A. I could not say he was drunk: he only
had two glasses of beer when I was there.
There were five of us and I spent half a dollar
on beer.
Q. You say you paid him thirty-seven dollars
A. Yes sir: I gave him $21.00 in paper
money and $6.00 in money and the rest an
express money order.
Q. You don’t remember how long you
stayed there that time
A. No, that I would not say. I know I did
not stay very long. I know it would not
exceed half an hour.
Q. Where did you go then
A. I went up to the little mill there. I
wanted to see Joe Ritz in the meantime I
saw John Ridge, a fellow that used to be in
there. I asked him where Joe Ritz was, and
he said he left last night for town, and I
did not see anybody else around so I went
right back again.
Q. Did you see Mr. Johnson after you got
back again
A. When I came back to the crossing I
heard a fight, it was in full blast.
Q. Now, the crossing was how far from the
A. It might be a hundred feet, but I don’t
think it is that much.
Q. You say you heard the fight. What do
you mean by that
A. I heard the sound of the club pounding.
I got near the door, Mr. Fry said, “God
Damn son of a bitch, I want my time book
and my checks!” and at the same time Fry
came out the door.
Q. Did you go up to the saloon after that
A. Yes, but Mr. Johnson locked the door.
Q. Did you see him inside or look through
the window
A. Yes Sir.
Q. What was he doing
A. He was wiping himself.
Q. Was he bleeding
A. Yes.
Q. Whereabouts as near as you can tell
A. He was bleeding right under the ear.
Q. Did you have any farther talk with Mr.
Fry
A. Yes.
Q. Was it in regard to the trouble there
A. Yes.
Q. State what that was.
A. I stayed outside the door after Johnson
lock the door. Fry was gone, and I sat
around there for about five minutes and
looked around. I saw Johnson did not
open the door, and Mr. Fry motioned me
