A. He said, “What is those” I said, “Those
are my checks.” And he grabbed them and
hit me right on the face.
Q. Had you not said anything to him
A. No Sir, we had not talked at all.
Q. With out saying anything to you, he
struck you in the face
A. Yes Sir.
Q. What did he strike you with
A. His hand.
Q. What did you do then
A. I stepped back to keep him from hitting
me and he took up the axe handle and
raised it to strike me, and I rose up and
took it out of his hand.
Q. What did you do then Did you hit
him
A. Yes Sir.

A. I could not say as to that.
Q. Where was he; behind the bar
A. Yes.
Q. You had the axe handle
A. Yes sir, after I took it away from him.
Q. How far were you from the door
A. About four or five feet.
Q. What happened after that
A. He grabbed a glass and a bottle and
went after me again.
Q. What kind of glass
A. A beer glass.
Q. And what kind of bottle
A. A beer bottle, and he came round to the
end of the bar.
Q. What were you doing in the meantime
A. I stepped up to the door.
