ficer we interviewed noted:<br />
… most people coming through those sites are decent good people and we’re getting a lot <strong>of</strong> feedback from<br />
those people saying ‘it’s great to see you out and about’. 416<br />
5.7.2.2. Complaints<br />
A search <strong>of</strong> <strong>the</strong> Ombudsman and <strong>NSW</strong> <strong>Police</strong> Force complaint databases revealed that no formal complaints<br />
were received in relation to <strong>the</strong> conduct <strong>of</strong> police and/or drug detection dogs during any <strong>of</strong> <strong>the</strong> 23 drug detection<br />
operations. In addition, <strong>the</strong> <strong>NSW</strong> <strong>Police</strong> Force advised that <strong>the</strong>y were unaware <strong>of</strong> any formal or informal complaints. 417<br />
5.7.2.3. Section 16 charges<br />
As noted above (at paragraph 2.1.7), section 16 <strong>of</strong> <strong>the</strong> <strong>Drug</strong> <strong>Detection</strong> <strong>Trial</strong> <strong>Act</strong> created three new <strong>of</strong>fences. The <strong>NSW</strong><br />
<strong>Police</strong> Force advised that no persons were charged under section 16 during <strong>the</strong> review period. 418 However, one<br />
person was charged with hindering police during a drug detection operation — see case study 10 (at paragraph 4.5).<br />
5.7.2.4. Impact <strong>of</strong> operations at roadhouses<br />
During <strong>the</strong> review period, police conducted four operations at petrol station truck stops (also known as roadhouses)<br />
targeting heavy vehicle drivers who police believed might have stopped to avoid scrutiny at o<strong>the</strong>r check points. The<br />
operations varied in duration from 15 minutes to two hours.<br />
As discussed above (at paragraph 4.2.2), <strong>the</strong>se operations were conducted on privately owned land open to <strong>the</strong><br />
public where drivers can refuel, eat, shower, rest and unwind.<br />
We interviewed <strong>the</strong> manager <strong>of</strong> a roadhouse where police conducted an operation. The manager advised that<br />
<strong>the</strong>re was some initial confusion about whe<strong>the</strong>r police had <strong>the</strong> power to conduct <strong>the</strong> operation at <strong>the</strong> roadhouse.<br />
The manager noted that police advised <strong>the</strong> console operator <strong>of</strong> <strong>the</strong>ir intention to conduct an operation upon arrival<br />
at <strong>the</strong> location.<br />
The manager opined that <strong>the</strong> operation:<br />
… was not a good look. … a lot <strong>of</strong> people just keep going when <strong>the</strong>y see a lot <strong>of</strong> police [because] <strong>the</strong>y think<br />
something’s up. You know if you see a lot <strong>of</strong> police you think ‘Oh well I won’t pull up ’cause something’s happening’. 419<br />
The manager, who did not appear to appreciate <strong>the</strong> police rationale for targeting vehicles stopped at <strong>the</strong> roadhouse,<br />
suggested that police could have conducted <strong>the</strong> operation at alternate locations:<br />
… [<strong>the</strong> police] have got all <strong>the</strong> places along <strong>the</strong> highway where <strong>the</strong> RTA pulls trucks in and that’s where I think<br />
[operations] should [be conducted]. 420<br />
The manager also advised that staff on duty mentioned that ‘a lot <strong>of</strong> trucks kept going that night.’ 421 When asked<br />
about <strong>the</strong> financial impact <strong>of</strong> <strong>the</strong> operation on <strong>the</strong> business, <strong>the</strong> manager stated:<br />
To be honest I haven’t looked at it but <strong>the</strong> console operator said that it was usually a lot busier. 422<br />
The manager also advised that when drivers purchase fuel <strong>the</strong>y could spend between $500 and $1,200 and that:<br />
… you’ve only got to miss out on four or five trucks and it’s a big loss. 423<br />
In addition, <strong>the</strong> manager noted that drivers who did not stop because <strong>of</strong> <strong>the</strong> police presence would have to travel<br />
a fur<strong>the</strong>r hour to reach <strong>the</strong> next roadhouse with similar amenities. Fur<strong>the</strong>rmore, drivers whose employers provided<br />
charge cards to purchase petrol would have to travel a fur<strong>the</strong>r two hours to reach <strong>the</strong> next roadhouse as <strong>the</strong> cards<br />
must be used at particular petrol company outlets.<br />
The manager also raised <strong>the</strong> issue <strong>of</strong> <strong>the</strong> potential impact <strong>of</strong> <strong>the</strong> operation on <strong>the</strong> fatigue management schedules<br />
