Government defeated over ‘carbon tax’<br />
<strong>The</strong> Conseil<br />
Constitutionnel,<br />
<strong>the</strong> court that<br />
exam<strong>in</strong>es <strong>the</strong><br />
legality of new French laws,<br />
has dealt an embarrass<strong>in</strong>g<br />
blow <strong>to</strong> President Sarkozy<br />
as it declared h<strong>is</strong> proposed<br />
taxe carbone (carbon tax)<br />
‘unconstitutional’ just days<br />
before it was due <strong>to</strong> come<br />
<strong>in</strong><strong>to</strong> force.<br />
<strong>The</strong> new carbon tax was<br />
a key element of <strong>the</strong> 2010<br />
budget and was <strong>the</strong> flagship<br />
of President Sarkozy’s<br />
attempts <strong>to</strong> put <strong>France</strong> on<br />
<strong>the</strong> frontl<strong>in</strong>e of <strong>the</strong> fight<br />
aga<strong>in</strong>st global warm<strong>in</strong>g.<br />
Its last m<strong>in</strong>ute rejection<br />
was both unexpected and<br />
embarrass<strong>in</strong>g.<br />
<strong>The</strong> proposals were<br />
announced amid great<br />
fanfare <strong>in</strong> September 2009<br />
and were designed as a tax<br />
on pollution. <strong>The</strong> tax was set<br />
at €17 per <strong>to</strong>nne and would<br />
have seen <strong>the</strong> price of petrol<br />
r<strong>is</strong>e by 4 centimes a litre<br />
and diesel by 4.5 centimes.<br />
<strong>The</strong> tax would also have<br />
applied <strong>to</strong> domestic heat<strong>in</strong>g<br />
oil add<strong>in</strong>g an extra 4.5<br />
centimes per litre and<br />
ano<strong>the</strong>r 0.35 centimes for<br />
each kWh of natural gas.<br />
<strong>France</strong> produces 90% of its<br />
electricity through nuclear<br />
power and electricity prices<br />
would have rema<strong>in</strong>ed<br />
unchanged. <strong>The</strong> government<br />
estimated that <strong>the</strong> average<br />
household would have paid<br />
an additional €74 a year.<br />
<strong>The</strong> new regulations were<br />
deemed unconstitutional<br />
due <strong>to</strong> <strong>the</strong> large number<br />
of exemptions that<br />
would have resulted<br />
<strong>in</strong> a d<strong>is</strong>proportionally<br />
heavy burden on ord<strong>in</strong>ary<br />
households, while <strong>the</strong><br />
largest <strong>in</strong>dustrial polluters<br />
would have gone largely<br />
untaxed. <strong>The</strong> court noted<br />
that up <strong>to</strong> 1,000 of <strong>France</strong>’s<br />
most pollut<strong>in</strong>g bus<strong>in</strong>esses -<br />
<strong>in</strong>clud<strong>in</strong>g oil ref<strong>in</strong>eries and<br />
cement works – would have<br />
been exonerated.<br />
“<strong>The</strong> large number of<br />
exemptions from <strong>the</strong> carbon<br />
tax runs counter <strong>to</strong> <strong>the</strong> goal<br />
of fight<strong>in</strong>g climate change<br />
and violates <strong>the</strong> equality<br />
enjoyed by all <strong>in</strong> terms of<br />
public charges,” said <strong>the</strong><br />
constitutional council <strong>in</strong> its<br />
last m<strong>in</strong>ute rul<strong>in</strong>g.<br />
Speak<strong>in</strong>g on French radio,<br />
<strong>the</strong> junior m<strong>in</strong><strong>is</strong>ter for trade<br />
and consumption, Hervé<br />
Novelli, admitted, “It was<br />
perhaps shock<strong>in</strong>g that <strong>the</strong><br />
sec<strong>to</strong>rs given exemptions<br />
were those that polluted <strong>the</strong><br />
most. So we will have <strong>to</strong> put<br />
that right.”<br />
President Sarkozy has been<br />
<strong>in</strong>creas<strong>in</strong>gly zealous <strong>in</strong> h<strong>is</strong><br />
pursuit of environmental<br />
causes s<strong>in</strong>ce <strong>the</strong> strong<br />
performance of <strong>the</strong> French<br />
Green party <strong>in</strong> 2009’s<br />
European elections,<br />
claim<strong>in</strong>g when <strong>the</strong> carbon<br />
tax was unveiled: “It’s a<br />
question of survival of <strong>the</strong><br />
human race”. <strong>The</strong>re <strong>is</strong> little<br />
he can now do <strong>to</strong> avoid <strong>the</strong><br />
huge embarrassment that<br />
will follow <strong>the</strong> failure of a<br />
highly public<strong>is</strong>ed personal<br />
crusade <strong>to</strong> push <strong>the</strong> tax<br />
through.<br />
<strong>The</strong> bill faced opposition<br />
from <strong>the</strong> outset, with 2/3<br />
of <strong>the</strong> public aga<strong>in</strong>st <strong>the</strong><br />
new tax and environmental<br />
groups warn<strong>in</strong>g <strong>the</strong> tax did<br />
not go far enough <strong>to</strong> be<br />
effective. <strong>The</strong> opposition<br />
Social<strong>is</strong>t party was<br />
understandably overjoyed<br />
at <strong>the</strong> bloody nose given<br />
<strong>to</strong> <strong>the</strong> president by <strong>the</strong><br />
constitutional court. “Th<strong>is</strong><br />
<strong>is</strong> a good dec<strong>is</strong>ion and shows<br />
once aga<strong>in</strong> that Sarkozy’s<br />
way of do<strong>in</strong>g th<strong>in</strong>gs does not<br />
work,” <strong>the</strong> Social<strong>is</strong>t party’s<br />
parliamentary leader, Jean-<br />
Marc Ayrault, <strong>to</strong>ld French<br />
radio. “<strong>The</strong>y announce a<br />
reform, l<strong>is</strong>ten <strong>to</strong> no one and<br />
produce a poor job. It’s a<br />
real mess.”<br />
<strong>The</strong> government <strong>is</strong> <strong>still</strong><br />
determ<strong>in</strong>ed <strong>to</strong> push through<br />
<strong>the</strong> taxe carbone and<br />
will present an amended<br />
proposal with a view <strong>to</strong><br />
it becom<strong>in</strong>g law on 1st<br />
July 2010. <strong>The</strong> last m<strong>in</strong>ute<br />
rejection of <strong>the</strong> new tax <strong>is</strong><br />
not only an embarrassment<br />
<strong>to</strong> <strong>the</strong> government, it will<br />
also leave a large hole <strong>in</strong><br />
government coffers as it<br />
was estimated it would ra<strong>is</strong>e<br />
over €4 billion <strong>in</strong> its first<br />

New ‘triangle’ build<strong>in</strong>g <strong>to</strong> change Par<strong>is</strong> skyl<strong>in</strong>e<br />
<strong>The</strong> Par<strong>is</strong> skyl<strong>in</strong>e could<br />
be about <strong>to</strong> change<br />
for <strong>the</strong> first time <strong>in</strong><br />
20 years as plans are mov<strong>in</strong>g<br />
forward <strong>to</strong> build an enormous<br />
triangular build<strong>in</strong>g <strong>in</strong> <strong>the</strong> Porte<br />
de Versailles area of <strong>the</strong> capital.<br />
<strong>The</strong> 50-s<strong>to</strong>rey office build<strong>in</strong>g<br />
would break Par<strong>is</strong>’ 37-metre<br />
height limit on new build<strong>in</strong>gs.<br />
Officials <strong>in</strong> Par<strong>is</strong> are vot<strong>in</strong>g<br />
on whe<strong>the</strong>r <strong>to</strong> overturn th<strong>is</strong><br />
rule that limits build<strong>in</strong>gs <strong>to</strong> 37<br />
metres with a view <strong>to</strong> six new<br />
skyscrapers eventually be<strong>in</strong>g<br />
built <strong>in</strong> <strong>the</strong> com<strong>in</strong>g years. Par<strong>is</strong><br />
already has a controversial<br />
pyramidal build<strong>in</strong>g: 1989’s<br />
addition outside <strong>the</strong> Pala<strong>is</strong><br />
du Louvre. At 180 metres tall,<br />
<strong>The</strong> changes would have seen petrol and diesel r<strong>is</strong>e by 4 and 4.5 centimes a litre respectively<br />
‘Projet Triangle’ will dwarf its<br />
da<strong>in</strong>ty little s<strong>is</strong>ter.<br />
Many felt <strong>the</strong> 20-meter high<br />
Louvre addition clashed<br />
with <strong>the</strong> palace. <strong>The</strong> new<br />
triangle build<strong>in</strong>g <strong>is</strong> no less<br />
controversial. Den<strong>is</strong> Baup<strong>in</strong>,<br />
<strong>the</strong> Deputy Mayor of Par<strong>is</strong><br />
and a member of <strong>the</strong> Green<br />
Party, has critic<strong>is</strong>ed <strong>the</strong> design<br />
as “bl<strong>in</strong>g-bl<strong>in</strong>g architecture…<br />
We have already got one <strong>to</strong>wer<br />
that adds <strong>to</strong> <strong>the</strong> city’s radiance:<br />
<strong>the</strong> Eiffel Tower. No need for<br />
ano<strong>the</strong>r one.”<br />
Constructed from glass and<br />
metal, <strong>the</strong> 50 s<strong>to</strong>reys will offer<br />
88,000 square metres of office<br />
space. An ass<strong>is</strong>tant <strong>to</strong> <strong>the</strong> mayor<br />
of Par<strong>is</strong>, Anna Hidalgo, was<br />
keen <strong>to</strong> po<strong>in</strong>t out <strong>the</strong> positive<br />
aspects for <strong>the</strong> proposed<br />
project. “Five thousand jobs<br />
will be created and v<strong>is</strong>i<strong>to</strong>rs will<br />
be able <strong>to</strong> go up <strong>the</strong> <strong>to</strong>wer and<br />
look out over Par<strong>is</strong>. And <strong>the</strong>re<br />
will be a new 8,000-metre<br />
public garden.”<br />
<strong>The</strong> new build<strong>in</strong>g, which<br />
will become <strong>the</strong> third highest<br />
structure <strong>in</strong> Par<strong>is</strong> beh<strong>in</strong>d <strong>the</strong><br />
Eiffel Tower and <strong>the</strong> much<br />
maligned Tour Montparnasse,<br />
was designed by Sw<strong>is</strong>s<br />
architects Jacques Herzog and<br />
Pierre de Meuron and <strong>is</strong> already<br />
be<strong>in</strong>g called Par<strong>is</strong>’ answer <strong>to</strong><br />
Lord Foster’s ‘Gherk<strong>in</strong>’ <strong>in</strong> <strong>the</strong><br />

putt<strong>in</strong>g up premiums for <strong>the</strong><br />
first time <strong>in</strong> six years.<br />
House <strong>in</strong>surance will also be<br />
more expensive th<strong>is</strong> year and<br />
health <strong>to</strong>p-up premiums will<br />
see an average <strong>in</strong>crease of<br />
around 5%.<br />
French urged<br />
<strong>to</strong> take out pet<br />
<strong>in</strong>surance<br />
While be<strong>in</strong>g <strong>the</strong> European<br />
country with <strong>the</strong> most pets<br />
(7.8 millions dogs and 10.7<br />
million cats), <strong>France</strong> <strong>is</strong> far<br />
beh<strong>in</strong>d <strong>in</strong> terms of <strong>in</strong>sur<strong>in</strong>g<br />
its animals. In Sweden 80%<br />
of cats and dogs are <strong>in</strong>sured,<br />
<strong>in</strong> <strong>the</strong> UK 20% are covered<br />
and <strong>in</strong> <strong>France</strong> just 2%.<br />
Lead<strong>in</strong>g pet <strong>in</strong>surer SantéVet<br />
<strong>is</strong>, however, not<strong>in</strong>g a sharp<br />
r<strong>is</strong>e <strong>in</strong> <strong>the</strong> number of pets<br />
be<strong>in</strong>g <strong>in</strong>sured <strong>in</strong> <strong>France</strong>,<br />
reg<strong>is</strong>ter<strong>in</strong>g premiums of over<br />
10 million euros <strong>in</strong> 2009.<br />
<strong>The</strong> market for pet <strong>in</strong>surance<br />
<strong>is</strong> relatively new <strong>in</strong> <strong>France</strong>.<br />
<strong>The</strong> notion of keep<strong>in</strong>g a pet<br />
has evolved over <strong>the</strong> years;<br />
<strong>in</strong> rural communities, where<br />
it was once considered usual<br />
<strong>to</strong> keep a dog on a cha<strong>in</strong><br />
outside, now we f<strong>in</strong>d our<br />
four-legged friends curled up<br />
