6CHAPTER –IISPEEDY PAYMENT OF FAMILY GRATUITY AND PENDING ENQUIRYAWARDSECTION-1SPEEDY PAYMENT OF FAMILY GRATUITY12. (a) To ensure speedy payment of family gratuity in case of death in service, due towounds sustained in action, flying accidents or parachute jumping or while employed inaid to civil power etc., as enumerated in Chapter IV of Pension Regulations <strong>for</strong> <strong>the</strong> Army,Part I (2008), highest priority shall be given to <strong>the</strong> completion of proceedings of <strong>the</strong>Court of Inquiry, which have a vital bearing on <strong>the</strong> finalisation of <strong>the</strong> liberalised/specialfamily <strong>pension</strong>ary awards. It shall be ensured by all concerned that no delay occurs atany stage in <strong>for</strong>warding <strong>the</strong> proceedings, with necessary remarks of <strong>the</strong> competentauthority, to <strong>the</strong> Principal Controller of Defence Accounts (Pensions) through <strong>the</strong>prescribed channels. All assistance shall be given by <strong>the</strong> concerned RecordOffice/Service Headquarters to <strong>the</strong> claimants in filling up <strong>the</strong> details in <strong>the</strong> prescribed<strong>pension</strong>ary <strong>for</strong>ms.The initial action and reporting <strong>for</strong> finalisation of <strong>the</strong> family gratuity claim is laiddown in Appendix-III to <strong>the</strong>se Regulations.(b) The payment of family gratuity shall be made by Controller of DefenceAccounts (Officers) in <strong>the</strong> case of Officer and Pay Accounts Office concerned in case ofPersonnel Below Officer Rank. While initiating special family <strong>pension</strong>/liberalised family<strong>pension</strong> claims, <strong>the</strong>se authorities should intimate to <strong>the</strong> Principal Controller of DefenceAccounts (Pensions), if any payment of family gratuity at <strong>the</strong>ir end has been made to <strong>the</strong>widow/ heir.PROVISIONAL PAYMENT OF FAMILY GRATUITY13. The Controller of Defence Accounts (Officers) in <strong>the</strong> case of Officer, andController of Defence Accounts under whose jurisdiction <strong>the</strong> Pay Accounts Officer(O<strong>the</strong>r Ranks) attached to Record Office in <strong>the</strong> case of Personnel Below Officer Rank,shall make provisional payment of family gratuity to <strong>the</strong> following extant immediately onreceipt of <strong>the</strong> prescribed report accompanied by <strong>the</strong> relevant documents, to <strong>the</strong> eligiblemember of <strong>the</strong> family of <strong>the</strong> individual.(i)Cases falling under circumstances (i) , (iv), (v), (vi), (vii) &(viii) ofRegulation 137 of Pension Regulations <strong>for</strong> <strong>the</strong> Army , Part I (2008)- 100percent of Family Gratuity.(ii) Cases falling under circumstances (ii) & (iii) of Regulation 137 of PensionRegulations <strong>for</strong> <strong>the</strong> Army , Part I (2008) - 75 percent of Family Gratuity.PAYMENT OF FAMILY GRATUITY- OFFICERSPension Regulations <strong>for</strong> <strong>the</strong> Army, Part II (2008)
