11.3 BID NOT SECURED IN ACCORDANCE WITH PARA 11.1(i) SHALL BE TREATED AS<br />

NON-RESPONSIVE AND SHALL BE REJECTED BY THE TENDERING AUTHORITY.<br />

11.4 The bid security <strong>of</strong> the unsuccessful bidder will be discharged/returned as promptly as possible<br />

as but not later than 30 days after the expiry <strong>of</strong> the period <strong>of</strong> bid validity prescribed by the<br />

<strong>Tender</strong><strong>in</strong>g authority.<br />

11.5 The bid security may be <strong>for</strong>feited:<br />

(a) If bidder withdraws his bid dur<strong>in</strong>g the period <strong>of</strong> bid validity specified by the bidder on the Bid<br />

Form, OR<br />

(b) In case <strong>of</strong> a successful bidder, if the bidder fails:<br />

i. To sign the contract.<br />

ii. To furnish per<strong>for</strong>mance security.<br />

12. PERIOD OF VALIDITY OF BIDS :<br />

12.1 Bid shall rema<strong>in</strong> valid <strong>for</strong> 150 days from the date <strong>of</strong> bid open<strong>in</strong>g prescribed by the <strong>Tender</strong><strong>in</strong>g<br />

authority, pursuant to Clause 18.1. A BID VALID FOR A SHORTER PERIOD SHALL BE<br />

REJECTED BY THE TENDERING AUTHORITY AS NON-RESPONSIVE.<br />

12.2 In exceptional circumstances, the <strong>Tender</strong><strong>in</strong>g authority may request the bidder’s consent <strong>for</strong> an<br />

extension to the period <strong>of</strong> bid validity. The request and the responses thereto shall be made <strong>in</strong><br />

writ<strong>in</strong>g. The bid security provided under Clause 11 shall also be suitably extended. The bidder<br />

may refuse the request without <strong>for</strong>feit<strong>in</strong>g his bid security. In such case(s), his/her bid shall be<br />

rejected without <strong>for</strong>feit<strong>in</strong>g the bid security. A bidder accept<strong>in</strong>g the request and grant<strong>in</strong>g extension<br />

will not be permitted to modify his bid.<br />

13. POWER OF ATTORNEY :<br />

i) a) The power <strong>of</strong> attorney should be submitted and executed on the non-judicial stamp paper <strong>of</strong><br />

appropriate value as prevail<strong>in</strong>g <strong>in</strong> the respective states (s) and the same be attested by a Notary<br />

Public or registered be<strong>for</strong>e Sub-Registrar <strong>of</strong> the sate(s) concerned.<br />

b) The power <strong>of</strong> Attorney be executed by a person who has been authorized by the Board <strong>of</strong><br />

Directors <strong>of</strong> the firm <strong>in</strong> this regard, on behalf <strong>of</strong> the Company / <strong>in</strong>stitution / body corporate.<br />

ii)<br />

FORMAT AND SIGNING OF BID:<br />

The bid shall conta<strong>in</strong> no <strong>in</strong>terl<strong>in</strong>eations, erasures or overwrit<strong>in</strong>g except as necessary to correct<br />

errors made by the bidder <strong>in</strong> which case such corrections shall be signed by the person(s) sign<strong>in</strong>g<br />

the bid with date.<br />
