(3) There can be no variances requested from the subdivision<br />
regulations.<br />
(4) There cannot be, as a result of such subdivision, a creation of<br />
any lot, which fails to meet all requirements of the subdivision<br />
regulations.<br />
(5) Each subdivider may have only one single lot subdivision using<br />
the one-lot procedure per month.<br />
(6) Additional street right-of-way dedication shall be given in cases<br />
where the existing right-of-way does not meet the present minimum<br />
right-of-way width.<br />
(7) Further, each subdivider shall be limited to only one interior onelot<br />
subdivision approval.<br />
c) Subsequent to meeting all requirements, the favorable review of the<br />
Planning Commission staff, and signature of certification of the Planning<br />
Commission secretary with staff certification. In addition all platting fees<br />
and/or attorney fees must be paid in full prior to the final plat being<br />
released from the planning department.<br />
4.05. Submission Dates:<br />
The official submission date shall be considered the date of the Commission<br />
meeting at which a plat is considered for approval. This is not the date upon<br />
which the plat is submitted to the Planning Commission staff for review. Plats<br />
shall be submitted to the Planning Commission staff on or before the first (1st)<br />
calendar day of the month in which approval is requested.<br />
4.06. Notice of review:<br />
The Planning Commission or its technical staff shall mail notice of the time and<br />
place of the plat review meeting five (5) days prior to the date of the meeting. The<br />
notice shall be mailed to the address specified on the plat.<br />
4.07. Action by the Planning Commission:<br />
4.07.1 Preliminary Plat Review:<br />
(a) Within sixty (60) days after the official submission date of the<br />
preliminary plat, the Planning Commission will review the plat and indicate<br />
its approval, disapproval, or approval subject to modifications. Failure of<br />
the Planning Commission to act on the preliminary plat only within this<br />
sixty (60) days will be deemed approval of the preliminary plat only. The<br />
Planning Commission will review the plat and indicate its approval,<br />
disapproval or approval subject to modifications, specifically stating any<br />
modifications required in the minutes of the meeting.<br />
