SAN ANTONIO HOUSING AUTHORITYSECTION 3 PROGRAMCONTRACTOR COMPLIANCE GUIDEBACKGROUNDThe San Antonio Housing Authority (SAHA) adopted a formal Section 3 program, policy, andprocedures on June 2, 2011 (Resolution 5164) to provide the framework for its compliance withSection 3 of the Housing and Urban Development (HUD) Act of 1968 which applies to allemployment and economic projects funded in whole or in part by HUD.Therefore, all prime contractors participating on a HUD-assisted project shall comply with allapplicable sections of the SAHA Section 3 Program.The objective of the SAHA Section 3 Program is to ensure to the greatest extent feasible thatemployment and other economic-related opportunities are directed to low- and very-low incomeindividuals and businesses owned by such individuals.SECTION 3 GUIDANCE1. The SAHA Section 3 Program adopted on June 2, 2011 is hereby incorporated byreference as part of this Section 3 Guidance. Notice is hereby given that it is theresponsibility of bidder/proposer or contractor to ensure understanding and compliancewith all applicable sections of the Section 3 Program. Bidders/proposers and/or primecontractors are directed to the SAHA website for more information on the Section 3Program.2. The Section 3 Program requirements apply to all HUD-assisted projects covered bySection 3 and are therefore applicable to SAHA bidders/proposers and recipients ofcontracts and subcontracts.3. In order to achieve the Section 3 Program objectives, numerical goals fortraining/employment and subcontracting opportunities for Section 3 residents andBusiness Concerns have been established. The Section 3 goals (below) apply to theentire Section 3 covered project and represent minimum numerical goals set forth in theSection 3 Program. In the absence of evidence to the contrary, a contractor that meetsthe minimum numerical goals will be considered to have complied with the Section 3Program requirements. SAHA reserves the right to increase project-specific goals asmay be deemed appropriate by the SAHA representatives. Contractors are advised toread each solicitation carefully to determine the applicable goals for compliance. In theevent the solicitation changes the goals listed below, Contractor must follow the strictergoals.Page 1 of 6
