Bona fide transactions are not caught. <strong>GAAR</strong> only comes into play if the transactions are legally effective in conformity with the relevant Act and are not a sham but, in the opinion of the Revenue, are devoid of economic substance and carried out with the sole purpose of obtaining a tax benefit. • 8.
